VEHICLE AND REGISTERED PLANT FLEET PROCUREMENT PROGRAMME 2010/2011

Purpose of Report

To seek approval to procure new and replacement vehicles and registered plant in 2010/11 as per the attached programme.

Background

The preparation of the Vehicle and Registered Plant Fleet Replacement Programme for 2010/11 has been undertaken by the Council’s Fleet Section in consultation with User Directorates/Sections, including a review of current vehicle condition and service.

Vehicles acquired by Contract Hire such as fleet cars are dealt with separately and are not included in this report.

The proposed programme is shown on the attached Appendix. It is noted however that the Fleet Manager, in conjunction with User Directorates, may opt to extend the working life of individual vehicles once tenders are received where there are economic advantages to be gained.

The means of financing the acquisition of each of the items listed will be either by Operating Lease, Outright Purchase or Prudential Loan.

 Operating Lease - can be used for the acquisition of vehicles and plant but cannot be considered for pre-owned items.

 Outright Purchase - can be used to acquire new or pre-owned vehicles or items of plant. Items acquired by this means will involve monthly contributions to the Renewals Fund for a pre- determined period of time.

 Prudential Loan - can be used to acquire new or pre-owned vehicles or items of plant. Items required by this means will involve loan repayments for a pre-determined period of time.

Most of the fleet is on a 7- year replacement cycle.

The financing costs of the vehicle acquisitions will be a charge on the relevant Directorates’ Operating Account and the means of acquisition will be agreed between the Fleet Manager and user Directorate in each case.

Sustainability Appraisal

Will have a positive impact on the Community Plan themes of Environment and Transport and Economic Prosperity in view of increased service reliability and reduced emissions.

Recommendation

It is recommended that the proposed Vehicle and Registered Plant Procurement Programme attached as Appendix 1 be approved for 2010/11.

Reason for Proposed Decision

The vehicles and items of plant listed in this report have reached the end of their economic life and their replacement will have a beneficial effect on both the environment and the productivity of the Council.

GNOLL ESTATE COUNTRY PARK GRANT OFFER

Purpose of Report

To seek Members’ approval to accept grant aid from the Forestry Commission for the eradication of Rhododendron ponticum from the Gnoll Estate Country Park

Background

Over the past several years there have been localised outbreaks of Phytopthora (Sudden Oak Death Syndrome) in the Gnoll Estate Country Park. This has resulted in enforcement notices being served on the authority by DEFRA requiring the removal of infected areas to take place within 30 days. A host species for this highly infectious disease is Rhododendron ponticum. These outbreaks have been treated locally using existing resources, by on site cutting back, burning the diseased trees, and applying a selective herbicide to the cut stumps.

The Welsh Assembly Government through the Better Woodlands for Scheme administered by Forestry Commission have now made funding available for land owners to eradicate Rhododendron ponticum on sites where Phytothora has been found, and invited County Borough Council to submit an application.

For ease of management the Gnoll Estate Country Park has been divided into compartments 1A to 1N and the levels of Rhododendron ponticum in each compartment assessed. A price based on established criteria was subsequently calculated to work out the estimated cost of treatment and it is on this basis that the amount of grant aid required was calculated and submitted to WAG.

In response to the Council’s application a grant has been offered and if accepted it is anticipated that part if not all of the work could be undertaken by the existing Parks and Neighbourhood employees partly during this spring, and partly between September 2010 and February 2011. To confirm if this is feasible, it is consequently being arranged to undertake a trial clearance in one of the identified compartments.

EHB-250210-REP-EN-MR 8 Should it not prove possible for the in-house workforce to undertake all the work then tenders would be sought from a suitable contractor.

Financial Implications

Given the potential for tenders being sought the level of available grant funding is not being made publically available at this time. A verbal update will be given at Cabinet Board.

There is no matched funding requirement associated with the grant but the Council would effectively be committed to topping up the resources funded by the grant with labour from within the Parks & Neighbourhood Service, if necessary, to complete the removal of Rhododendron ponticum.

Should the Council not accept the grant offer and not undertake the removal of the Rhododendron ponticum there is a likelihood of further outbreaks of Phytopthora and this would result in further enforcement notices being served on the Council. If this happened the Council would have to comply with any erradication at its own expense.

There is a requirement from the Forestry Commission that the grant offer is accepted within 30 days.

Sustainability Appraisal

This work would have a positive environmental impact on the future of the Gnoll Estate Country Park by the removal of the invasive non native species Rhododendron ponticum and preventing the spread of a notifiable tree disease (Phytopthora).

Recommendation

That Members accept the offer of grant aid (exact amount to be advised at Cabinet Board) and that the Principal Country Parks and Grants Officer be authorised to sign the grant offer contracts, after consultation with the Head of Legal and Democratic Services.

To accept an offer of grant aid towards eradication of Rhododendron ponticum from the Gnoll Estate Country park.

STREETCARE FEES & CHARGES 2010/2011

Purpose of Report

To seek Members approval of proposed Fees and Charges for Streetcare Services.

Background

Due to increasing costs it is necessary to review and/or increase fees and charges for the use of the following services:

Parks & Neighbourhood Services:– See Appendix A

Except where otherwise indicated, increases are in line with corporate assumptions of 2.1%, rounded up to the nearest 5 pence.

Drainage, Streetworks & Trunk Road Services:– See Appendix B

Except where otherwise indicated, increases are in line with corporate assumptions of 2.1%, rounded up to the nearest 5 pence.

Trade Waste:– See Appendix C

The trade waste service is a chargeable function currently provided to around 1300 customers throughout the County Borough.

In order to keep pace with increasing service costs owing to, in the main, landfill tax and disposal charges rising at a rate above inflation, it is proposed to increase charges by 7.5%.

Festive Lighting:

It is proposed to increase charges to Town and Community Councils in respect of the erection, maintenance and dismantling of festive lighting in line with the corporate assumption of 2.1%. The supply of any additional decorations or renewal of unserviceable equipment will remain subject to individual pricing.

PROCESS OF STREET INSPECTIONS

Purpose of Report

To seek approval of an internal Highway Defect Inspection Manual, the purpose of which is to set out the Council’s strategy and process in relation to highway defect inspections as part of fulfilling the Council’s statutory duty as a Highway Authority.

Background

The draft Highway Defect Inspection Manual is given as Appendix A.

The document has been developed in line with the recommendations laid down in the Code of Practice for Highway Maintenance Management July 2005. It sets out specified frequencies of inspection and intervention levels depending on local and national factors, formalising a Defect Inspection Regime to comply with Section 41 of the Highways Act 1980.

The guidelines contained within the document are intended to provide assistance to all inspectors involved in undertaking Street Inspections to carry out their duties with consistency.

[The Welsh Assembly Government is Highway Authority for the Motorway and Trunk Road Network which are therefore not covered by this document.]

Sustainability Appraisal

Adoption of the proposed Highway Defect Inspection Manual will contribute to the proper management of the public highway by the Council acting in its statutory role as Highway Authority.

Recommendation

It is recommended that the Highway Defect Inspection Manual attached as Appendix A be approved.

The purpose of this document is to set out the Council’s strategy in relation to Highway Defect Inspections, and forms part of the Council’s statutory duty, as a Highway Authority, to maintain highways maintainable at public expense(1). This document has been developed in line with the recommendations laid down in the Code of Practice for Highway Maintenance Management July 2005.

The aim of the guidelines contained within this document are intended to provide assistance to all inspectors involved in undertaking Defect Inspections to carry out their duties with consistency and to clear recognised and understood criteria.

2. ORGANISATION

Streetcare Services which is part of Neath Port Talbot’s Environment Directorate covers the majority of the client and operational functions for highway maintenance management, other than those relating to structures.

The Streetworks team is part of the Drainage, Streetworks and Trunk Roads section within Streetcare, responsible for providing a service which includes the defect inspection regime. The team comprises a supervisor and three highway inspectors. The highway inspectors’ record defect inspections using hand held data capture devices, and issue this information for action/repair.

For the purpose of the inspection regime the authority has been split into 3 areas (see Appendix A), each with a nominated highway inspector. The areas are split as such:-

 North ( / Lliw Valley)  Central (Neath / Neath Valley)  South (Port Talbot / Afan Valley)

Resilience Planning In the event of an emergency event the Emergency Response / Escalation Procedure will be implemented. As a result the highway defect inspection regime may be suspended until circumstances change and normal working practices resume.

EHB-250210-REP-EN-MR 24 3. DEFECT INSPECTION POLICY

The document sets out specified frequencies of inspection and intervention levels depending on local and national factors, formalising a Defect Inspection Regime to comply with Section 41 of the Highway Act 1980.

Neath Port Talbot have developed carriageway and footway categories based on the frequency of inspection and the type of inspection undertaken. The frequency of inspections are split into four categories covering monthly, three monthly, six monthly and annual inspections and are referenced category 1, 2, 3 and 4, respectively. The two types of inspections used within Neath Port Talbot are Driven Inspections and Walked Inspections and are referenced category A and B respectively.

For example:- A monthly driven inspection would have a category reference 1A. The number 1 defining the frequency of inspection (monthly) and the letter A defining the type of inspection (driven).

Driven Inspections

All driven routes comprise inspections undertaken with a driver and a Highway Inspector, carried out from a slow-moving vehicle appropriate to the road conditions, where the carriageway only is assessed.

Walked Inspections

All walked routes comprise inspections undertaken by a Highway Inspector, which is a detailed inspection carried out at a walking pace from the footway, where the footway and carriageway is assessed.

Route Planning

The carriageway and footway hierarchy for highways maintainable at public expense within Neath Port Talbot County Borough Council have been developed in line with local factors and the recommendations laid down in Section 8 of the Well Maintained Highways - Code of Practice for Highway Maintenance Management.

The Authority’s carriageway and footway categories, hierarchy and inspection frequencies for driven routes and walked routes are detailed in

EHB-250210-REP-EN-MR 25 Appendix B. A summary of the Highway Defect Inspection frequencies is shown in Table 1 below. 4. INSPECTION ASSESSMENT & INVESTIGATORY LEVELS

There are many different types of defects that the inspector is expected to identify and record. The following list has been compiled taking into account the main highway elements likely to cause inconvenience to users of the network and the wider community; but should not be taken as an exhaustive list.

Primary identifiable defects:-

. potholes, cracks or gaps in the running surface; . ironwork (gully covers, manholes etc) broken, raised, sunken or missing; . rocking or otherwise unstable footpath surfaces; . crowning, depression and rutting in the running surface; . abrupt level differences in the running surface; . kerbing, edging or channel defects; . edge deterioration of the running surface;

Level of response

This manual defines defects in two categories:

 Priority 1 - Defects that require prompt attention because they represent an immediate or imminent hazard to highway users.  Priority 2 – All other defects, where the actual size/position of the defect will not represent an immediate or imminent danger to highway users.

Priority classification of deficiencies will depend upon:

. the depth, surface area, or other extent of the defect; . the location of the defect relative to highway features such as junctions and bends; . the location of the defect relative to the positioning of users, especially vulnerable users, such as in traffic lanes or wheel tracks; . the nature and extent of interaction with other defects; . forecast weather conditions, especially potential for freezing of surface water.

Defects considered as EMERGENCIES and pose a particular high risk must be reported to the relevant officer for immediate attention at the time of inspection. Examples of such defects may be:-

. carriageway collapse or comparable severe surface defects with high probability of loss of control. . missing or defective ironwork that has a high probability of injury or loss of control.

 Priority 3 – used to reference streets with no identifiable defects; and sections of highway which are passed to the Network Management team for consideration for inclusion in the annual resurfacing programme.

5. RECORDING DEFECTS

Hand-held data capture devices are used to record all defects identified. The inspector should use simple terms at all times when describing and recording defects identified during inspections. Descriptions should be short and to the point, it may also be beneficial to photograph some defects, as this will help both the inspector and the repair team. Where possible the terminology set out in the ‘Code of Practice’ and those in this guide should be used.

To enable the repair teams to undertake effective repairs in the first instance it is important that certain critical information is passed on to the teams. This information must be recorded during the inspection on site

EHB-250210-REP-EN-MR 29 and recorded in a clear and concise manner. The three most important pieces of information to be recorded are:-

 LOCATION  TYPE OF DEFECT  DEFECT PRIORITY

LOCATION

Identifying the precise location of the defect is essential for the repair team to carry out the necessary repair. It is important therefore that the information recorded by the inspector is simple and easily understood. To locate a defect efficiently, the repair team requires two pieces of information:

. Location along the street. . The position of the defect on the highway/footway.

Location along the Street

This information will assist in using operational resources effectively. One or a combination of the following can be used:

. House number. . Street lamp number. . Building name. . Road junction.

Where there are no houses in the street the street lamp number may be used. Where neither houses nor street lamps exist the defect may, as a last resort, be marked with road marking paint. House names can be difficult to locate especially on long roads, so if it is necessary to give a house name it would help the repair team to have some other additional information such as;

. Derwen House- between Streetlamp 18 and Streetlamp 19

Some other examples for locating a defect along a street are: -

. outside 38. . adjacent to 60. . 10 metres from Streetlamp no.25.

The actual position of the defect in relation to the localised footway/carriageway is essential to enable the repair team to locate and rectify it. Again, simplicity in describing its position is the key to success.

Some examples are: -

. in carriageway channel. . at rear of the footway. . adjacent to. . at edge of tactile paving. . on radius kerb. . on verge. . on central reservation. . on vehicle crossing.

This list is by no means definitive. However, by using combinations of these and similar terms it is possible to give simple but clear instructions, which will help to record and input the location of the defect for the repair team.

Examples:-

. Near Derwen House between streetlamp 18 and 19 at rear of footway. . Adjacent to 60 New Road in carriageway channel.

TYPE OF DEFECT

When describing a defect it will be helpful to refer to the particular material that is affected by the defect. In some cases the defect may affect several materials and these will also need to be covered within the description. Such information is particularly helpful to the repair teams and can reduce unproductive time. Where it is necessary to replace an item, the product type and/or size, if possible should be given. Examples:-

. pothole 300 x 300 >40mm deep. . end damage to kerb. . missing block paviour (red) 200mm x 100mm x 65mm thick.

EHB-250210-REP-EN-MR 31 . damaged road gully cover 255mm x 300mm. . ACO footway drainage grating 1000mm x 100mm wide missing. . damaged p.c.c. paving slab 600mm x 600mm x 50mm thick.

DEFECT PRIORITY

All Priority 1’s must be reported to the responsible Streetcare Area Supervisor, or section responsible for the designated repair team. The inspector must telephone through as soon as they are identified, to enable the repair to be done as soon as possible. The inspection reports/photographs relating to the Priority 1’s must then be passed to the responsible section on returning to the office.

Inspection reports for all Priority 2 defects are issued to the section responsible for the designated operational repair teams.

Priority 2 defects identified on one monthly ‘Driven’, one monthly ‘town centre’ and three monthly ‘School’ inspections should be highlighted to the responsible Streetcare Area Supervisor to prioritise the repair response time accordingly.

Any street where there is no defect to report must be included in the inspectors report and recorded as a Priority 3.

Other information such as the ‘date of inspection’, ‘category of road’ and who the report is to be ‘passed’ to for action must also be recorded on the report at the time of inspection.

Third Party Safety Defects

During an inspection, a defect may be identified which is not the responsibility of the Council to repair. The Council does however have a duty of care to all users of the highway. The inspector should therefore take steps where necessary to ensure that the party responsible for the repair is made aware of the defect.

Typical third party defects include defective utility covers, and overgrowth issues. Utility defects are referred to the Streetworks team for action; a section 81 notice is sent to the responsible statutory undertakers for repair. The overgrowth defects are referred to the highway surveyor for action; a letter is sent to the landowner requesting the appropriate action.

EHB-250210-REP-EN-MR 34 NPT CATEGORY DESCRIPTION FREQUENCY 1A Strategic Routes carry a substantial element of 1 Month Routes through traffic across the County Borough (Driven) to major centres of population and commerce elsewhere. Strategic routes are for fast moving long distance traffic with little frontage access or pedestrian traffic. Speed limits are usually in excess of 40 mph and there are few junctions with parking only allowed in purpose designated lay-bys or service areas. Pedestrian crossings are either segregated or controlled and parked vehicles are generally prohibited.

2A Main Important routes which connect the main 3 Months Distributor residential and employment areas of the (Driven) Routes Borough, linking urban centres to the strategic network with limited street parking and frontage access. Speed limits in urban areas are usually 40 mph or less, and there are positive measures for pedestrian safety.

In rural areas these roads link the larger villages and HGV generators to the Strategic and Primary Network.
