Proceedings of 256th Meeting of ERC-NCTE held on 30th – 31st May, 2018 PROCEEDINGS OF 256th MEETING OF THE ERC-NCTE HELD ON 30th – 31st May, 2018 The 256th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was held on 30th – 31st May, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 256th ERC Meeting. Prof. Shukla Mahanty - Chairperson Prof. (Mrs.) S.M. Meenakumari Devi - State Representative of Manipur Prof. Vanlalhruaii - State Representative of Mizoram Shri Vijay Kumar Mishra - State Representative of Bihar Dr. Shanti Ram Adhikari - State Representative of Sikkim Shri Pradeep Kumar Yadav - Regional Director (I/C), ERC & Convener At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. No. Item No. Content Confirmation of the Proceedings of 255th meeting held on 30th April to 2nd May, 2018 at Bhubaneswar. ER-256.1 Confirmed. ATTENTION! 1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. Shri Pradeep Kumar Yadav (RD/Convener, ERC, NCTE) Prof. Shukla Mahanty (Chairperson ERC, NCTE) 1 Proceedings of 256th Meeting of ERC-NCTE held on 30th – 31st May, 2018 ER-256.3 Circular, Guidelines and Instructions received from NCTE Hqrs 1. 256.3.1 Explanation of the Convener of the Committee as per Clause 7(12) of NCTE Regulations, 2014 (F. No. 3-18/NCTE/ERC/Reg./2017) NCTE vide letter No. NCTE-CDN016(13)/18/2018-CDN-HQ/66012 dated 16.05.2018 seeking explanation of the Convener under Clause 7(12) of NCTE Regulation, 2014. The Committee considered the matter therein and it is resolved that since there is no clear cut instruction to implement it from the retrospective dates of recognition as per the NCTE Regulations. The Committee decided to consider the stipulations for the prospective applications. It will create hue and cry among the recognised teacher training institutions. The decision of ERC be intimated to the NCTE HQs. accrodingly. 2. 256.3.2 Circulation of the Minutes of 47th meeting of the General Body of NCTE held on 28th March, 2018.(F. No. 22-1/NCTE/ERC/MGBM/2018) NCTE vide letter No. F.NCTE-CDN011(11)/2/2018-US(CDN)-HQ dated 10th April, 2018 circulated the minutes of 47th meeting of the Gerental Body of NCTE and the same was placed for appraisal of ERC. 3. 256.3.3 Draft Teacher Eligibility Test (TET) Guidelines received from NCTE HQs., New Delhi. (F. No.3-1/NCTE/ERC/Reg./2018) The comments sought on the draft Teacher Eligibility Test (TET) Guidelines for Elementary, Secondary and Senior Secondary levels of Education developed by the Committee constituted by NCTE HQs., New Delhi received through e-mail dated 06.4.2018 was circulated among the Members of the ERC. ER-256.2 [Court Case] Abdul Jabbar College of Education, Plot No.3576, 3578, Vill-Natatala, PO-Paharpur, 4. 256.2.1 Tehsil/Taluka-Lalgola, Dist:-Murshidabad, West Bengal-742148 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (ERCAPP3016) The institution was granted recognition for D.El.Ed. course with an intake of 50 (one basic unit) from the academic session 2016-2017 vide order No. ER-234.6.26(Part-2)/ERCAPP3016/D.El.Ed./2016/51718 dated 20.03.2017 by the ERC, NCTE. The institution filed W.P. (C) No 852 of 2018 in the High Court of Delhi. The Hon’ble High Court disposed of the matter on 30.01.2018 with a direction inter alia: “Learned Counsel appearing for the respondent/NCTE on advance notice is unable to either deny or admit the contentions made by the learned counsel for the petitioner. Keeping in view the contentions raised by the learned counsel for the petitioner and order passed by this Court, the respondents are directed to treat the present writ petition as representation and decide the same by passing reasoned and speaking order within six weeks”. The order passed by the Hon’ble Court was forwarded to NCTE HQs., New Delhi through e-mail dated 12.04.2018 for further directions. In response, e-mail dated 16.05.2018 received from NCTE HQs. with the opinion that the matter be considered in ERC Meeting. Accordingly, the Committee considered the aforesaid matter and observed as under: (i) The institution submitted willingness affidavit on Rs.100/- non-judicial stamp paper only for 50 intake i.e. One Unit. (ii) The institution submitted approved faculty list (1 HOD + 9 lecturers) for 50 intake (One Unit) only instead of required faculty (1 HOD + 15 lecturers) for 100 intake (Two Units) as per NCTE Regulations, 2014. Hence, the decision of ERC taken in 234th meeting granting recognition for 50 intake in D.El.Ed. programme remain unchanged. In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position. (Private) (The West Bengal University of Teachers’ Training, Education Planning and Administration) (ERCAPP3465) The institution was granted recognition for B.Ed. course with an intake of 50 (one basic unit) from the academic session 2016-2017 vide order No. ER-213.6(i).168/ERCAPP3465/B.Ed./2016/46334 dated 02.05.2016 by the ERC, NCTE. The institution filed W.P. (C) No 1211 of 2018 in the High Court of Delhi. The Hon’ble High Court disposed of the matter on 09.02.2018 with a direction inter alia: “Learned counsel appearing for the respondent/NCTE on advance notice is unable to either deny or admit the contentions made by the learned counsel for the petitioner. Keeping in view the contentions raised by the learned counsel for the petitioner and the orders passed by this Court, the respondents are directed to treat the present writ petition as representation and decide the same by passing reasoned and speaking order within six weeks”. Hence, the decision of ERC taken in 213th meeting granting recognition for 50 intake in B.Ed. programme remains unchanged. In view of the above, the Committee decided as under: A reasoned order be issued to the institution stating the above position. Satyendranath Basu D.El.Ed. and B.Ed. College, Plot No LR 3250, 3252, Street No- NH 34, Vill:- Itla, PO-Kalirhat, Tehsil/Taluka- Kishnanagar, Town/City- Kishnanagar, 6. 256.2.3 Dist:-Nadia, West Bengal-741102 (B.Ed.) (Private) (The West Bengal University of Teachers’ Training, Education Planning and Administration) ((ERCAPP4266) Recognition to B.Ed. course was refused vide ERC order dated 18.07.2016. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-486/2016 Appeal/15th Meeting-2016 dated 03.01.2017 rejected the appeal and the order of ERC confirmed. The institution filed writ petition bearing No W.P.
