SENATE BILL No. 1257 No SENATE BILL No. 1257 SENATE BILL No. 1257 September 11, 2012, Introduced by Senator KAHN and referred to the Committee on Appropriations. A bill to amend 1987 PA 248, entitled "Airport parking tax act," by amending section 7a (MCL 207.377a), as amended by 2006 PA 135. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 7a. (1) On the first day of each month, the state 2 treasurer shall make a distribution from the fund in the following 3 order of priority: 4 (a) To the state aeronautics fund created in section 34 of the 5 aeronautics code of the state of Michigan, 1945 PA 327, MCL 259.34, 6 an amount that equals a total of $6,000,000.00 per state fiscal 7 year. The funds distributed subject to this subdivision shall be 8 used exclusively for safety and security projects at state 9 airports, including reimbursement to the comprehensive 10 transportation fund of amounts used to pay principal and interest 11 on bonds issued on or before December 31, 2007 by the state SENATE BILL No. 1257 05934'12 JLB 2 1 transportation commission under section 18b of 1951 PA 51, MCL 2 247.668b, and to provide the matching funds by this state for 3 federal funds to be used for safety and security at state airports. 4 (b) To each city within which a regional airport facility is 5 wholly located in an amount that equals a total of $1,500,000.00 6 per calendar year divided by the total number of cities within 7 which a regional airport facility is wholly located. The 8 distribution described in this subdivision shall be deposited in 9 the general fund of the city. 10 (C) TO THE MICHIGAN MEDICAID BENEFITS TRUST FUND ESTABLISHED 11 IN SECTION 5 OF THE MICHIGAN TRUST FUND ACT, 2000 PA 489, MCL 12 12.255, AN AMOUNT EQUAL TO $6,653,800.00. 13 (D) (c) A distribution to each qualified county in an amount 14 equal to the total amount remaining in the fund multiplied by a 15 fraction the numerator of which is the population of that qualified 16 county during the immediately preceding year and the denominator of 17 which is the total population of all qualified counties during the 18 immediately preceding year. The distribution described in this 19 subdivision shall be deposited in the general fund of the qualified 20 county to be used only for indigent health care. Each fiscal year 21 the qualified county shall provide written documentation to the 22 state treasurer, to the state treasurer's satisfaction, that the 23 distribution described in this subdivision was used for indigent 24 health care. In addition, the qualified county shall also provide 25 written documentation to the state treasurer of all other revenues 26 that were used for indigent health care in that fiscal year. If the 27 state treasurer determines that the qualified county did not use 05934'12 JLB 3 1 the distribution described in this subdivision for indigent health 2 care in any fiscal year, the qualified county shall immediately 3 repay those funds to the state treasurer to be deposited into the 4 general fund of this state. 5 (2) The distribution provided by subsection (1) shall not be 6 made if all taxing units are authorized by law to impose taxes and 7 the collection is made of taxes imposed under 1953 PA 189, MCL 8 211.181 to 211.182, on concessions at a regional airport facility. 9 (3) As used in subsection (1)(a), "state airports" means all 10 of the following airports located in this state: 11 (a) Adrian - Lenawee County airport. 12 (b) Allegan - Padgham field. 13 (c) Alma - Gratiot community airport. 14 (d) Alpena - Alpena County regional airport. 15 (e) Ann Arbor - Ann Arbor municipal airport. 16 (f) Atlanta - Atlanta municipal airport. 17 (g) Bad Axe - Huron County memorial airport. 18 (h) Baraga - new airport. 19 (i) Battle Creek - W.K. Kellogg airport. 20 (j) Bay City - James Clements airport. 21 (k) Bellaire - Antrim County airport. 22 (l) Benton Harbor - southwest Michigan regional airport. 23 (m) Big Rapids - Roben-Hood airport. 24 (n) Cadillac - Wexford County airport. 25 (o) Caro - Tuscola area/Caro municipal airport. 26 (p) Charlevoix - Charlevoix municipal airport. 27 (q) Charlotte - Fitch H. Public Comment Undersheriff Dean Pratt read a written statement (see attached pgs. 7-8) regarding the actions taken by the Sheriff’s Department during the March 10, 2018, homicide investigation. Mr. Pratt also read the following statement from a relative of the 15-year-old survivor: “I strongly feel that all the law enforcement involved including the Antrim County Sheriff Department, Kalkaska County Sheriff’s Department, Michigan State police, EMS, fire dept, Munson hospital did a great job with such a tragic situation. I am confident that law enforcement had it handled. If any of you want to do anything helpful and kind, keep all involved in your thoughts and prayers, especially for the man who passed from his injuries and his wife and family. If you don’t have anything nice or helpful to say, keep it to yourself. There is a lot of families hurting from this tragedy and I want to remind you to be kind to one another and keep in mind most posts on social media regarding this tragedy have not been accurate.
