CANON 294 ECCLESIASTICAL CIRCUMSCRIPTIONS AND THEIR RELATIONSHIP WITH THE DIOCESAN BISHOP What is the relationship of the faithful in personal ecclesiastical circumscriptions to the local diocesan bishop? OPINION The Apostolic See, in the Annual General Statistical Questionnaire, asks diocesan bishops the number of priests in the ecclesiastical circumscription of the diocese, their country of origin and whether they are diocesan or religious. The fact that the diocesan bishop is answering these questions indicates the close relationship between himself and any personal Ecclesiastical Circumscription. Canons 215 and 216 of the 1917 Code required that ecclesiastical circumscriptions be territorial within a diocese and an apostolic indult was needed, for example, to establish personal parishes for an ethnic group of the faithful. After World War II, Pope Pius XII provided for the pastoral care of refugees and migrants in his apostolic constitution Exsul Familia in 1952. Chaplains for migrants were granted special faculties to facilitate pastoral care without receiving the power of jurisdiction or governance. The Second Vatican Council admitted personal criteria in ecclesiastical organisation. The decree Christus Dominus 11 held that the essential element of a particular Church is personal, being a “portion of the people of God”. Personal factors are crucial to determine the communitarian aspect of the makeup of a community. After Vatican II, the Code of Canon Law needed revision. The Synod of Bishops in 1967 approved the principles to guide the revision of the code. The eighth principle stated: “The principle of territoriality in the exercise of ecclesiastical government is to be revised somewhat, for contemporary apostolic factors seem to recommend personal jurisdictional units. -

Resolutions to Censure the President: Procedure and History Updated February 1, 2021 Congressional Research Service https://crsreports.congress.gov R45087 Resolutions to Censure the President: Procedure and History Summary Censure is a reprimand adopted by one or both chambers of Congress against a Member of Congress, President, federal judge, or other government official. While Member censure is a disciplinary measure that is sanctioned by the Constitution (Article 1, Section 5), non-Member censure is not. Rather, it is a formal expression or “sense of” one or both houses of Congress. Censure resolutions targeting non-Members have utilized a range of statements to highlight conduct deemed by the resolutions’ sponsors to be inappropriate or unauthorized. Before the Nixon Administration, such resolutions included variations of the words or phrases unconstitutional, usurpation, reproof, and abuse of power. Beginning in 1972, the most clearly “censorious” resolutions have contained the word censure in the text. Resolutions attempting to censure the President are usually simple resolutions. These resolutions are not privileged for consideration in the House or Senate. They are, instead, considered under the regular parliamentary mechanisms used to process “sense of” legislation. Since 1800, Members of the House and Senate have introduced resolutions of censure against at least 12 sitting Presidents. Two additional Presidents received criticism via alternative means (a House committee report and an amendment to a resolution). The clearest instance of a successful presidential censure is Andrew Jackson. The Senate approved a resolution of censure in 1834. On three other occasions, critical resolutions were adopted, but their final language, as amended, obscured the original intention to censure the President. -

Legal Sidebari The Constitutionality of Censuring the President March 12, 2018 House Democrats have introduced a resolution that, if approved by the House, would formally “censure and condemn” President Trump for disparaging comments on immigration issues he allegedly made during a meeting with Members of Congress. This is the second presidential “censure” resolution introduced in the House this Congress. While each house of Congress has authority to discipline its own Members through censure, congressional censure of the President is rare. For that reason, there seems to be a recurring question as to whether Congress has the constitutional authority to adopt such a measure at all. As discussed below, it would appear that Congress may censure the President through a simple (one chamber) or concurrent (two chamber) resolution, or other non-binding measure, so long as the censure does not carry with it any legal consequence. This Sidebar will discuss examples of congressional censure of the President before addressing its constitutional validity. While Black’s Law Dictionary defines censure as “an official reprimand or condemnation…,” in practice, there is no clear rule for determining the legislative actions that may qualify as a “censure” of the President. Viewed broadly, censure of the President could include any legislative measure formally adopted by the House or Senate that expresses that body’s disagreement with specific presidential conduct. Using this definition, the first congressional censure of the President seemingly occurred in 1834 after President Andrew Jackson removed his Treasury Secretary for refusing to withdraw government deposits from the Bank of the United States. The approved Senate resolution stated that President Jackson had “assumed upon himself authority and power not conferred by the constitution and laws, but in derogation of both.” The Jackson resolution was subject to some debate, and three years later—once the President’s supporters regained control of the Senate—the resolution was officially expunged from the Senate Journal. -

Christians are witnessing the advent of an emerging ecumenical paradigm, which, because it is not fully realized, is still realizing its full definition. The paradigm operates in a global context rather than a Eurocentric one, and even as it is more global, it is simultaneously more local. It cultivates shared praxis while being less concerned with the comparison of dogmas. Ecclesiology is also entering a new paradigm which shares many features with its ecumenical counterpart, particularly its global perspective and interest in shared praxis ahead of dogmatic questions. Even though ecumenism and ecclesiology share common trajectories, their journeys are unfolding in largely parallel rather than cooperative and mutually-enriching ways. This raises the question: What opportunities might arise from examining the shifts in ecumenism and ecclesiology together? This article examines how new methodological and practical developments in these two fields can form and inform one another. It studies the shift to synodality in the Catholic Church and the turn towards discernment in the ecumenical sphere as manifestations of similar theological commitments and a common interest in cultivating participatory processes. The seismic changes reshaping the religious landscape are transforming the relationship between ecumenism and ecclesiology; yet a strong connection between them endures and illumines paths forward for the church in the third millennium. -

Four communicative disjunctions are ways in which, “the Catholic Church today is … out of phase with the world it wants to speak to.”1 Unless and until the influence of Pope Francis permeates the Church at all levels and in all contexts his charismatic leadership cannot be said to have changed this condition altogether. He surely has set a direction away from the clerical culture among bishops that abetted sweeping clergy abuse of minors under a rug of silent re-assignments. Even the Church now represented in the deeds and words of Francis cannot by-pass coming to grips with the disjunctions and with abuse. So George McLean’s theological response to the disjunctions and crisis of abuse remains a valid, long-term project. He advises nothing less than, “… rethinking the entire nature of the Church and its public presence in quite different, indeed kenotic, terms.” 2 That is a tall theological order. 3 What does a theological project of that scope involve? Outlining some directions along which to think about a kenotic theology of the Church draws on more than theological reflection and research. -

A key to reading the motu proprio “Magnum principium” The new Motu Proprio Magnum principium has altered the formulation of some norms of the Codex iuris canonici regarding the translation of liturgical books into modern languages. Pope Francis has introduced some modifications to the text of canon 838 in this Motu Proprio, dated 3 September 2017 and entering into force from 1st October 2017. The reason for these changes is explained in the papal text itself, which recalls and explicates the principles which underlie translations of the Latin typical editions as well as the delicacy required by those who undertake such work. Because the Liturgy is the prayer of the Church it is regulated by ecclesial authority. Given the importance of this work, the Fathers of the Second Vatican Council had already considered the question of the roles of both the Apostolic See and the Episcopal Conferences in this regard (cf. Sacrosanctum concilium, nn.36, 40 & 36). In effect the great task of providing for liturgical translations was guided by norms and by specific Instructions from the competent Dicastery, in particular Comme le prévoit (25 January 1969) and then, after the Codex iuris canonici of 1983, by Liturgiam authenticam (28 March 2001), both published at different stages with the goal of responding to concrete problems which had become evident over the course of time and which had arisen as a result of the complex work that is involved in the translation of liturgical texts. The material relating to the whole field of inculturation was, on the other hand, regulated by the Instruction Varietates legitimae (25 January 1994). -

Saint Dominic had been to southern France to preach against the Albigensian heresy, which denied the goodness of creation and held that the spirit is good but that matter (including the body) is evil. A common saying in Albigensianism was “the body is a tomb,” suggesting that true freedom is realized only when one is freed from the flesh. This heresy held that there are two supreme beings: a good god who created the spirit world, and an evil god who created the material world. Since matter was evil to the Albigensians, marriage and procreation were evil. Jesus was not thought to be human, nor was Mary considered the mother of God. Albigensianism denied the humanity of Christ. The Crucifixion and Resurrection of Jesus were only illusions, and the whole concept of the cross in the Christian life was rejected. Cavins, J. (2004).
