This is an interlocutory application, brought by the respondents in the main application, for leave to file a fourth set of affidavits in the main application. The main application is an application to review the decision of the respondents to transfer the applicant, a prisoner, from a facility in Upington to a facility in Kimberley. 2 2. In order to avoid any confusion, the parties herein will be referred to as in the main application. 3. The applicant, in the main application, obtained an interim interdict by way of a rule nisi, issued on the 27 February 2015 and confirmed on the 28 August 2015, preventing the said transfer pending the outcome of the said review and ordering that the costs of the interim interdict be costs in the review application. The review application was duly filed. The respondents opposed the review and an answering affidavit was filed on their behalf. 4. In broad terms the basis of the applicant’s review of the said decision was based on the contention that moving him from Upington would take him away from his family. Also that he was studying architecture through an external institution and that he had a mentor who was able to visit him in Upington periodically, but that he did not know any architects in Kimberley and that he would not have access to a mentor to assist him with his studies.

As cities strive to bid for the highest order in terms of maintaining and attracting both local and foreign investments as well as tourists, it is imperative to build socially cohesive, environmentally friendly and economically competitive cities as these attributes have become key essential. However, not every city has the financial means to undertake such obligations so they often resort to the formation of public-private partnerships, a phenomenon often termed as Business Improvement Districts, for the attainment of such goals.

Please be advised that an “OK” slip, received from a fax machine, will not be accepted as proof that documents were received by the GPW for printing. If documents are faxed to the GPW it will be the sender’s respon- sibility to phone and confirm that the documents were received in good order. Furthermore the Government Printing Works will also not be held responsible for cancellations and amendments which have not been done on original documents received from clients.
