Familiarity with the dismal indicators, however, cannot breed acquiescence. This does not have to be the legacy of our state. We do not need governmental leadership nor Mississippi’s citizens to accept being last. Instead, we need courageous leadership with an intentional commitment to equity, a willingness to change the narrative and genuine community engagement. Mississippi is Failing to Thrive. It is time we stop being last. www.aclu-ms.org 3 Mississippi has some of the highest equity disparities in the country. Poverty Mississippi continues to be the poorest state in the nation. • “While working hard, many of Mississippi’s families fall short of economic security. According to an analysis of data from the U.S. Census, approximately 42% of Mississippi’s working families are low-income and 22% of residents live in poverty.” (http://mepconline.org/category/policy-areas/income-working-families) • Alongside poverty, disparity continues to loom. For children the poverty rate is 35%, for senior citizens the poverty rate is 18% and for women the poverty rate is 25.9%. There are 253,000 Black children below 200% poverty. -

In 1975 Milner Ball, then a law professor at the University of Georgia, published an article in the Stanford Law Review called “The Play’s the Thing: An Unscientific Reflection on Trials Under the Rubric of Theater.” In it, Ball argued that by looking at the actions that take place in a courtroom as a “type of theater,” we might better understand the nature of these actions and “thereby make a small contribution to an understanding of the role of law in our society.”3 At the time, Ball’s view that courtroom action had an important “theatrical quality”4 was a minority position, even a 1 Esslin, Martin. -

WILLIAM WINTER AND THE POLITICS OF RACIAL MODERATION 335 William F. Winter and the Politics of Racial Moderation in Mississippi by Charles C. Bolton On May 12, 2008, William F. Winter received the Profile in Courage Award from the John F. Kennedy Foundation, which honored the former Mississippi governor for “championing public education and racial equality.” The award was certainly well deserved and highlighted two important legacies of one of Mississippi’s most important public servants in the post–World War II era. During Senator Edward M. Kennedy’s presentation of the award, he noted that Winter had been criticized “for his integrationist stances” that led to his defeat in the gubernatorial campaign of 1967. Although Winter’s opponents that year certainly tried to paint him as a moderate (or worse yet, a liberal) and as less than a true believer in racial segregation, he would be the first to admit that he did not advocate racial integration in 1967; indeed, much to his regret later, Winter actually pandered to white segregationists in a vain attempt to win the election. Because Winter, over the course of his long career, has increasingly become identified as a champion of racial justice, it is easy, as Senator Kennedy’s remarks illustrate, to flatten the complexity of Winter’s evolution on the issue CHARLES C. The Origins (and Fragility) of Judicial Independence Tara Leigh Grove* The federal judiciary today takes certain things for granted. Political actors will not attempt to remove Article II judges outside the impeachment process; they will not obstruct federal court orders; and they will not tinker with the Supreme Court's size in order to pack it with like-minded Justices. And yet a closer look reveals that these "self- evident truths" of judicial independence are neither self-evident nor necessary implications of our constitutional text, structure, and history. This Article demonstrates that many government officials once viewed these court-curbing measures as not only constitutionally permissible but also desirable (and politically viable) methods of "checking" the judiciary. The Article tells the story of how political actors came to treat each measure as "out of bounds" and thus built what the Article calls "conventions of judicial independence." But implicit in this story is a cautionary tale about the fragility of judicial independence. -

WITH DETERMINATION AND FORTITUDE 195 With Determination and Fortitude We Come to Vote: Black Organization and Resistance to Voter Suppression in Mississippi by Michael Vinson Williams On July 2, 1946, brothers Medgar and Charles Evers, along with four friends, decided they would vote in their hometown of Decatur, Missis- sippi. Both brothers had registered without incident but when the men returned to cast their ballots they were met by a mob of armed whites. The confrontation grew in intensity with each step toward the polling place. After a few nerve-racking moments of yelling and shoving, the Evers group retreated, but the harassment did not end. Medgar Evers recalled that while they were walking away some of the whites followed them and that one man in a 1941 Ford “leaned out with a shotgun, keep- ing a bead on us all the time and we just had to walk slowly and wait for him to kill us …. They didn’t kill us but they didn’t end it, either.” The African American men went home, retrieved guns of their own, and returned to the polling station but decided to leave the weapons in the car. Standish ALL RIGHTS RESERVED ii ABSTRACT Grassroots Organizing Work (GROW) (Under the Directino of William Sturkey) This paper examines an interracial labor organizing project in the Southern pulpwood processing industry. The project was organized by two white former members of the Student Nonviolent Coordinating Committee (SNCC) in response to the organization’s directive that white activists conduct antiracist organizing in white communities. It was ultimately funded by the Southern Conference Educational Fund (SCEF). GROW’s strategy was to convince poor white Southerners of their common interests with black Southerners through labor organizing and, in turn, to transform their racial attitudes. Due to the successes of the classical civil rights movement, including the Voting Rights and Civil Rights Acts, as well as the mobilization of white antiracist activists, the project succeeded in building interracial coalitions and winning modest gains for pulpwood haulers. This paper joins existing 1970s labor and New Left historiography while also interrogating the historiography of civil rights unionism and interracial coalition building in the Deep South. iii TABLE -
