- Recorded Monuments Protected under Section 12 of the National Monuments (Amendment) Act, 1994 County Cavan Archaeological ;Survey of Ireland The Office of Public Works Section 12 (1) of the National Monuments(Amendment) Act 1994 states that "shall establishand maintain a recordof monumentsand places where they believethere are monumentsand the recordshall be comprisedof a list of monumentsand such places and a mapor mapsshowing each monumentand such place in respectof eachcounty in the State." Section12 (2) of the Act providesfor the exhibitionin eachcounty of the list and mapsfor that countyin a mannerprescribed by regulationsmade by the ~inis~e~"~o~" ~,~, C~l~’e anti ~he Gael’~ch~. The relevant regulations were madeunder StatutoryInstrument No. 341 of 1994, entitled NationalMonuments (Exhibition of Recordof Monuments)Regulations, 1994. [] [] Protection of Monumentsand Places included in the Record Section 12 (3) of the Act provides for the protection of monumentsand places includedin the recordstating that "Whenthe owner or occupier (not being the Commissioners)of monumentor place which has been recorded under subsection (1) this section or any personproposes to carry out, or to causeor permit the carrying out of, any work at or in relation to such monumentor ,,m place, he shaft give notice in writing of his proposalto carry out the work to the Commissionersand shaft not, except in the case of urgent necessity and with the consent of the Commissioners,commence the workfor a period of two monthsafter havinggiven the notice." A person contraveningthis requirementfor two monthsnotification to the Commissionersof Public Worksin Ireland of proposedworks at or in relation to a recordedmonument or place shall (under Section 13 of the Act) be guilty of an offence and be liable on summaryconviction to a maximumpenalty of a £1000 fine and 12 monthsimprisonment and on conviction on indictment to a maximumpenalty of a £50,000 fine and 5 years imprisonment. L It should also be noted that Section 16 of the National Monuments(Amendment) Act 1994 amendedthe National Monuments(Amendment) Act 1987 (the Act of 1987) that underSection 2 (1) (a) (iv) of that the useor possession of adetection device "in, or at the site of, a monumentrecorded under section 12 of the National Monuments(Amendment) Act, 1994," .m is prohibited otherwise than in accordancewith a consentof the Commissionersof Public Worksin Ireland grantedunder the provisionsof Section2 of the Act of 1987. A personcontravening the aboveprovisions relating to use or possessionof detectiondevices shall (underSection 2 (5) of the Act of 1987) be guilty of offence and be liable (under Section 23 (1) of the Act of 1987) on summary conviction to a maximumpenalty of a £1000 fine and 6 monthsimprisonment or on conviction on indictment to a maximumpenalty of a £50,000 fine and 12 monthsimprisonment. It shouldbe further notedthat underSection 7 (1) (a) of the National Monuments(Amendment) Act 1994 a memberof the Garda Sioch&na may without warrant seize anddetain: "a detectiondevice found in, at the site of, or in the vicinity of" a monumentrecorded under Section 12 of the Act unless the person in possession of the device has a consent of the Commissionersof Public Worksin Ireland in accordancewith the provisions of Section2 of the Act of 1987. L Theinformation on whichthe list of monumentsand places for eachcounty and the mapsshowing those monumentsand placesis basedis derivedfrom that usedfor the non-statutorySites andMonuments Records previously issued for eachcounty by the NationalMonuments and Historic PropertiesService, but certain monuments havebeen added and certain entries in the Sites andMonuments Records have not beentransferred into the statutoryrecord as they refer to featureswhich have been foundon inspectionnot to merit inclusionin that recordor they cannotbe located withsufficient accuracy to be soincluded. C] Focal o11 Li I E] Therecorded monuments and places in eachcounty are numberedaccording to the OrdnanceSurvey Maps of the scale of Six Inchesto OneMile ("6 Inch Sheets")for the county,and the entry for eachmonument and place is arrangedin five columns underthe followingheadings (the abbreviationused in the actual list is given in bracketsafter each): C] 1 MonumentNumber (h/ION. NO.) 2 OrdnanceSurvey 6-Inch SheetNumber/Plan/Trace (SH/PL/TR) 3 NationalGrid Co-ordinates(NAT. GRID) 4 TownlandName(s) (TOVVNLAND) 5 Classification ~1 ~o~um~n~~umbet" This refers to the uniqueidentifying numbergiven to bothmonuments and places enteredin the recordand is givenin a formsimilar to the followingexample which D refers to the first monumentor place on the first OrdnanceSurvey 6 Inch Sheetfor CountyCavan: CV001-001-- Eachcounty has been given a two letter identifying code,and this formsthe first elementin the identifying number.The next element(in the aboveexample the 001- comingafter the countycode) gives the numberof the OrdnanceSurvey 6 Inch map on whichthe monumentis located. Thedash is so as to allow for OrdnanceSurvey [] 5 % Sheetswith A and B inserts and in such cases the Sheet numberwould be given in the form (for example)001A or 001Bas appropriate. Thelast elementgives the numberof the monumentor place within the sequenceof monumentnumbers on the particular OrdnanceSurvey 6 Inch Sheet - in the above examplethis is the 001-- at the end. Thefirst two of the three dashesat the end allow monumentsor places situated in close proximity to each other or closely associated with each other to be given one overall monumentnumber but at the sametime be individually identified throughthe use of sub-numberingin the form (for example)00101-, 00102-, 00103-, etc., as appropriate. Thefinal dashis to allow for a situation where a monumentor place is divided betweentwo or more Ordnance Survey6 Inch Sheetsin whichcase an asterisk is placed at the end of the second and subsequentmonument numbers relating to that monumentor place, thus giving (for example)the form 001-*. Non-Sequential Numbering Gapsin the sequenceof monurrient numbersfor any particular OrdnanceSurvey 6 Inch Sheetare the result of entries in the non-statutory Sites andMonuments Record having been subsumedin one monumentnumber in the statutory record or, for the reasons given in the section headed "Information forming the Basis for the Record", the non-transferral of certain entries in the non-statutory Sites and MonumentsRecord to the statutory record. 2 OrdnanceSurvey 6 Inch Sheet Number~Plan~Trace EachOrdnance Survey 6 Inch Sheet is divided into sixteen equal parts knownas Plans, and eachof these Plans is divided into six equal parts knownas Traces. The general position of a monumentor place on an OrdnanceSurvey 6 Inch Sheet can thus be given by use of the Plan and Tracesystem. 3 National Grid Co-ordinates The ten-figure co-ordinates given in this columnindicate the position of each monumentor place with reference to the National Grid. 4 TownlandName(s) Thetownland or townlandsin whicha monumentor place is situated are given in this column. L" 5 CO~sstfic~ion Theclassification gives a brief indicationof the natureof eachrecorded monument or place. The mapson which the recorded monumentsand places are shownare reduced copiesof OrdnanceSurve~ Maps of the scale of Six Inchesto OneMile ("6 Inch Sheets"),i.e. 1:10,560.The resulting maps are at a scaleof approximately1:12,500. As explainedin the section "Fo~a~o~ L~s~"the recordedmonuments and places are listed andnumbered according to OrdnanceSurvey 6 Inch Sheet. W~yin ~hich ~onumentsand FOacesare Sho~n The recordedmonuments and places are shownon the mapsby being circled or boxedin as appropriate by a black line. In somecases several monumentsor placesare circled or boxedin togetherbecause of their close proximityto, or association with, each other. The circles and boxes around the recorded monumentsand places are intendedto showthem but not to define their exact extent. Re~’em~g~’~n ~he ~ps to ~he L~ A shortenedversion of the appropriatemonument number as given in the list is printedin large charactersbeside each circle or box. Theelements of the monument numberindicating the 6 Inch Sheet numberand county code are omitted. For example,the first monumentor place on the first 6 Inch Sheetfor CountyCavan has the monumentnumber CV001-001-- as explained in the section "Fo~ ~ Lis~". The circle or box showingthat monumentor place on the maphas the number1 printedbeside it. Thenext recordedmonument or place on the first 6 Inch Sheetfor CountyCavan has the monumentnumber CV001-002-- and the appropriatecircle or boxon the mapwill havethe number2 printed beside it. The sequenceof numberingof the monumentsand places on each Ordnance Survey6 BnchSheet generally runs from left to right acrossthat sheetin roughly horizontalbands, but monumentsor places added after the completionof the initial numberinghave been placed at the endof the numericalsequence.
