Chapter 4: Wilsthorpe to Speeton Moor Coast Path: Easington to Brigg - Natural England’s Proposals

Part 4.1: Introduction

Start Point: Wilsthorpe (grid reference: TA 1738 6505) End Point: Speeton Moor (grid reference: TA 1679 7487) Relevant Maps: 4a to 4l

Understanding the proposals and accompanying maps:

The Trail:

4.1.1 Follows existing walked routes, on a combination of cycle tracks (pedestrian), promenades, public footpaths/footways, public highway and cliff top paths.

4.1.2 Mainly follows the coastline quite closely and maintains good views of the sea.

4.1.3 Follows a route similar to the existing Headland Way.

Protection of sensitive features:

4.1.4 This part of the coast includes the following sites, designated for nature conservation or heritage preservation (See map C of the Overview):

 Flamborough Head Site of Special Scientific Interest (SSSI) for its geological /wildlife interest.

 Flamborough Head proposed Site of Special Scientific Interest (pSSSI) for its geological /wildlife interest.

 Flamborough Head and Cliffs Special Protection Area (SPA) for its wildlife interest.

 Flamborough and Filey Coast proposed Special Protection Area (pSPA) for its wildlife interest.

 Flamborough Head Special Area of Conservation (SAC) for its wildlife interest.

 Flamborough Head proposed Special Area of Conservation (pSAC) for its wildlife interest.

England Coast Path | Easington to Filey Brigg | Natural England’s Proposals  Section of Danes’ Dyke between the Cliff Plantation and the B1255 (NHLE: 1013191) for its archaeological interest.

 Northern Section of Danes’ Dyke from Wold Farm field boundary to Bempton Cliffs (NHLE: 1013194) for its archaeological interest.

We have assessed the potential impacts of access along the proposed route (and over the associated spreading room described below) on the features for which the affected land is designated and on any which are protected in their own right.

4.1.5 With input from specialists we have considered each of the sites involved and the relevant designations and concluded that for this section of the coast our proposals will not have a detrimental effect.

4.1.6 The levels and patterns of public access along this length of coast would be unlikely to change significantly as a result of our proposals and we have therefore concluded that our proposals would not be likely to have any significant impact on these features.

4.1.7 Access to the coastal margin at RSPB Bempton, Thornwick Nab, High Holme and Breil will be restricted, as per the direction outlined in the formal proposals at 4.3.6 below.

Accessibility:

4.1.8 Generally, there are few artificial barriers to accessibility on the proposed route, which makes use of existing surface paths wherever these meet the criteria in the Coastal Access Scheme. However, there are places where it may not be entirely suitable for people with reduced mobility because:

 The trail would follow an uneven grass or bare soil path along the cliff top.

 There are places where it would be necessary to ascend/descend steps at sections at the intersection of EFB-4-S028 FP to EFB-4-S029, within EFB-4-S029, at the intersection of EFB-4-S030 and EFB-4-S031 FP, at the intersection of EFB-4-S031 FP and EFB-4-S032 FP, within EFB-4-S060, within EFB-4-S081 FP, at the intersection of EFB-4-S083 FP and EFB-4-S084 FP, and within EFB-4-S084 FP.

4.1.9 The existing steps detailed above will be replaced as required, so as to make them easier to use. We envisage this happening as part of the physical establishment work described in part 7 of the Overview.

4.1.10 Stiles at the intersections of EFB-4-S080 FP and EFB-4-S081 FP, at the intersection of EFB-4-S083 FP and EFB-4-S084 FP, at the intersection EFB-4-S085 and EFB-4-S086, at the intersection of EFB-4-S086 and EFB-4-S087, and at the intersection of EFB-4-S097 FP and EFB-4-S098 FP will be removed and replaced with pedestrian gates. We envisage this happening as part of the physical establishment work described in part 7 of the Overview.

England Coast Path | Easington to Filey Brigg | Natural England’s Proposals Where we have proposed exercising our discretion:

4.1.11 Landward boundary of the coastal margin: We have used our discretion on some sections of the route to map the landward extent of the coastal margin to an adjacent physical boundary such as a fence or wall to make the extent of the new access rights clearer. See Table 4.2.1 below.

See also part 3 of the Overview - ‘Understanding the proposals and accompanying maps’, for an explanation of the default extent of the coastal margin and how we may use our discretion to adjust the margin, either to add land or to provide clarity. See also Annex C of the Overview - ‘Excepted land categories’.

4.1.12 Restrictions and/or exclusions: We have proposed to exclude [and/or] restrict access by direction under the Countryside and Rights of Way Act (2000) in certain places along this section of coast. For details of these directions, see 4.3.6 in the Formal Proposals Section of this chapter and Part 10 of the Overview.

4.1.13 Restrictions and/or exclusions: Access rights to the spreading room would be subject to the national restrictions on coastal access rights listed in Annex D of the Overview. These restrictions would not apply to public rights of way.

Establishment and ongoing management of the trail

4.1.14 Some physical establishment of the trail would be necessary, in accordance with the general approach described in part 7 the Overview:

 New or replacement steps at the intersection of EFB-4-S028 FP to EFB-4-S029, within EFB-4-S029, at the intersection of EFB-4-S030 and EFB-4-S031 FP, at the intersection of EFB-4-S031 FP and EFB- 4-S032 FP, within EFB-4-S060, within EFB-4-S081 FP (x3), at the intersection of EFB-4-S083 FP and EFB-4-S084 FP and within EFB-4-S084 FP.

 New ramp at the intersection of EFB-4-S032 FP and EFB-4-S033 FP.

 New footbridge within EFB-4-S041, at the intersection of EFB-4-S042 FP and EFB-4-S043 FP, at the intersection of EFB-4-S048 FP and EFB-4-S049 FP.

 Stiles at the intersection of EFB-4-S080 FP and EFB-4-S081 FP, at the intersection of EFB-4-S083 FP and EFB-4-S084 FP, at the intersection of EFB-4-S085 and EFB-4-S086, at the intersection of EFB-4-S086 and EFB-4-S087, and at the intersection of EFB-4-S097 FP and EFB-4-S098 FP will be removed and replaced with pedestrian gates.

4.1.15 Ongoing management and maintenance would be necessary in accordance with the general approach described in part 8 of the Overview.

England Coast Path | Easington to Filey Brigg | Natural England’s Proposals Future Change:

4.1.16 With the exception of (EFB-4-S001 CP to EFB-4-S021 CP), all the route of the trail on this length of coast would be able to change without further approval from the Secretary of State in response to coastal erosion or other geomorphological processes, or encroachment by the sea. This would happen in accordance with the criteria and procedures for ‘roll back’ set out in part 9 of the Overview. See table(s) 4.2.1 below for details of the sections likely to be affected in the foreseeable future.

4.1.17 At the time of preparing the report, we do not foresee any other need for future changes to the access provisions proposed for the length of coast described in this chapter.

England Coast Path | Easington to Filey Brigg | Natural England’s Proposals Part 4.3: Chapter 4 - Formal Proposals

 Below are our formal proposals to the Secretary of State for the length of coast shown on maps 4a to 4l.

 They should be read in conjunction with the relevant maps.

 The commentary above explains the practical effect of these proposals.

Formal Proposals – Wilsthorpe to Speeton Moor

Proposed route of the trail

4.3.1 In relation to route sections EFB-4-S001 MU to EFB-4-S021 MU, the route, as initially determined at the time the report was prepared, is to be at the centre of the line shown on maps 4a to 4b as the proposed route of the trail.

4.3.2 In relation to route sections EFB-4-S022 FP to EFB-4-S126 FP, the route, as initially determined at the time the report was prepared, is to be at the centre of the line shown on maps 4b to 4l as the proposed route of the trail.

4.3.3 If at any time any part of a route section listed in the previous paragraph needs, in Natural England’s view, to change:

 as a result of coastal erosion or other geomorphological processes or encroachment by the sea

 in order to link with other parts of the route that need to roll back in direct response to such changes;

in order for the overall route to remain viable, the new route for the part in question will be determined by Natural England without further reference to the Secretary of State. This will be done in accordance with the criteria and procedures described under the title ‘Roll-back’ in part 9 of the Overview and section 4.10 of the Coastal Access Scheme. If this happens, the new route will become the approved route for that section for the purposes of the Order which determines where coastal access rights apply.

Landward boundary of coastal margin

4.3.4 Adjacent to route sections EFB-4-S004 to EFB-4-S007, EFB-4-S059 FP, EFB-4-S061 FP to EFB-4-S062 FP, EFB-4-S067 FP to EFB-4-S068 FP, EFB-4-S070 FP, EFB-4-S072 FP, EFB-4-S074 FP to EFB-4-S075 FP, EFB-4-S084 FP to EFB-4-S085, EFB-4-S094, EFB-4-S097 FP to EFB-4-S107 FP the landward boundary of the coastal margin is to coincide with the wall or fence, which at the time of writing this report is landward of the trail as shown on maps 4a and 4f to 4j.

4.3.5 Adjacent to route sections EFB-4-S003 FW and EFB-4-S008 the landward boundary of the coastal margin is to coincide with the landward edge of the pavement shown as the trail on map 4a.

Local restrictions and exclusions

England Coast Path | Easington to Filey Brigg | Natural England’s Proposals 4.3.6 Natural England proposes to restrict or exclude access relevant to this length of coast, as follows:

Under s26 of CROW, for the purpose of conserving nature conservation interests of the land in question, there would be no new access rights at:

 RSPB Bempton from the safety fence on the seaward side of the trail to mean low water from 1 March to 30 September each year.

 Thornwick Nab, High Holme and Breil as indicated on the associated maps from 1 March to 30 September each year.

Refer to Part 10 of the Overview for further details.

4.3.7 There are no proposals for alternative routes in relation to this length of coast.

Explanatory note: coastal margin Part 3 of the Overview to the report explains where the landward boundary of the coastal margin falls by default. Our proposals include any suggested variation of this default boundary.
