The Deterrent Effects of Ethics Codes for Corporate Crime: a Meta-Analysis ABSTRACT Title of Document: THE DETERRENT EFFECTS OF ETHICS CODES FOR CORPORATE CRIME: A META-ANALYSIS Natalie Marie Schell-Busey, Ph.D., 2009 Directed By: Dr. Sally Simpson, Criminology and Criminal Justice The current financial crisis, brought on in part by the risky and unethical behaviors of investment banks, has drawn attention to corporate crime, particularly on the issue of how to prevent it. Over the last thirty years, codes of conduct have been a cornerstone of corporate crime prevention policies, and consequently are now widespread, especially among large companies. However, the empirical literature is mixed on the effectiveness of codes, leaving them open to critics who charge that codes can be costly to implement, ineffective, and even criminogenic. In this dissertation I use meta-analysis to examine the evidence regarding the preventative effects of ethics codes for corporate crime. The results show that codes and elements of their support system, like enforcement and top management support, have a positive, significant effect on ethical-decision making and behavior. Based on these results, I propose an integrated approach toward self-regulation founded on Braithwaite’s (2002) enforcement pyramid, which specifies that regulation should primarily be built around persuasion with sanctions reserved for situations where a stronger deterrent is needed. Since then, we have seen the COVID-19 pandemic and the resurgence of the #BlackLivesMatter movement following the police killings of George Floyd, Breonna Taylor, and all too many others. Given these critical events, we as researchers and as members of a research organization paused to reflect on how our work speaks to the urgent injustices laid bare today. These events have dramatically foregrounded existing calls for jus- tice at the intersections of technology, unjust social and political structures, digital privacy, surveillance, and the values and purpose of technology corporations. Many of the defining events that have shaped ethics in the tech sector in recent years—including tech worker organization, walkouts and resignations over military con- tracts, continued contestations over racial and sexual harassment inside of tech companies, legislation and regulations, and critical audits—have been and continue to be the contentious background to the research conducted for this report. Our research takes place amidst, but is not primarily about, these tectonic changes that have repeatedly reframed the broader tech ethics conversation. It is in- stead about the ways those inside of tech companies have begun reshaping corporate practices against this background—how they understand the problems their industry faces, the means at their disposal to address these problems, and the lines of thought that shape those understandings.

Unlike the illicit markets and associated ‘organised crime groups’ and ‘criminal enterprises’ that are the normal focus of money laundering studies, corporate financial crimes involve ostensibly legitimate businesses operating within licit, transnational markets. Within these scenarios, we see corporations as primary offenders, as agents, and as facilitators of the administration of illicit finances. In all cases, organisational structures provide opportunities for managing illicit finances that individuals alone cannot access, but which require some element of third-party collaboration. In this article, we draw on data generated from our Partnership for Conflict, Crime, and Security Research (PaCCS)-funded project on the misuse of corporate structures and entities to manage illicit finances to make a methodological and substantive addition to the literature in this area.
