Instrument overview

1. The Continuing Care (Scotland) Amendment Order 2018 (Draft) was laid by the under section 26A(11)(b) of the Children (Scotland) Act 1995 on 22 January 2018. It is subject to the affirmative procedure.

2. This instrument raises the upper age limit for young people who are eligible to receive continuing care from local authorities from 19 years of age to 20.

3. The Delegated Powers and Law Reform Committee considered the instrument on 30 January 2018 and determined that there were no issues within its remit to draw to the attention of the Parliament.

4. At its meeting on the 28 February 2018, the Committee considered the Continuing Care (Scotland) Amendment Order 2018 [draft].

5. MSP, Minister for Childcare and Early Years, moved—

S5M-10206— That the Education and Skills Committee recommends that the Continuing Care (Scotland) Amendment Order 2018 be approved.
