B-1 CITY UNIVERSITY OF ADOPTION OF FISCAL YEAR 2019-2020 CAPITAL BUDGET

WHEREAS, in accordance with New York State Education Law and New York State Finance Law, the Board of Trustees (the “Board of Trustees”) of the City University of New York (the “University”) has authority to allocate and transfer annual appropriations among the State-Operated and statutory colleges and programs of the University;

WHEREAS, the New York State Enacted budget and Executive budget have appropriated $444.5 million in new State capital appropriations, $2.66 billion in State capital re-appropriations, and $232.8 million in the City fiscal years 2019/20 capital budget;

WHEREAS, the capital investment plan is supported by funds generated through bonds sold by the Dormitory Authority of the State of New York with debt service payments appropriated by the State and the City, and through bonds sold by the City and also by State minor repair funding from the State General Fund; and

WHEREAS, the City provides 50% of the funding for the community colleges capital projects and special projects at senior colleges, and the State provides 100% of the funding for the majority of senior college capital projects and the 50% matching funding for the community colleges capital projects.

NOW, THEREFORE, BE IT

RESOLVED, that the Board of Trustees adopt the capital budget allocations pursuant to Exhibit A, for projects authorized by The City University Construction Fund, to address critical maintenance, infrastructure, and programmatic initiatives in support of the University’s mission; and

RESOLVED, that the University will provide semi-annual reports to the Board of Trustees’ Committee on Facilities Planning and Management on planned, active, and completed capital projects.

EXPLANATION: The colleges will begin FY2019-2020 operations on July 1, 2019. Since the City of New York’s Fiscal Year 2019-2020 budget is not yet adopted, the allocations provided herein are subject to change. The capital plan focuses on completion of existing projects and critical health, safety, code compliance and rehabilitation projects, while addressing the need for expansion and modernization of facilities as called for in campus master plans, where funds are available.

• Health and Safety needs Correct health and safety deficiencies identified in building condition assessment surveys and by college and Central Office personnel, including projects that address campus safety and security, such as the provision of fire alarms and emergency phone stations, where appropriate. • Preservation of Facilities needs Correct building systems deficiencies identified in building-condition assessment surveys and by college and Central Office staff, by restoring and preserving critical building infrastructure, including interior building systems and exterior building envelopes. • Mechanical and infrastructure needs Address deficiencies in the mechanical, electrical and plumbing (MEP) infrastructure, as needed, with the goal of improving system performance and efficiency, by making corrections to heating/ventilation/air conditioning systems, power distribution and water and sewage systems. • ADA needs Continue the removal of access barriers identified in building-condition assessment surveys and by the colleges and Central Office personnel to further compliance with the Americans with Disabilities Act (ADA) and statutes, including remodeling of toilet facilities, stair landings and railings, signage, door widths, etc. • Certificate of occupancy/public assembly needs Bring CUNY facilities into compliance with New York City Department of Buildings regulations by making minor corrections. Compliance is determined by issuance of certificates of occupancy and public assembly. • Energy conservation needs Reduce energy consumption and promote compliance with State Executive Order 88, by installing advanced boiler controls; retro-commissioning building controls infrastructure and systems; implementing an LED lighting-replacement program; and modifying laboratory ventilation systems. • Science lab upgrade needs Renovate labs for instruction and research. Correct building service deficiencies in specific labs so that state-of-the-art equipment can be fully utilized and maintained. • Bathroom facilities upgrade needs Upgrade bathrooms to reflect parity within distribution of gender of users, and to enhance health and safety code compliance, including asbestos removal and compliance with accessibility codes. • Educational technology initiative needs University-wide deployment of new technologies, including virtualization and the sharing and delivery of online expertise and new systems and services that support, administer and enhance academic delivery. • Science and technology equipment needs Funding for acquisition of scientific and technological equipment through CUNY's Graduate Research Technology Initiative that provides support for research in diverse disciplines. • Broadcasting equipment needs Funding to enable CUNY TV to establish the server systems and infrastructure necessary to convert to digital HDTV in accordance with FCC requirements, as well as convert its videotape library to digital format.
