Under the Act, an agency has 30 days to respond to an FOI request. As DPC did not respond to your request within the time frame required, the department is deemed to have refused you access to all documents relevant to your application. However, I have determined to process the request as if the statutory time frame had been met.

The purpose of this letter is to advise you of my determination.

A total of 92 documents were identified as answering the terms of your application and I have determined as follows:

 I grant you access in full to 46 documents, copies of which are enclosed;  I grant you access in part to 45 documents, copies of which are enclosed, and  I refuse access to 1 document

Please refer to the attached schedule that describes each document and sets out my determination and reasons in summary form.

Sections of these documents contain information relating to the personal affairs of a third party, namely mobile phone numbers and email addresses. Under clause 6(1) of Schedule 1 to the Act, information is exempt if releasing it would involve the ‘unreasonable disclosure of information concerning the personal affairs of any person’. I have considered that the application of clause 6(1) requires two elements, one that the information contains the personal affairs of that person; and secondly that disclosure would be unreasonable and contrary to public interest. I have determined that this information falls within the category of ‘personal affairs’ as listed under section 4(1) of the Act, thereby meeting the first elements of this clause. Further, I have considered whether the disclosure of this information would be unreasonable. In doing so, I have considered the relevance of this information to the public and the likelihood as to whether the person in question would consent to disclosure. I have concluded that this information was likely obtained in confidence and through measures which would otherwise make it unavailable to the public. I have considered the factors in favour of public interest and determined that these factors are outweighed by the need to maintain personal confidentiality in this instance. Therefore, I have determined that this information meets the requirements of clause 6(1) and is thereby exempt pursuant to this clause.

Documents 8 and 14-16

These documents contain commercial methodology and intellectual property of third parties. The disclosure of this content could reasonably destroy or diminish the commercial value of this information, as it would reveal proprietary information and unique business ideas for start-up businesses, in a niche and emerging market. These proposals were presented to the Government in order to obtain advice or possible pathways to investigate in order for them to reach fruition. Whilst there is significant public interest in how successful recipients of funding assistance use their grants, certain material contained in these documents could give competing entities unfair advantage to entrepreneurial and innovative business plans. I have therefore determined to remove this information pursuant to clause 7(1)(b) of the Act.

Documents 9, 10, 17, 19, 21, 26, 31, 49, 51-53, 56, 57, 59, 60, 62, 64, 65, 70, 71, 73- 75, 79-84, 86, 87 and 90

These documents contain information which I have determined to be exempt pursuant to clause 12 of Schedule 1 to the Act. This section states that information is exempt from release if ‘it contains matter the disclosure of which would constitute an offence against an Act’. Under section 10 of the Aboriginal Heritage Act 1988, information entered into the central or local archives relating to Aboriginal sites or objects retains confidentiality. Under section 35 of the Aboriginal Heritage Act 1988, a person must not, in contravention of Aboriginal tradition, divulge information relating to an Aboriginal site, object or remains. A section of this document contains such information, the release of which would be an offence against the Aboriginal Heritage Act. I have therefore exempted this information pursuant to clause 12(1) of Schedule 1 to the Act for this information.

Document 19

This document contains information concerning the business, professional and commercial affairs of a third party. The disclosure of their identity could reasonably

The letter implies that they may be building a development on land that they have not conducted site clearance upon. Further investigation showed that the third party was not required to undertake this action as it was not building within a registered site location. In my view it would be inappropriate to reveal their identity and cast the aspersion that they operate in an unprofessional manner. I have therefore determined it is not in the public interest to disclose this information and it is exempted pursuant to clause 7(1)(c) of the Act.

Clause 6 – Documents affecting personal affairs

(1) A document is an exempt document if it contains matter the disclosure of which would involve the unreasonable disclosure of information concerning the personal affairs of any person (living or dead)

Clause 7 – Documents affecting business affairs

(1) A document is an exempt document—

(b) if it contains matter—

(i) consisting of information (other than trade secrets) that has a commercial value to any agency or any other person; and

(ii) the disclosure of which—

(A) could reasonably be expected to destroy or diminish the commercial value of the information; and

(B) would, on balance, be contrary to the public interest; or

(c) if it contains matter—

(i) consisting of information (other than trade secrets or information referred to in paragraph (b)) concerning the business, professional, commercial or financial affairs of any agency or any other person; and

(ii) the disclosure of which—

(A) could reasonably be expected to have an adverse effect on those affairs or to prejudice the future supply of such information to the Government or to an agency; and

(B) would, on balance, be contrary to the public interest.

Clause 12 – Secrecy Provisions

(1) A document is an exempt document if it contains matter the disclosure of which would constitute an offence against an Act.

As Ramindjeri and Tribal Owners of the Coorong, lower lakes, River Murray and the Sea we have conducted many of these types of assessments in the past for clients, across numerous areas of Southern SA and believe we have the personnel and skills required to complete the tasks successfully.

Project Task We understand our task is to work with DPTI and/or other expert personnel to; a) Conduct field work at the selected site to monitor the modification of the significant canoe Tree and to identify any Aboriginal sites that may still be located within the project area that are protected by the South Australian Heritage Act 1988. b) Record the traditional or contemporary significance of any archaeological and mythological/ ethnographic sites within the selected area. c) Assist DPTI with additional information required for the final written report if required.

Methodology Prior to field activities if required DPTI, other experts and/or the Tribal owners may; . Load GIS data into a handheld GPS unit for orientation and field map illustration of the area to be assessed.

Prior to field activities the Tribal Owners of the Coorong, lower lakes, river Murray and the Sea Inc team may; . Discuss location and possible cultural issues with other Tribal elders and record possible outcomes of the survey.

During the modification DPTI and other experts may; . Assist with the taking of field notes and provide digital camera and GPS unit with mapping capability. . Provide any negotiated resources as required.

We will meet with DPTI and other experts at the site to monitor as they conduct the modification. The archaeological survey will be conducted by; . Pedestrian transects requiring us to systematically inspect the identified land on foot, looking for areas of interest for archaeological sites and objects. . Using our cultural experience to focus on areas of high importance to our ancestors. . GPS important items found during the survey. . Photograph these sites in a culturally sensitive manner. . Record local observations or details. . Discussing items of significance to provide appropriate management actions.

Desired Survey Outcome From this work we expect; a) To locate and record this and any other sites of significance to Aboriginal Heritage and/ or Tradition. b) Identify appropriate management actions or options for sites identified and covered by South Australian Heritage Act 1988, and Tribal Owners of the Coorong, lower lakes, River Murray and the Sea Inc where deemed. c) Be able to work with DPTI and other experts to assist and sign off on any final report/s.

WH&S Working in a safe environment is important to us. All field operation requires 2 personnel daily to carry out the task. Our selected team will provide; . Physically capable field operators . Thank you for accepting my apologies and that of The Tribal Owners at the recent Section 13 consultation in relation to an application for Authorisation under Section 23 of the Aboriginal Heritage act 1988 from DPTI. As already noted the Canoe Tree is of high significance to all aboriginal peoples especially the Tribal Owners as we have bloodline connection to the area and the Canoe Tree. We note the importance of acting swiftly to prune the Canoe tree and agree that although it is ideal that it is not touched in any way due to safety and the obvious intention not to disturb or harm the actual Canoe we support that the Canoe Tree is pruned as a matter of urgency. As it is of high significance and already a registered site we insist that whilst the work is taking place we are present on site to monitor and will contribute to the CHMP at the rates that is agreed upon (see attached). It doesn’t surprise me that DPTI has decided not to engage with us as they do not recognise us as Traditional owners. We feel we are being discriminated against because of our race, that being Original peoples. In future we will continue to participate in the process but are aware that a relationship with DPTI is now non existent as this latest attempt at ethnic cleansing is blatant disrespect for the importance Aboriginal culture that is evident and has been compounded by layers of disrespect by DPTI.  That appropriately qualified and experienced arborists will be conducting the required pruning work;  That the work will be undertaken very carefully with an emphasis on the protection of the canoe scar; and  That the works will be undertaken in compliance and adherence to DPTI’s Aboriginal Sites, Objects and Remains Discovery Procedure 1 has made a decision not to engage Aboriginal heritage monitors for the proposed works.

DPTI acknowledges the heritage values of the tree and accordingly intends to provide the contracted arborists with a cultural heritage induction relating to the significance of the site (and the need for precision in the pruning works).

DPTI has advised that representatives of the Tribal Owners of the Coorong, Lower Lakes, River Murray and the Sea Inc. are welcome to attend the site to observe the pruning activity.

Hi Toby. The couple of issues that I didn’t get to discuss in the team reports are; 1) In Alex’s can I have inserted that I was an apology for the Canoe Tree consultation and no Aboriginal community reps attended. Also I would like to know more about the Kangaroo Island Golf Course Cultural Heritage Survey that Alex talks about. 2) In Justine’s the Clause 12(1) discovery should have been Ramindjeri first and then maybe Ngarrindjeri. We wish to be brought up to speed and then participate and actually do the repatriation properly. Everything done around repatriation on our Country including what is known as Ngarrindjeri must include the Tribal Owners. Hi Toby. I brought this up at State Heritage last Friday 01/02/2019 but I am also writing to you for some clarification. Recently as you know I brought to both you and Perry’s attention that we had concerns about a piece of land at Wellington East where land was being sold and disturbed without any Aboriginal site clearing being done. I was there again in the last week or so and noticed since my last visit more houses have been erected and land cleared. I was particularly concerned that at Clause 12(1) I believe it is a new foundation that was being started and a caravan was on the site where it appeared the land holder was residing. It has also come to be attention that a piece of land has been sold on the swamp area where there is a native vegetation caveat on it. We are very concerned that land is being in fact disturbed therefore without following the Act and other important laws, rules and regulations. Clause 7(1)(c)

We are asking that you or one of your staff follows this up for some piece of mind at the very least.

I hope you are well, it was lovely seeing you last week at the SAHC meeting.

We have looked into the heritage concerns you raised in relation to Wellington East and a subdivision that is occurring out that way.

You raised specific concerns related to Clause 12(1)

At present however, our records indicate there is no known heritage in that specific location. If you are aware of heritage values that apply specifically to Clause 12(1) , please send any information through to the agency for us to follow up.

To be clear though, there is no legal requirement to conduct a heritage survey prior to ground disturbing works. The developer is obliged under the Aboriginal Heritage Act 1988 (the Act) to ensure that they do not ‘damage, disturb or interfere’ with Aboriginal sites, objects or remains. As such, the request for a survey can be made of the developer but there is no legal obligation for them to conduct one.

Of note, there is a housing development occurring in the vicinity of the site referred to above. The land agents responsible for selling the lots have undertaken a check of the Register and are aware of the heritage values that apply to those specific lots. The Agents are legally bound to disclose all encumbrances that apply to a any land available for purchase. I am going to contact the Agents to ensure that the information is passed on to any potential purchasers. This will ensure that the purchasers are aware of their obligations under the Act and how that may effect they way in which they use the land.

Cl a u s e 6( 1) In terms of the native vegetation concerns, we do not have access to information related to vegetation caveats as we do not administer the Acts which apply to vegetation. In this case, it may be best to follow up directly with Chris Nichols.

Hi Perry. As you know we moved our interested area back after Kaurna Native Title determination. As they are still interested in areas below their NT boundary we would like to shift back towards Adelaide the same distance as the end of the Southern conclusion of Kaurna I believe that might be around Sellicks Hill if that makes sense. Say it’s 30km from Sellicks to we need to go 30km towards Adelaide as our area of interest. We were going to have interest on all Kaurna and Narrungga land as we do have members who are both Kaurna and Narrungga but it was decided that there are other mechanisms for them to have their interests catered for. Can you please readjust our map and send me a copy when your able to. I’m very aware of your workload and appreciate your efforts. Mark commented that it was a privilege for him to represent the Committee on the Alliance. He said his association with Keith began with a conversation in New Zealand. Equally passionate about heritage, and the possibilities of tourism, Mark had been keen to engage on where Aboriginal people and their initiative fit within the Alliance and where the state was interested to go.

Keith acknowledged that the meeting was being held on Kaurna land and acknowledged the elders, past, present and emerging.

Keith explained that he had been asked to develop a tourism heritage strategy. He was seeking advice on what the direction should encompass. Keith explained that there was a commitment by all councils to include Aboriginal stories into all their heritage.

Keith explained that he had been chairing the HC for some years. He stated that Mark would speak to the link with the Alliance.

Keith hosted a PowerPoint presentation on the Alliance and the strategy. Keith’s message was that more must be done to protect heritage; that the more it is used and accessed the more it is understood and appreciated.

Keith explained that the Alliance was both a personal and election commitment by the Minister, David Spiers. The Alliance was about revival and identifying the potential to significantly connect and build South Australian heritage experiences into and within the tourist economy.

Keith continued with a focus on bushfire recovery in areas such as Kangaroo Island and the Adelaide Hills.

Syd raised the matter of the . Syd expressed the view that climate change was a threat that needed addressing as well.

Mark advised the meeting that there is a World Indigenous Tourism Summit in Perth this year. Mark understands the Department of the Premier and Cabinet (DPC) is providing funding for some delegates to attend. Mark expressed the view that it would be beneficial if any members of Committee could attend. Yvonne raised her involvement with the Adelaide City Council (ACC) and their interest in heritage places, naming of streets. She explained that they are developing a history of Adelaide Airport and are looking to construct a cultural centre in Victoria Square.

Keith advised that the Alliance engages closely with the ACC as one of the Alliance members.

Syd stated that he was keen to hear about the built environment and closer associations with Aboriginal connections. Syd spoke of the Aboriginal flag having been designed in the ; the .

Keith contributed the suggestion of mission churches as well, and expressed the view that they are part of Aboriginal peoples’ stories while being shared sites.

Yvonne contributed St Francis’ Boys Home at Semaphore. Syd offered Eddy Betts’ pocket before suggesting to Keith that he leave the Committee with some homework.

Loralee suggested that heritage is not a house that you can lock up.

Keith stated that the channels are open and that he is committed to see Aboriginal cultural heritage included.

Discussion then ranged around appointments to the HC and whether an Aboriginal representative would be countenanced.

Keith advised that the Minister acknowledges First Nations peoples.

Low-flying planes with laser technology will be used to create three-dimensional maps of firegrounds on Kangaroo Island. The detailed maps show the direction of the fire, the affected areas and even surviving pockets of land. The data is free and accessible to the public and could help communities with recovery efforts and reducing future fire risks on their properties. Meanwhile, fire affected honey producers on Kangaroo Island say they’ve experienced an increase in online sales thanks to the State Government’s Book Them Out campaign. New report outlines recommendations aimed at lowering council rates

A series of recommendations aimed at lowering council rates have been outlined in a new report by the Productivity Commission. The review suggests that all councils should publish their spending online to enable ratepayers to make comparisons with other Local Government areas. After an enormous effort by firefighters, the Kangaroo Island community and volunteers, we reached a milestone on Thursday 6th February with the Kangaroo Island fire declared safe by the CFS.

As you know a number of our parks on the island have been impacted by the fires and they remain closed to public access for safety reasons.

We recognise there is strong interest from our tourism industry, the Kangaroo Island community, environmental partners and stakeholders to see and understand first-hand the impact of this bushfire event on our iconic natural environment.

We now have a limited opportunity to invite you to join us on an escorted site visit of Flinders Chase National Park. The secured route will take in Cape du Couedic, Admirals Arch and Remarkable Rocks so you can understand the scale of our recovery efforts.

I know it’s my fault I didn’t read the email properly but I wanted to go on the Flinders Chase trip today but didn’t realise the pick up was from Penneshaw hence I went to Cape Jervis and realised I had to pay the Sealink myself. This is minor in many ways but DEW and previous DEWNR has disappointed me so much I just can’t ever be on the same page any longer. I’m tired of the SA Government being idle in our cultural right to look after and over Country. Yes there are things in the pipeline but it doesn’t stop Defence being financed to go over when we as Traditional Owners have not been over as yet. Dear Mark, Christine, Luke and Jeffrey

As you know, the western end of Kangaroo Island recently suffered extensive bushfires. Areas burnt included those supporting 27 Aboriginal heritage sites recorded on the Central Archive maintained by Aboriginal Affairs and Reconciliation (AAR). As the heritage organisations you represent have registered an interest in Kangaroo Island, we would like to invite up to two representatives from each of your organisations to travel to KI to view and assess the fire impacts, particularly in relation to a cluster of Aboriginal sites in the Flinders Chase National Park.

An initial two‐night visit is offered as an opportunity for you to understand the damage caused, and to help you to consider a possible post‐fire ceremony or healing event on the Island. If after the initial visit a healing ceremony (or ceremonies) is considered appropriate, AAR will investigate the feasibility of options to facilitate travel to the island for further traditional owners.

When

If you have representatives who wish to attend, AAR is proposing that they travel either:  to KI late Monday 2 March, returning the morning of Wednesday 4 March, or  to KI late Tuesday 3 March, returning the morning of Thursday 5 March, or  to KI late Wednesday 4 March, returning the morning of Friday 6 March.

I apologise for the very short notice. Next week is the only week in the near future that AAR is available to travel to KI. If there is to be ceremony, we think that it should happen sooner rather than later, so this initial scoping trip needs to happen quickly. There is of course no obligation to attend.

Who

Invitations are extended to up to two representatives of the:  Original Southern South Australian Tribes Indigenous Corporation  Ramindjeri Heritage Association  Ngarrindjeri Heritage Committee Inc  Kaurna Nation Cultural Heritage Association Inc.

After the initial visit, it is contemplated that a larger contingent of TOs may visit KI for a ceremony/healing event.

Where

Given fire damaged roads, travel will be slower than usual, so it will not be possible to visit all impacted sites within the time available. For this reason, AAR is proposing we visit an area of the Flinders Chase National Park that 1 supports 10 sites that are all relatively close, accessible and on crown land. AAR will send 3 archaeologists (Alex van Wessem, Matt Schlitz, Danielle Furniss) and a GIS mapping expert (Alex Nuijten). Travel to these sites takes at least 90 minutes from Kingscote. We will spend a full day there, driving by cars early on the morning after attendees’ arrival.

Transport

Transport from Adelaide will likely be by bus, possibly the Sealink Bus departing Adelaide at 3.30 pm and arriving at Cape Jervis 5.15 for ferry departure at 6pm. Return times can be negotiated. Possibilities include returning via Penneshaw to Cape Jervis 7.00am for SeaLink bus 9.30 arriving Adelaide 11.30 am. A later return may be more convenient for some attendees. On the island AAR will have four cars, each to be driven by an AAR employee, allowing representatives from each heritage organisation to travel separately.

Food and Accommodation

Accommodation for two nights will be provided, likely in Kingscote or somewhere nearby depending on availability. Dinners and breakfast will be provided at the accommodation. AAR will procure lunch for the day at the Flinders Chase.

Costs

AAR will cover all transport, food and accommodation costs from the time of your pick up until your return to Adelaide. Fees for heritage services are not available. This trip is offered for the direct benefit of attendees and their organisations, not to provide services to government or a third party. Again, there is no obligation to attend.

If representatives from your organisation do wish to attend, please let me know as soon as possible, preferably today, of the names of representatives and their preferred day to travel to KI. We will have to choose the most popular day to travel, it is not possible to run separate tours for particular groups.

As you know, the western end of Kangaroo Island recently suffered extensive bushfires. Areas burnt included those supporting 27 Aboriginal heritage sites recorded on the Central Archive maintained by Aboriginal Affairs and Reconciliation (AAR). As the heritage organisations you represent have registered an interest in Kangaroo Island, we would like to invite up to two representatives from each of your organisations to travel to KI to view and assess the fire impacts, particularly in relation to a cluster of Aboriginal sites in the Flinders Chase National Park.

An initial two‐night visit is offered as an opportunity for you to understand the damage caused, and to help you to consider a possible post‐fire ceremony or healing event on the Island. If after the initial visit a healing ceremony (or ceremonies) is considered appropriate, AAR will investigate the feasibility of options to facilitate travel to the island for further traditional owners.

When

If you have representatives who wish to attend, AAR is proposing that they travel either:  to KI late Monday 2 March, returning the morning of Wednesday 4 March, or  to KI late Tuesday 3 March, returning the morning of Thursday 5 March, or  to KI late Wednesday 4 March, returning the morning of Friday 6 March.

I apologise for the very short notice. Next week is the only week in the near future that AAR is available to travel to KI. If there is to be ceremony, we think that it should happen sooner rather than later, so this initial scoping trip needs to happen quickly. There is of course no obligation to attend.

Who

Invitations are extended to up to two representatives of the:  Original Southern South Australian Tribes Indigenous Corporation  Ramindjeri Heritage Association  Ngarrindjeri Heritage Committee Inc  Kaurna Nation Cultural Heritage Association Inc.

1 After the initial visit, it is contemplated that a larger contingent of TOs may visit KI for a ceremony/healing event.

Where

Given fire damaged roads, travel will be slower than usual, so it will not be possible to visit all impacted sites within the time available. For this reason, AAR is proposing we visit an area of the Flinders Chase National Park that supports 10 sites that are all relatively close, accessible and on crown land. AAR will send 3 archaeologists (Alex van Wessem, Matt Schlitz, Danielle Furniss) and a GIS mapping expert (Alex Nuijten). Travel to these sites takes at least 90 minutes from Kingscote. We will spend a full day there, driving by cars early on the morning after attendees’ arrival.

Transport

Transport from Adelaide will likely be by bus, possibly the Sealink Bus departing Adelaide at 3.30 pm and arriving at Cape Jervis 5.15 for ferry departure at 6pm. Return times can be negotiated. Possibilities include returning via Penneshaw to Cape Jervis 7.00am for SeaLink bus 9.30 arriving Adelaide 11.30 am. A later return may be more convenient for some attendees. On the island AAR will have four cars, each to be driven by an AAR employee, allowing representatives from each heritage organisation to travel separately.

Food and Accommodation

Accommodation for two nights will be provided, likely in Kingscote or somewhere nearby depending on availability. Dinners and breakfast will be provided at the accommodation. AAR will procure lunch for the day at the Flinders Chase.

Costs

AAR will cover all transport, food and accommodation costs from the time of your pick up until your return to Adelaide. Fees for heritage services are not available. This trip is offered for the direct benefit of attendees and their organisations, not to provide services to government or a third party. Again, there is no obligation to attend.

If representatives from your organisation do wish to attend, please let me know as soon as possible, preferably today, of the names of representatives and their preferred day to travel to KI. We will have to choose the most popular day to travel, it is not possible to run separate tours for particular groups.

As you are very likely aware, on 15 March 2020, the Premier of South Australia declared a public health emergency in South Australia in relation to the Novel Coronavirus (COVID-19) pandemic. Following that declaration, state and federal health authorities have advised and directed the cancellation or postponement of all non-essential public meetings.

In compliance with that advice, and in order to limit the spread of COVID-19, the public meeting proposed to discuss the Wearing Street Aquatic and Arts Precinct Redevelopment (Project) on 31 March 2020 at the Port Noarlunga Arts Centre is cancelled.

Section 13 of the Aboriginal Heritage Act 1988 (SA) (Act) requires the Premier to take “all reasonable steps” to consult with relevant Aboriginal parties whenever there is an application for authorisation under the Act, as is the case with the Project. The Act does not though mandate public meetings, and Aboriginal Affairs and Reconciliation (AAR) considers it unreasonable to ask people to attend such a meeting in the midst of a public health emergency.

While no public meeting will be held, AAR will seek to directly contact key Traditional Owners with a known interest in the Project area to seek their submissions prior to the closure of the consultation period.

Thanks for the tip regarding the wetting/stabilisation agent. I like your thinking here. I hadn't heard of this particular product. I noted this bit:

1 Rainstorm received an Earth Award for Outstanding Product Performance from the Civil Construction Federation of Australia for a project in the Pilbara in which we applied Gluon™ to sand dunes using helicopter applications (truck access was limited). Gluon™ is a versatile water-bound polymer emulsion which provides high performance veneering for sites requiring seed rehabilitation and planting. Utilise our expert application services, or we can provide site- specific application procedures and equipment is needed.

Generally speaking if TOs are happy for a chemical agent to go on top of coastal dune sand on top of the old people then this could be a good process for any agreed small area revegetation/hydromulching should this secondary process get approval/funds. I was trying to find the technical sheet to see what's in it.

I'll be picking up some gear at Netley first thing in the morning and able to meet you at the Clause 12(1) carpark around 11.30am. Does that work for you?

I'll have site information, GPS, camera, scales and shovels and sand buckets and pick up some gloves/disinfectant from work. Crown land vegetation is present but we will need to gather it on the surface so whatever is practical at this point.

Can you let me know if Clyde/Jordan/Ngarrindjeri have any concerns/happy for us to go ahead as I df just want to respect the process.

Likewise, thanks for the kind words and for the privilege of working on country with you. It was a good day. I will be in touch regarding a conversation with Ramindjeri and Ngarrindjeri around a longer term, collaborative conservation plan. Having seen the landscape for the first time I have a feeling that the wider area contains more burials or could be a larger burial ground. This suggested by the site card maps. There is a second burial on the downslope from the carpark area which will also need to be monitored/revisited as part of the plan.

I’ll forward some information and images from Friday asap to you and Ngarrindjeri.

Last Wednesday 25 March 2020, Ellie Simpson (Senior Forensic Scientist, SAPOL) contacted me as below to advise that the human remains at Aboriginal site Clause 12(1) had become exposed again. An urgent response was required.

Following Ellie's request I sought to contact both Ngarrindjeri and Ramindjeri TOs to arrange an urgent (temporary) conservation measure for the burial site. Mark then emailed Clyde and Jordan at Ngarrindjeri that he was able to assist in a separate email.

Background

This burial site on coastal reserve (Crown land) was recorded in late February 2014 and the remains at that time were recovered from downslope and reburied with jute matting and locally sourced rocks by Michael Diplock (Heritage specialist) and Ngarrindjeri Heritage Officers. Short and longer term conservation of the site was again requested in 2015, 2016 and 2018 following SAPOL reports that the remains had become exposed.

The site is located in an actively eroding coastal landscape with considerable sand slip and greater susceptibility of site exposure following high wind and storm events. SAPOL were informed of the latest exposure by Corey Jackson (Coastal Watch) based at Yankalilla Council.

Temporary Conservation Measure

On Friday 27 March 2020 Mark Koolmatrie (Ramindjeri) and Matt Schlitz (Principal Heritage Officer, Aboriginal Affairs and Reconciliation) relocated Clause 12(1) Mark undertook a cleansing ceremony prior to entering the conservation reserve. The site was relocated and confirmed as the reported site in the Central Archive. Spatial recording of bone fragments which had moved downslope was undertaken. An immediate conservation zone was also spatially recorded for the Archive and a future conservation plan subject to consultation with TOs. Photographs of the existing condition of the site were taken and for each stage of the conservation process at the site. Mark Koolmatrie returned the remains to the main burial location. It was agreed that geotextile bags be placed at the western foot of the burial to arrest the rate of sand slip. Sand was then sourced from a sterile location away from the burial to minimise any site disturbance. Shell and crystal quartz and quartzite stone artefacts were observed downslope. The sand was applied over the entire burial with additional rocks to stabilize potential slippage. Dead brush and sand was then reaapplied over additional jute matting tied down by geotextile bags at the western and eastern ends of the burial orientation.

Ongoing Protection

The temporary measures applied last Friday will not last without a more permanent solution. The site will require additonal stabilisation to prevent another exposure event. AAR would like to develop a collaborative approach between Ngarrindjeri and Ramindjeri TOs, the Yankalilla

3 District Council (including Coast Care) and NRM to develop a longer term conservation stragey for the Clause 12(1) area. I contacted Derrick Simpson (General Inspector/Fire Prevention Officer, Yankalilla Council) today and I now have these contact details.

AAR wishes to assist you to resolve this ongoing matter and will strive to put a more permanent conservation measure in place for burial sites in this reserve. It is apparent that this area holds significant cultural values and there is the potential for further burials to become exposed. There are additional threats from campers and dogs in the reserve area that need to be managed.

Please let me know if you would like to receive the images and to meet to discuss the development of a conservation management plan. This can be via a teleconference given ongoing concerns with COVID‐19.

Good morning Matt, I hope all is well for you at work and at home.

Yesterday I was notified by SAPOL that human skeletal remains were located by members of the public at Clause 12(1) .

I examined a photograph of the remains and was able to confirm that it is the same skeleton that was first discovered in 2015, and due to insufficient conservation efforts, has since been reported to me in 2016, 2018 and 2019. This is now the fifth report I have received.

Police indicated to me that the people finding the bones were quite distressed by the discovery.

Is it possible for you to engage with the Traditional Owners to further protect and conserve these bones? At present the skull is sitting on top of a pile of rocks with other bones scattered around it. Looking at the more recent photographs it does appear to me that the bones are becoming damaged by the exposure to the weather (and possibly human interference).

Mr Koolmatrie noted that while the applicant has previously worked with Kaurna, it should be mindful that there are other groups beyond Kaurna that have an interest in the area. The applicant, in Mr Koolmatrie’s view, should be inclusive rather than exclusive. He noted that OSSATIC members wish to be involved in any work that occur in the application area, in terms of heritage management or other employment opportunities.

Further, Mr Koolmatrie noted that Kaurna should be aware that there are other people outside of its own small cohort of people.

Mr Koolmatrie made reference to the Clause 12(1) burial recovery project in 2011 where the Kaurna and Ramindjeri groups worked in close proximity to one another. In his view, this showed state government’s acknowledgement that both groups have a ‘shared history’ in the area. Mr Koolmatrie also noted that the application area is close to the Clause 12(1) burial site, and that while there would unlikely be ancestral remains found within the application area, artefacts may be present. The proximity to theClause 12(1) burial site indicates that Aboriginal people were occupying and using the area, and that the area is significant.

Mr Koolmatrie recommended that the applicant should implement strategies to ensure that any disturbance to heritage is minimised. He was also supportive of the applicant's willingness to adhere to AAR’s Aboriginal Heritage Discovery Protocols. In addition, he also supported AAR’s proposal to require the applicant’s staff and contractors to attend a legislative awareness session prior to the works commencing.

On the topic of the Clause 12(1) anthropological site, Mr Koolmatrie advised that it is a Kaurna women’s site. He therefore asked whether involvement in the

2 monitoring works associated with the project should be restricted to women only. Mr Koolmatrie noted that if it is Kaurna’s preference that the monitoring work should only be undertaken by women, OSSATIC would be supportive of this.

Heritage Tourism Strategy update

Thank you for the opportunity to present to the State Aboriginal Heritage Committee on the development of a Heritage Tourism Strategy and Action Plan for South Australia. We value the contribution the Committee is making to this project via the representation of Mr Mark Koolmatrie on the Heritage Tourism Alliance.

In the presentation we provided an overview of the outcomes of the first round of stakeholder engagement to inform development of the strategy and action plan. Enclosed is a copy of the Engagement Report which provides a more detailed summary of the outcomes.

The Heritage Tourism Alliance is progressing the development of a draft action plan to support implementation of the Heritage Tourism Strategy. It is proposed that a specific action within the plan articulate the need for further engagement with Aboriginal people, communities and stakeholders to better understand and identify how Aboriginal heritage tourism ambitions can be realised and supported. As the State Aboriginal Heritage Committee is a key partner in growing heritage tourism, we would seek to work collaboratively with the Committee in implementing this action.

Once available, a copy of the draft strategy and action plan will be provided to the Committee for feedback and endorsement, or otherwise, of actions related to the development of Aboriginal heritage tourism in South Australia. This request for feedback will form part of a second round of engagement to be undertaken before the strategy and action plan is finalised for release by the Minister.

During our presentation, it was raised by your Committee that an important step towards progressing heritage in South Australia would be the inclusion of an Aboriginal heritage representative on the South Australian Heritage Council (the Council). As you may be aware the Council is appointed by the Minister for Environment and Water via a

Following Ellie's request I sought to contact both Ngarrindjeri and Ramindjeri TOs to arrange an urgent (temporary) conservation measure for the burial site. Mark then emailed Clyde and Jordan at Ngarrindjeri that he was able to assist in a separate email.

Background

This burial site on coastal reserve (Crown land) was recorded in late February 2014 and the remains at that time were recovered from downslope and reburied with jute matting and locally sourced rocks by Michael Diplock (Heritage specialist) and Ngarrindjeri Heritage Officers. Short and longer term conservation of the site was again requested in 2015, 2016 and 2018 following SAPOL reports that the remains had become exposed.

The site is located in an actively eroding coastal landscape with considerable sand slip and greater susceptibility of site 3 exposure following high wind and storm events. SAPOL were informed of the latest exposure by Corey Jackson (Coastal Watch) based at Yankalilla Council.

Temporary Conservation Measure

On Friday 27 March 2020 Mark Koolmatrie (Ramindjeri) and Matt Schlitz (Principal Heritage Officer, Aboriginal Affairs and Reconciliation) relocatedClause 12(1) . Mark undertook a cleansing ceremony prior to entering the conservation reserve. The site was relocated and confirmed as the reported site in the Central Archive. Spatial recording of bone fragments which had moved downslope was undertaken. An immediate conservation zone was also spatially recorded for the Archive and a future conservation plan subject to consultation with TOs. Photographs of the existing condition of the site were taken and for each stage of the conservation process at the site. Mark Koolmatrie returned the remains to the main burial location. It was agreed that geotextile bags be placed at the western foot of the burial to arrest the rate of sand slip. Sand was then sourced from a sterile location away from the burial to minimise any site disturbance. Shell and crystal quartz and quartzite stone artefacts were observed downslope. The sand was applied over the entire burial with additional rocks to stabilize potential slippage. Dead brush and sand was then reaapplied over additional jute matting tied down by geotextile bags at the western and eastern ends of the burial orientation.

Ongoing Protection

The temporary measures applied last Friday will not last without a more permanent solution. The site will require additonal stabilisation to prevent another exposure event. AAR would like to develop a collaborative approach between Ngarrindjeri and Ramindjeri TOs, the Yankalilla District Council (including Coast Care) and NRM to develop a longer term conservation stragey for the Clause 12(1) area. I contacted Derrick Simpson (General Inspector/Fire Prevention Officer, Yankalilla Council) today and I now have these contact details.

AAR wishes to assist you to resolve this ongoing matter and will strive to put a more permanent conservation measure in place for burial sites in this reserve. It is apparent that this area holds significant cultural values and there is the potential for further burials to become exposed. There are additional threats from campers and dogs in the reserve area that need to be managed.

Good morning Matt, I hope all is well for you at work and at home.

Yesterday I was notified by SAPOL that human skeletal remains were located by members of the public at Clause 12(1) .

8 I examined a photograph of the remains and was able to confirm that it is the same skeleton that was first discovered in 2015, and due to insufficient conservation efforts, has since been reported to me in 2016, 2018 and 2019. This is now the fifth report I have received.

Police indicated to me that the people finding the bones were quite distressed by the discovery.

Is it possible for you to engage with the Traditional Owners to further protect and conserve these bones? At present the skull is sitting on top of a pile of rocks with other bones scattered around it. Looking at the more recent photographs it does appear to me that the bones are becoming damaged by the exposure to the weather (and possibly human interference).

He supports the project, on the proviso that Ramindjeri people are part of the entire project. Mr Koolmatrie added that if the Applicant is not willing to engage the Ramindjeri people, then the authorisations should not be granted.

Mr Mark Koolmatrie participated in the IHC heritage survey walk in February 2020 and advises that his position as set out in that report remains unchanged. In particular, Ramindjeri people should be involved in any future work to be carried out on the causeway, including construction employment opportunities, consultation on revegetation and design elements and, to be involved in all further consultation relating to heritage management on the island.

Mr Koolmatrie emphasised the importance of having Ramindjeri monitors for all ground and seafloor disturbing works, but also for structural elements going into the sea, such as pylons. This is because there will be obstruction to sea and marine life, particularly whales which are sacred in Ramindjeri culture, and also dolphins which come into the bay.

Should the authorisations sought be granted to the Applicant? Why or why not?

 Yes, provided that the Applicant meets the conditions set out below.

If the authorisations are granted, what conditions, if any, should be imposed on them?

Mr Koolmatrie would like the following conditions imposed on the authorisations, if granted:

Hey Toby. The Aboriginal Reform Group has stepped up their push for change in our communities.

There is a possibility of interstate print media occurring over the next couple of weeks that will ask for a royal commission, an independent ombudsman and an enquiry into some of our communities or a combination of all 3. (I too want the story of how a white woman is speaking as a traditional owner here in South Australia and this may occur he said but he has to get his head around why this has happened and more so why it is continuing).

Like many journalists they either take up a story and run with it or wait and then wait some more so I’m not sure if it will happen. I was interviewed yesterday so there is a possibility. (He told me that he was contacting other prominent leaders around our state for comment yesterday and today and then will ask The Premier for comment).

If I do hear if they will run a story I will keep you in the loop as I don’t want you to be blindsided. Thanks Mark.

Hi Matt, As discussed, an update from our meeting today.

Uncle Clyde, Mark, Candice and I met today to discuss the situation at Clause 12(1)

As we are all keenly aware, the issues we are facing at Clause 12(1) go back several decades or longer. To date, a significant amount of resources and effort have unsuccessfully been used in trying to resolve these issues. More importantly, the state of the burials continues to cause needless distress to Community.

Both Mark and NAC agree that first, a survey of the whole of the dune area needs to be carried out to understand the nature and extent of the problems. As a result of the survey, recommendations on remedial actions will then be put to AAR.

Can you please indicate whether AAR has the capacity to provide funding for the survey (and some staff to help) as well as for potential remedial actions? Regarding funding, we believe various other interested parties such as Yankalilla Council etc need to be approached for a contribution to this project.

We’re all looking forward to moving forward on this in a collaborative and productive approach.

The good news is that following recent AAR management discussion, AAR will commit to partially fund a longer term solution for the burial area. However, further consultation with DEW and Yankalilla District Council is now required to request additional support and funding.

AAR heritage staff will also be available for a site survey with Narrindjeri and Ramindjeri to inform the heritage conservation plan.

I'm on leave next week and will get back in touch shortly after to discuss engagement and funding commitment from the other relevant parties.

Hi. I’ve been contacted by Chris Mitchell the ex editor of The Australian newspaper. He is about to write a number of articles requesting a Royal Commission or at the very least an enquiry into why two Aboriginal Native Title bodies in South Australia are in Special Administration with at least two others facing the same, the issues of how an independent business totally diverted all Aboriginal business and funding from an Aboriginal community and Native Title body to their own business, how a non Aboriginal woman is allowed to in the position of being a traditional owner for an Aboriginal body and the list goes on. 1 What Chris is seeking is a response from government before the articles roll out starting Saturday week. Can you suggest who is the best person for Chris to call? I know this is difficult but it’s even more difficult for me to be caught in the middle. Chris’s number is Clause 6(1) . The Heritage Information Team advise that there is a registered archaeological site called Clause 12(1) in the area described.

Just a quick note that I haven’t forgotten about Clause 12(1) and I will be in touch with you regarding these projects next week. I have been drawn away to other parts of the State in recent months, but we now have Amy Ziesing (Senior Heritage Officer) who joined us in November and another position to be filled in January 2021 which will give the Conservation Team a much needed boost for our program of works.

BTW congratulations on your position as Chair of the SAHC! I understand that Jill and Toby have me down to provide a quick overview to the Committee at the next meeting.
