southern africa PERSPECTIVE, No. 1/83 HUMAN RIGHTS VIOLATIONS IN APARTHEID SOUTH AFRICA In 1982, the South African Government bought space in the Wall Street Journal for 13 ads at $24,000 each. A similar series in the Washington Post cost between $5,200 and $7,200 an ad. All ads showed blacks and whites together in settings implying full equality, as lawyers, students, sportsmen. The ads are part of a sophisticated prop aganda effort which is pushing "the changing face of South Africa." What is not changing in South Africa is the white minority government's commit ment to apartheid. This brief survey of human rights violations demonstrates that what is changing is only the particular methods employed to continue the policy of apartheid. The overwhelming majority of South Africa's people are victims of a racist system which inflicts deprivation, fear and oppression. Those who protest face detention, torture, imprisonment and even death. Blacks*, who outnumber whites by five to one, are completely disenfranchised. Under new constitutional proposals for a tri cameral parliament, those designated as Coloureds and Indians will be given separate institutions with the whites retaining the monopoly of power. The white chamber will have the largest number of members and will dominate the process of electing a president who will have wide-ranging executive power. The African majority remains totally excluded from this new structure. -

Comment The United States Arms Embargo Against South Africa: An Analysis of the Laws, Regulations, and Loopholes Raymond Paretzkyt Introduction With reports of violence and unrest in the Republic of South Africa a daily feature in American newspapers, public attention in the United States has increasingly focused on a variety of American efforts to bring an end to apartheid.. Little discussed in the ongoing debate over imposi- tion of new measures is the sanction that the United States has main- tained for the past twenty-three years: the South African arms embargo. How effective has this sanction been in denying South Africa access to items with military utility? Are there ways to strengthen the arms em- bargo so that it achieves greater success? An evaluation of the embargo is complicated by the fact that there is no one place in which the laws implementing it can be found. Rather, the relevant regulations have been incorporated into the existing, com- plex scheme of U.S. trade law. This article offers a complete account of the laws and regulations implementing the embargo, analyzes the defects in the regulatory scheme, and recommends ways to strengthen the em- bargo. The first part outlines the background of the imposition of the embargo, while the next three parts examine the regulations that govern American exports to South Africa and explore the loopholes in these reg- ulations that hinder their effectiveness. SUMMARY OF CHANGES Other than nonsubstantive, technical changes, this bulletin is revised to clarify that sales tax exemption for certain coins, bullion, or legal tender applies to coins, bullion, or legal tender that would be allowable investments in individual retirement accounts or individually-directed accounts, even if such coins, bullion, or legal tender was not actually held in such accounts. INTRODUCTION In general, an excise tax known as the state gross retail (“sales”) tax is imposed on sales of tangible personal property made in Indiana. However, transactions involving the sale of or the lease or rental of storage for certain coins, bullion, or legal tender are exempt from sales tax. Transactions involving the sale of coins or bullion are exempt from sales tax if the coins or bullion are permitted investments by an individual retirement account (“IRA”) or by an individually-directed account (“IDA”) under 26 U.S.C. -

INTRODUCIION The first results of Western economic and political sanctions against the government of South Africa are in: Apartheid's supporters have been strengthened while those seeking reforms have been weakened. "I'he evidence of this is abundant: ' . ++ In the whites-only election last month, the ruling National Party (NP)was returned with even greater control over the Parliament than before. ++ In the election, the racially moderate Progressive Federal Party (PW) was replaced as the official opposition party in the Parliament by the pro-apartheid Conservative Party (CP). This means that for the first time since the institutionalization of apartheid in 1948, the Pretoria government will be criticized in 'the Parliament not for moving too slowly to abolish apartheid, but for moving too quickly. ++ U.S. influence in Pretoria has been reduced, as the South African government has rejected what it views as unacceptable foreign interference in its internal affairs. ++ Economic sanctions have not damaged the South African economy severely. Most South African producers have found ' new markets for their products. Further, sanctions have caused a short-term stimulus, as the economy moves to create its own substitutes for former imports. ++ To the extent that the effects of sanctions have been felt in South Africa, they have been felt by blacks--precisely the people they were supposed to help. ++ Disinvestment by U.S. corporations doing business in South Africa also has set back the anti-apartheid campaign. U.S. corporatioh have sold their manufacturing plants and assets to South African businessmen at firesale prices. -
Forced Removal of Population the Apartheid Regime Has Sought to Enforce Strict Territorial Segregation of the Different ‘Population Groups’
residence, commercial activities and industry for members of the White, Coloured and Asian groups (each in separate zones). Based on these group areas are segregated local government structures, and a segregated tricameral parliament with separate White, Coloured and Indian chambers, designed to preserve white political power while extending limited participation in central government to small sections of the Indian and Coloured communities. The majority of the population in South Africa is united in rejecting the segregated political structures of apartheid. Forced Removal of Population The apartheid regime has sought to enforce strict territorial segregation of the different ‘population groups’. People are forcibly evicted from their homes if they are in a zone which the government has asigned to another group. The government speaks, not of forced removal or eviction, but of Relocation and Resettlement. The evictions take place in many different kinds of areas and under different laws. In rural areas people are moved on a number of different pretexts. The places in which they live may be designated Black Spots — these are areas of land occupied and owned by Africans which the government has designated for another group, usually white. The occupiers are moved to a bantustan. Others are moved in the course of Consolidation of the bantustans, as the regime attempts to reduce the number of fragments of land which make up the bantustans. Over a million black tenants have been evicted from white owned farms since the 1960s. Tenants who paid cash rent to the farms were called Squatters, implying they had no right to be on the land. -

It seeks to answer the question, how has activism changed in post-apartheid Manenberg as compared to the 1980s? The study analysed the politics of resistance in Manenberg placing it within the over arching mass defiance campaign in Greater Cape Town at the time and comparing the strategies used to mobilize residents in Manenberg in the 1980s to strategies used in the period of the 2000s. The thesis also focused on several key figures in Manenberg with a view to understanding what local conditions inspired them to activism. The use of biographies brought about a synoptic view into activists lives, their living conditions, their experiences of the apartheid regime, their brutal experience of apartheid and their resistance and strength against a system that was prepared to keep people on the outside. This study found that local living conditions motivated activism and became grounds for mobilising residents to make Manenberg a site of resistance. It was easy to mobilise residents on issues around rent increases, lack of resources, infrastructure and proper housing. -
