Background Introduction The Office of the Comptroller of the Currency’s (OCC) Comptroller’s Handbook booklet, “Mortgage Banking,” provides guidance for bank examiners and bankers on various mortgage banking activities, such as the purchase or sale of mortgages in the secondary mortgage market. Throughout this booklet, national banks and federal savings associations (FSA) are referred to collectively as banks, except when it is necessary to distinguish between the two. Background Mortgage banking generally involves loan originations as well as purchases and sales of loans through the secondary mortgage market. A bank engaged in mortgage banking may retain or sell loans it originates or purchases from affiliates, brokers, or correspondents. The bank may also retain or sell the servicing on the loans. Through mortgage banking, banks can participate in any combination of these activities. Banks have traditionally originated residential mortgage loans to hold in their loan portfolios. Examiners should refer to the “Retail Lending Examination Procedures” and the to-be- published “Residential Real Estate Lending” booklets of the Comptroller’s Handbook for guidance on banks that primarily originate mortgage loans to be retained in their loan portfolios. More expansive mortgage banking activities are a natural extension of the traditional origination process. This booklet and the examination procedures it outlines are intended for banks that engage in purchases or sales of mortgages in the secondary market. Mortgage banking is affected by changing economic conditions and new legislation, regulations, accounting principles, regulatory guidance, examination efforts, and legal actions. Numerous changes have addressed systemic issues revealed in the recent financial crisis, including deficiencies related to the origination and servicing of residential mortgage loans. In 2010, Congress passed the Dodd–Frank Wall Street Reform and Consumer Protection Act (Dodd–Frank), which included a number of changes to consumer protection laws and created the Consumer Financial Protection Bureau (CFPB). The CFPB has undertaken various rulemakings to implement Dodd–Frank changes, including amending Regulation Z to implement changes to the Truth in Lending Act (TILA) and Regulation X to implement changes to the Real Estate Settlement Procedures Act (RESPA). For instance, in January 2013, the CFPB issued final rules amending Regulation X and Regulation Z to introduce new servicing-related standards and requirements. Other final rules further amend Regulation Z, including to require that creditors make a reasonable, good faith determination of a consumer’s ability to repay any consumer credit transaction secured by a dwelling, to establish certain protections from liability for “qualified mortgages,” and to implement Comptroller’s Handbook 1 Mortgage Banking Version 1.0 Introduction > Background changes to the requirements for certain home-secured loans. Many of these rules are expected to become effective in January 2014.1 The CFPB’s rulemaking efforts, however, are ongoing. Bankers and examiners should ensure that the standards they follow are current. And the profitability of house flipping creates an incentive for scammers seeking to dislodge vulnerable — and often older — homeowners from their properties.2 In more economically depressed parts of the country, flipping is sometimes considered a boon because it puts dilapidated homes back on the market. However, in New York City, where prices are sky-high and demand for homes far exceeds supply, flipping contributes to gentrification and displacement. The practice not only affects homeowners, but also renters who live in 1-4 unit homes and often pay some of the most affordable rents in the city. Once an investor swoops in, these renters can find they’ve lost their leases as the property gets flipped.

    ORGANISATION FOR ECONOMIC CO-OPERATION AND DEVELOPMENT REPORT ON TAX FRAUD AND MONEY LAUNDERING VULNERABILITIES INVOLVING THE REAL ESTATE SECTOR CENTRE FOR TAX POLICY AND ADMINISTRATION EXECUTIVE SUMMARY This report contains information on the tax evasion and money laundering vulnerabilities associated with the real estate sector. The information contained in the report was provided by 18 countries represented in the Sub-Group in response to a questionnaire that was sent to delegates in July 2006. Apart from providing a useful overview of the key tax evasion and money laundering issues and risks associated with the real estate sector, the report is also intended to provide practical guidance to tax authorities that are seeking to implement or refine strategies to effectively address these risks. The key findings are as follows: In most of the countries surveyed, the real estate sector has been identified as an important sector being used to facilitate tax fraud and money laundering. There are no reported official figures or statistics about the dimension of the problem; one country, Austria, has reported an estimation of the amount of fraud involving the real estate sector of approximately € 70 million. The countries reported that the three most common methods and schemes used are: price manipulation (escalating prices make it easier to manipulate prices of properties and transactions), undeclared income / transactions and the use of nominees and/or false identities, and corporations or trusts to hide the identity of the beneficial owners. The method of concealing ownership has three main variations: a) onshore acquisitions through off- shores companies and/or through a complex structure of ownership; b) unreported acquisition of properties overseas; and c) use of nominees.

Specifically, it is not Ecology’s responsibility to determine what terms are used when referring to existing residential structures. Statewide, this means that there will continue to be substantial variation as to how local jurisdictions address nonconformities within the Shoreline. For Bremerton, it provides the opportunity to change how nonconformities are classified and how they are regulated. This report aims to help provide a better understanding of the underlying issues surrounding the optional language changes to the nonconforming code section. Staff is asking the Planning Commission to provide direction by answering the following questions: 1. Should the City create an alternate name for legal nonconforming residential structures on the shoreline; and 2. Should the City allow for the full replacement of such residential structures an unlimited number of times? Multiple factors, such as a household’s financial status and expectations about the future, influence the decision. Few people who decide to purchase a home have the necessary savings or available financial resources to make the purchase on their own. Most need to take out a loan. A loan that uses real estate as collateral is typically referred to as a mortgage. A potential borrower applies for a loan from a lender in what is called the primary market. The lender underwrites, or evaluates, the borrower and decides whether and under what terms to extend a loan. Different types of lenders, including banks, credit unions, and finance companies (institutions that lend money but do not accept deposits), make home loans. The lender requires some additional assurance that, in the event that the borrower does not repay the mortgage as promised, it will be able to sell the home for enough to recoup the amount it is owed. Typically, lenders receive such assurance through a down payment, mortgage insurance, or a combination of the two. Mortgage insurance can be provided privately or through a government guarantee. After a mortgage is made, the borrower sends the required payments to an entity known as a mortgage servicer, which then remits the payments to the mortgage holder (the mortgage holder can be the original lender or, if the mortgage is sold, an investor).
