Testimony of Lori Wallach Director, Public Citizen’s Global Trade Watch before U.S. International Trade Commission on “Economic Impact of Trade Agreements Implemented Under Trade Authorities Procedures, 2021 Report” October 2, 2020 Lori Wallach, Director Public Citizen’s Global Trade Watch 215 Pennsylvania Ave. SE Washington, D.C. 20003 [email protected] 202-546-4996 Mister Chairman and members of the Commission, thank you for the opportunity to testify today on the economic impact of trade agreements implemented since 1985 under trade authorities procedures so as to contribute to the Section 105(f)(2) report required by the Bipartisan Congressional Trade Priorities and Accountability Act of 2015. I am Lori Wallach, director of Public Citizen’s Global Trade Watch. Public Citizen is a national public interest organization with more than 500,000 members and supporters. For more than 45 years, we have advocated with some considerable success for consumer protections and more generally for government and corporate accountability. It is critical that the Commission’s evaluation of the economic impacts of the Free Trade Agreements (FTAs) negotiated by the U.S. government under trade authorities procedures (Fast Track) provides accurate and trustworthy information to policymakers and the general public about the agreements’ actual outcomes. In many communities nationwide, decades of trade agreements negotiated on a model established with the North American Free Trade Agreement (NAFTA) have caused economic damage to many and fueled anger and despair. The dwindling ranks of defenders of that model argue that it was not trade, but other policies and trends that have caused the problems people “blame” on trade pacts. -

INTRODUCTION The ideological landscape of post cold-war America is coming into resolution. Liberal interests, specifically labor and environ- mental groups, are increasingly apprehensive of the World Trade Organization ("WTO" or the "Organization"). It is not difficult to understand why. Thus far, the WTO has been no friend to these interests. While globalized trade promoted by the WTO has provided the preconditions for a boom in corporate profits, American workers are less economically secure and, despite recent gains, probably less well compensated than in the period before globalization. Additionally, globalized free trade has imperiled the environment in ways that the WTO has done nothing to remedy. These challenges to both labor and the environment are similar, and in many ways, call for similar responses. Neverthe- less, in this Article, I will focus on environmental concerns, leav- ing the question of how labor should respond to the WTO for another day. The New Rules of the Road: A Progressive Approach to Globalization By Jared Bernstein and Lori Wallach Introduction The emergence of trade as a top election issue shows that the economic and social costs imposed by our current trade policy model have reached a tipping point. For purveyors of the status quo, this is a crisis, as the inherent inequities in their approach to trade have finally surfaced. For those of us who have long recognized such inequities, the current moment presents an opportunity to craft a new model, a new set of “rules of the road.” Far from trying to set back the clock on globalization, it is only through this new, far more inclusive, non-corporate-centric approach that we can rebuild American support for expanded trade. This will not occur by continuing to assert that, despite their experiences, those who perceive themselves and their communities as having been hurt by exposure to the forces of globalization are just plain wrong. Or that the next trade agreement will be the one that fixes everything. Or by offering the increasingly large portion of the population who find themselves on the losing side of the current rules some temporary adjustment assistance. -

LORI WALLACH Director, Public Citizen’s Global Trade Watch Lori Wallach is the director of Public Citizen’s Global Trade Watch. A 30-year veteran of congressional trade battles starting with the 1990s fight over Fast Track and NAFTA, she was named to the “Politico’s 50” list of thinkers, doers and visionaries transforming American politics in 2016 for her leadership in the Trans-Pacific Partnership debate. Wallach is an internationally recognized expert on trade with experience advocating in Congress and foreign parliaments, trade negotiations, courts, government agencies, the media and in the streets. Dubbed “the Trade Debate’s Guerrilla Warrior” in a National Journal profile and “Ralph Nader with a sense of humor” in a Wall Street Journal profile, she combines a lawyer’s expertise on the terms and outcomes of agreements with insight from the front lines of trade debates. Wallach’s specialty is translating arcane trade issues into accessible language. FR: Lori Wallach and Todd Tucker, Public Citizen’s Global Trade Watch DT: Wednesday, June 13, 2012 RE: Public Interest Analysis of Leaked Trans-Pacific Partnership (TPP) Investment Text After more than two years of negotiations under conditions of extreme secrecy, on June 12, 2012, a leaked copy of the investment chapter for the Trans-Pacific Partnership (TPP) trade agreement was posted at http://tinyurl.com/tppinvestment . Public Citizen has verified that the text is authentic. The leaked text provides stark warnings about the dangers of “trade” negotiations occurring without press, public or policymaker oversight. It reveals that negotiators already have agreed to many radical terms granting expansive new rights and privileges for foreign investors and their private corporate enforcement through extra-judicial “investor-state” tribunals. Although TPP has been branded as a “trade” agreement, the leaked text shows that TPP would limit how signatory countries may regulate foreign firms operating within their boundaries, with requirements to provide them greater rights than domestic firms. The leaked text reveals a two-track legal system, with foreign firms empowered to skirt domestic courts and laws to directly sue TPP governments in foreign tribunals. There they can demand compensation for domestic financial, health, environmental, land use laws and other laws they claim undermine their new TPP privileges. The leak also reveals that all countries involved in TPP talks - except Australia - have agreed to submit to the jurisdiction of such foreign tribunals, which would be empowered to order payment of unlimited government Treasury funds to foreign investors over TPP claims. As revealed in Section B of the leaked text, these tribunals would not meet standards of transparency, consistency or due process common to TPP countries’ domestic legal systems or provide fair, independent or balanced venues for resolving disputes between sovereign nations and private investors. -

Angus King: Rethinking Free Trade Angus King H’07, a distinguished lecturer at the College since 2004, is a regular contributor to the Bowdoin Daily Sun. In his latest post, the former two-term governor of Maine argues that free trade isn’t all that it’s cracked up to be. Imagine the governor of one of our states going to the Congress and making the following argument: “We are a small state that is struggling economically; we’re predominantly rural and would like to expand our manufacturing base. But it’s hard because we’re subject to those onerous federal environmental laws, which make building factories more expensive, as well as those pesky federal safety and wage and hour laws, which drive up the cost of labor. “So we would appreciate it if you would exempt us from all those laws; then, we could attract jobs from the rest of the U.S. and sell our products for less than what they would cost to make in the other states. Consumers in the other states would get cheaper goods and we’d get lots of new jobs. And maybe, eventually, our economy will improve to the point where we can buy stuff from the other states as well. So how about it?” Sound preposterous? Absolutely; the guy would be laughed out of Congress and not even get through the door at the White House. And yet, this is essentially what happens when we sign a free trade agreement with another country, especially one with minimal environmental and labor laws. -
