INSTRUCTIONS FOR THE PP’s
A. All the PP’s who have applied for issuance of TOR by online registration of the proposals can take-up the EIA studies as per the Standard TOR developed by the Minister of Environment, Forest & Climate Change, New Delhi. The SEAC will have the right and the responsibility of stipulating additional TOR in specific Projects considering its project features.
B. The State Expert Appraisal Committee will consider the project proposals for prior EC, in its meeting to be held on 10/08/2019 at 10.30 A.M. at M.P. Pollution Control Board, E-5, Arera Colony, Bhopal. The Project proponents are requested to attend the meeting in person or depute a competent person having proper & full background of the proposed project with proper authorization in writing Capacity-Authority Letter), who can explain the project and also respond to the queries & offer his views on suggestions made by the committee. Such person would be required to make a presentation on the salient features of the project, the related environmental issues, risk assessment and proposed Environmental Management Plan. His commitment before the committee will be treated as your commitment.

D. As per the OM No. 11114 dated 08/02/20126 of SEIAA Project Proponent should submit an affidavit to be executed on appropriate non- judicial stamp paper of minimum value and attested by public notary along with online application for environmental clearance and at the time of submission of hard copy with declaration read as under:
“I hereby give an undertaking that the data and information given in the application and enclosures for environmental clearance are true to the best of my knowledge and belief without concealing any fact and I am aware that if any part of data and information submitted is found to be false or misleading at any stage the project will be rejected and clearance given, if any to the project will be revoked at our risk and cost.” The PP’s who have not submitted above declaration at the time of online submission/with hard copy, should bring above affidavit at the time of presentation.
E. Kindly send a brief write up of project/executive summary of the project (maximum three page, in word format) and the name of the consultant with the Sl. No. in the QCI/NABET list in a week’s time by e-mail to the following addresses: [email protected] & [email protected] atleast 03 days prior to the SEAC meeting mentioning case number and agenda meeting number with date.
F. In accordance with the circular no. J-11011/618/2010-IA.II (I) dated 30.5.2012, in case of expansion project and or renewal of mine lease for which environment clearance was issued earlier, the project proponent shall submit a certified report of the status of compliance of the conditions stipulated in the environment clearance for the on-going / existing operations of the project by the Regional Offices of Ministry of Environment, Forest and Climate Change. The status of compliance of the conditions stipulated in the EC as highlighted in the report(s) will be discussed by the EAC during appraisal of the project.
G. Consideration of mining proposals involving violation of the EIA Notification, 2006, the project proponent shall give an undertaking by way of affidavit to comply with all the statutory requirements and judgements of Hon’ble Supreme Court of India dated 02/08/2017 in WP (C) No. 114 of 2014 in the matter of Common Cause V/s Union of India & others before grant of TOR/EC. The under taking interalia includes commitment of the PP not to repeat any such violation in future as per MoEF&CC OM No. F.NO. 3-50/2017-IA.III (Pt.) dated 30/05/2018. H. For all other projects (except building/construction projects, item 08 of schedule and mining projects of minor minerals up to 05 hectares under category-“B2”) information shall be provided in the prescribed Form-2 enclosed with OM issued by MoEF&CC vide circular no. F.No. 22-8/2018-IA.III dated 20th April, 2018 along with the copy of EIA/EMP report as per the generic structure given at Appendix-III of the EIA Notification, 2006, Summary of the Environmental Impact Assessment given in Appendix-IIIA. Risk Assessment Report. Copy of Feasibility Report or Detailed Project Report of Detailed Engineering Report, certification of compliance of earlier environmental clearance conditions in case of expansion proposals and final layout plant, as the case may be and as per the requirement contained in the EIA Notification, 2006 and/or the Form-2. I. The projects proposals which are scheduled for the EIA presentation in this meeting, the information shall be provided in the prescribed Form-2 enclosed with OM issued by MoEF&CC vide circular no. F.No. 22-8/2018-IA.III dated 20th April, 2018. J. The mining project proponents involving violations of the EIA Notification, 2006 under the provisions of S.O. 804 (E) dated 14/03/2017 and subsequent amendments for TOR/EC shall give an undertaking by way of affidavit to comply with all the statutory requirements and judgment of Hon;ble Supreme Court dated the 2nd August 2017 in Writ Petition (Civil) No. 114 of 2014 in the matter of Common Cause versus Union of India and Ors. Before grant of TOR/EC the undertaking inter-alia include commitment of the PP not to repeat any such violation of future. In case of violation of above undertaking, the TOR/Environmental Clearance shall be liable to be terminated forthwith. K. All Certificates’ should be addressed to the Ministry on letter head with letter number & dispatch number. L. The Consultants are requested to carry a valid proof in respect of their accreditation status from NABET. M. Only three sets of ppt presentations will be required alongwith 07 sets of detailed executive summery duly signed by the PP during appraisal of the project.
