SPPA/S5/16/6/A STANDARDS, PROCEDURES AND PUBLIC APPOINTMENTS COMMITTEE AGENDA 6th Meeting, 2016 (Session 5) Thursday 6 October 2016 The Committee will meet at 10.00 am in the Adam Smith Room (CR5). 1. Cross-Party Groups: The Committee will consider applications for recognition from two Cross-Party Groups, and take evidence from— Gordan MacDonald, Convener of the proposed CPG on Independent Convenience Stores; and then from— Jackson Carlaw, Convener of the proposed CPG on Building Bridges with Israel. 2. Cross-Party Groups - approval: The Committee will decide whether to accord recognition to the proposed Cross-Party Groups on Independent Convenience Stores and Building Bridges with Israel. 3. First Minister's Questions (in private): The Committee will consider a draft report and Standing Order rule changes. 4. Work programme (in private): The Committee will consider its work programme. In accordance with the provisions on Cross-Party Groups (CPGs) set out in Section 6 of the Code of Conduct (the Code), proposals for the establishment of CPGs in the Scottish Parliament must be submitted to the Standards, Procedures and Public Appointments Committee for its approval. 2. The provisions referred to in this note relate to Volume 2, Section 6, of the Code of Conduct. 3. There are two proposed Groups for the Committee‘s consideration. Proposed CPG on Independent Convenience Stores 4. The registration form submitted by the proposed CPG on Independent Convenience Stores is attached at Annexe A to this note. Consideration by the Standards, Procedures and Public Appointments Committee 5. Paragraph 6.3.10 of the Code states ―….As part of its consideration, the Standards, Procedures and Public Appointments Committee will invite one of the proposed Group‘s MSP office bearers (usually the Convener) to attend a meeting to explain the justification for the proposed Group‖. Gordon MacDonald MSP has been invited to the meeting to discuss registration of the proposed Group. Purpose 6. Paragraph 6.3.11 of the Code states ―the Committee will pay particular attention to a proposed Group‘s purpose. If the Committee considers that a Group is being proposed not in the public interest but, for example, to further particular commercial interests, the Group will not be accorded recognition. The Committee will also consider whether the purpose of a proposed Group overlaps the remit of an existing Group. The proposed Group has been asked to provide justification as to why its aim could not effectively be achieved within the existing Group‖. 7. The stated purpose of the proposed Cross-Party Group on Independent Convenience Stores is— ―To inform MSPs of the issues and challenges facing independent convenience stores and to highlight the contribution local neighbourhood shops make to Scotland's communities - particularly helping to sustain rural and marginalised urban communities - and to Scotland's economy (there are more convenience stores per head of population than in the rest of the UK). The group will bring together the key stakeholders in the independent convenience store sector: retailers, wholesalers, manufacturers and trade associations. It will connect with wider 1 SPPA/S5/16/6/1 stakeholders in the voluntary and charity sectors and invite guest speakers to participate.‖ Membership 8. Paragraph 6.4.1 of the Code requires Group membership to include at least five MSPs, with at least one MSP from each of the parties or groups represented on the Parliamentary Bureau. The Committee has previously agreed that there should be a general waiver of this Rule in the current Session and Groups are now required to have five MSPs from the majority of parties represented on the Parliamentary Bureau. The proposed Group meets this requirement. 9. The MSP membership (by party) of the proposed Group is as follows— 3 Scottish Conservative and Unionist Party 3 Scottish Labour Party 4 Scottish National Party 10. Paragraph 6.4.2 entitles groups to contain members from outwith the Parliament, but states that the overall membership of the CPG should be Parliamentary in nature. The proposed Group has listed two non-MSP members in the individual category and 33 in non-MSP member organisations. Office Bearers 11. Paragraph 6.4.3 requires one MSP to be Convener of the Group and there to be at least one other MSP office bearer. The proposed Group meets this requirement: Gordon MacDonald MSP is the Convener and Anas Sarwar MSP is the Deputy-Convener. Financial Benefits and Subscription 12. The registration form indicates that the Group will not receive financial benefits exceeding £500 per annum. 13. The registration form also indicates that members will not be charged a subscription. Proposed CPG on Building Bridges with Israel 14. The registration form submitted by the proposed CPG on Building Bridges with Israel is attached at Annexe B to this note. Consideration by the Standards, Procedures and Public Appointments Committee 15. Jackson Carlaw MSP has been invited to the meeting to discuss registration of the proposed Group. Purpose 16. The stated purpose of the proposed Cross-Party Group is— ―...to engage with Israel and build links based on business, culture and academia as well as exploring and countering issues of anti-Semitism at home and abroad.‖ 2 SPPA/S5/16/6/1 Membership 17. The MSP membership (by party) of the proposed Group is as follows— 5 Scottish Conservative and Unionist Party 1 Scottish Labour Party 1 Scottish Liberal Democrat 2 Scottish National Party 18. At agenda item 1 the Committee is invited to discuss any aspects of the application for recognition of the proposed Cross-Party Group on Independent Convenience Stores with Gordon MacDonald MSP and the proposed Cross-Party Group on Building Bridges with Israel with Jackson Carlaw MSP. At agenda item 2 the Committee will discuss whether to accord recognition to the proposed Groups. Please state the purpose of the Group. 2. Please also provide a brief explanation of the purpose of the Group and why the purpose is in the public interest. 3. Please also provide details of any overlaps with the purpose of existing Cross- Party Groups and an explanation of why, regardless of any such overlap, the Group should be established. 4. Please also provide an indication of the topics which the Group anticipates discussing in the forthcoming 12 months. 1. To inform MSPs of the issues and challenges facing independent convenience stores and to highlight the contribution local neighbourhood shops make to Scotland's communities- particularly helping to sustain rural and marginalised urban communities - and to Scotland's economy (there are more convenience stores per head of population than in the rest of the UK). The group will bring together the key stakeholders in the independent convenience store sector: retailers, wholesalers, manufacturers and trade associations. It will connect with wider stakeholders in the voluntary and charity sectors and invite guest speakers to participate. 2. The group will provide a unique forum for independent retailers in all of Scotland's communities including rural and island communities. It will have a particular focus on how independent convenience stores can connect with genuinely locally producers and suppliers. 3. There is no overlap with any existing cross party group. This is the only Cross Party Group to look exclusively at retail and the wider issues. 4. The agenda for the Group will be set and discussed with the members at the first official meeting It is proposed that the Group would meet approximately 4 times per year. Potential agenda topics include: Independent convenience stores, their contribution to the local economy and sustaining rural and marginalised urban communities. The impact and prevalence of retail crime. Promoting community engagement among convenience store retailers. 4 ANNEXE A The cost pressures on independent retailers and how these are affected by policy. Creating an eco-friendly and environmentally sustainable convenience store industry. To enable in-depth examination of these issues and to enable the cross party group to issue briefing papers and other reports for the benefit of MSPs, 3 sub• groups will be formed comprising members of the Group. These sub groups will be: 1. Convenience Stores and the Economy: The impact of cost pressures on the sector The interaction between reserved and devolved policy The contribution to the local economy · 2. Retail Crime: The impact and prevalence of retail crime Potential legislative solutions Illicit Trade Cyber-crime and its impact on retail 3.
