No.55433 Table Office MEMBERS OF RAJYA SABHA (DISQUALIFICATION ON GROUND OF DEFECTION) RULES, 1985 Under Rule 4(2) of the Members of Rajya Sabha (Disqualification on Ground of Defection) Rules, 1985, every member is required to furnish to the Secretary-General, inter-alia, a statement of particulars giving details of his/her party affiliation and declaration as in Form III set out for the purpose in the Rules. Rule 4(3) of the said Rules further provides that a summary of information furnished by the members under sub-rule (2) of this Rule is required to be published in Bulletin-Part II. Private Members Resolutions for 6 th May, 2016

As a result of draw of lot, the following Resolutions will, subject to compliance with the Rules, be set down for discussion on Friday, the 6 th May, 2016.

for incestuous rape on girls and women by suitably amending the provisions of the Indian Penal Code and other related laws; (b) amend the existing social laws so that a women should inherit half of the movable and immovable property of her husband after her marriage as a measure of social security to her; (c) reserve posts for women in all public employment so that they become economically independent; and (d) introduce welfare measures, subsistence allowance, old age allowance, medical care, old age and caring homes for the destitute widows, infirm and old women so that they too lead a honourable life in the society."

Shri D. Raja “Having regard to the fact that: (Admitted, (i) snatching away somebody’s life secured for crimes committed is not in second place consonance with evolving in the draw jurisprudence which embraces in its of lot) scope measures to reform the person and transform psychology in tune with the values of compassion and humanism; (ii) commission of a crime by somebody does not contract the scope to reform him or her, rather an approach to address the hidden faculties for realizing human worth is now accepted proposition in criminal jurisprudence and this is true for all human beings including those who have been convicted for heinous crimes; (iii) committing a crime is more a 5 sociological than a legal problem; (iv) research demonstrates the disproportionate use of death penalty against disadvantaged groups, as a study by students of National Law University, Delhi has shown that there are caste and religious biases in the imposition of death penalty in India, indicating that 94% of the persons given death sentences for terror related cases belonged to Dalit caste or religious minorities; (v) the former President of India, Late Dr. APJ Abdul Kalam had supported abolition of death penalty saying that as President, he felt pain in deciding mercy petitions of death row convicts since most of them had social and economic bias; (vi) the Supreme Court of India itself has admitted to errors and miscarriage of justice due to the arbitrary application of death penalty; (vii) the Law Commission Chairman, Justice AP Shah has also said that there is a serious need to re- examine the issue of death penalty since there are several inconsistencies in the system, which led to arbitrariness and discrimination in the imposition of death penalty; and

(viii) the majority of the members of United Nations have voted in support of the UN General Assembly resolution calling for a moratorium on the death penalty and India is among the minority of the Member countries still voting against the resolution seeking to ban the death 6

penalty,

this House urges upon the Government- (a) to reconsider its stand and make necessary amendments to various laws which have provisions for the death penalty so as to abolish capital punishment in the country; and (b) to declare a moratorium on all death sentence executions till the abolition of death penalty.”

Dr. T. Subbarami “Having regard to the fact that- (Admitted, Reddy (i) India is a sovereign, socialist, secured fourth secular, democratic republic as place in the declared in the Constitution of India; draw of lot) (ii) recently, there has been an increase in the incidents of communal violence and disturbance as created by miscreants and radical elements; (iii) growing intolerance and making inflammatory public statements by some leaders of political parties not only manifest in communal violence, hatred and spread of communal polarization in the country but also is an attack on the constitutionally guaranteed fundamental rights and faiths; this House urges upon the Government- (a) to take effective measures to deal with the incidents of communal violence and disturbance; (b) to take penal action against trouble-makers and persons making provocative statements, disturbing communal peace and harmony; and (c) to nurture and develop the feeling 7

of brotherhood and congenial atmosphere among various communities for harmonious development of all sections of the society in the country, irrespective of caste, creed, community or region."

Shri Mansukh L. “Having regard to the fact that:- (Admitted, Mandaviya (i) many State Governments secured fifth have already requested the Central place in the Government to allow use of regional draw of lot) language of the concerned States in judicial proceedings of the concerned High Courts; and (ii) due to rising literacy level, RTI activism and increasing influence of electronic/print media on our society, a large section of our society is taking more interest in judicial proceedings but currently the use of English language in judicial proceeding of High Courts is the main obstacle for them to understand the judicial verdicts as most of them are not well versed in English language;

this House urges upon the Central Government to allow use of regional language of concerned State in the judicial proceeding of the concerned High Court at the earliest possible." ______

Time limit for discussion of Private Members' Resolutions

Members are informed that the General Purposes Committee, in its meeting held on the 28 th April, 2008, has, inter alia , decided that the time limit of two hours for the discussion on a Private Member's Resolution prescribed in 8 the direction of the Chairman issued vide Rajya Sabha Bulletin Part- II dated the 2 nd May, 1997 be strictly adhered to.

In this context, it was also likewise recommended by the Committee that a Private Member's Resolution taken up on a day should be disposed of on the same day. ______

Members are informed that the election scheduled to be held on the 5th May, 2016 for the following bodies, as notified in Parliamentary Bulletin Part-II, dated 28 th April, 2016, Para Nos. 55414 and 55415 has been postponed to the next Session:

(i) The Court of the Aligarh Muslim University; and (ii) The Central Advisory Committee constituted under Section 3 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. 9

The date of election for the above bodies will be notified in the next Session. ______

“Refresher Course in IT skills” for Members of Rajya Sabha and their personal staff A Refresher Course in IT skills is being organized by the Rajya Sabha Secretariat, in coordination with the NIC, from 2nd to 6 th May 2016 in two sessions daily in Room No. FB 15, G-Block, Parliament Library Building, as per the details given below:- (i) Morning Session: from 10:30 A.M to 1:00 P.M - for the personal staff of Members; and (ii) Evening session: from 2:30 P.M. to 5:00 P.M - for the Members of Rajya Sabha. 2. Officers/Engineers from NIC will impart training on Basic Computer Applications and also familiarize the Members and their personal staff with features of the Rajya Sabha Website and other Government Websites and also 11 sort out operational/technical difficulties being faced by them in accessing the internet or any other computer related matters. 3. Members are requested to avail of this facility. 4. Members may also depute their personal staff for the morning training sessions. They are requested to issue the authorization letters to that effect to their personal staff. Personal staff who do not have entry passes may approach the PLB Reception with the authorization letters to facilitate their entry. In case of any difficulty, they may contact Training Cell, Room No. 228A, 2 nd Floor, Parliament House Annexe (Tel. 23034248). ______

No.55442 Library and Reference Unit, LARRDIS

Speaker’s Research Initiative (SRI) Members are reminded that a two days workshop under the auspices of the Speaker’s Research Initiative (SRI) will be held on 4 and 5 May, 2016 from 4 p.m. onwards on both the days in the BPST Main Lecture Hall, First Floor, Parliament Library Building (PLB) on the following subjects : (i) Drought and related agrarian issues; (ii) Drinking water management – Problems and issues; and (iii) Interlinking of rivers for water management.

The workshop will be chaired by Hon’ble Speaker, . Members may kindly see for information.
