Mestrovic This dissertation explores the systematic negligence of expressive functions in current United States Military System (USMS) practices. I draw from classical sociological theory and employ the Parsonian understanding of “expressive” versus “instrumental” social functions, to illustrate the U.S. military’s abandonment of procedures that tend to the emotional needs of the group and individual soldiers. I expand beyond Talcott Parsons’ understanding of the “symbolic/expressive” pattern variable, and engage this idea to discuss a variety of affective principles including leadership support, group cooperation, social cohesion, loyalty and trust, emotional stability, and reverence towards rituals. Subsequently, I wed these elaborations of pattern variables to principles which generally are coded as maternal and feminine. The main argument of this work is the following; social functions that typically are considered “feminine,” “motherly,” “emotional” are not characteristically valued in modern worldviews, although these functions are critically significant for the overall iii iv wellbeing of society. As a result, an overemphasis of the ideal types instrumental functions, “masculinity,” “efficiency,” and “rationality” monopolize today’s most influential social institutions, including the military. The deficiency of balance between expressive and instrumental functions results in various forms of deviance and anomie; including war crimes. iv v DEDICATION In Thanksgiving v vi ACKNOWLEDGEMENTS This manuscript has been a product of thanksgiving. Class matters, Williams argues, because “socially conscious progressives”1 need political allies to achieve progress with their agenda for work-family reform.2 Williams calls us not only to think about class and recognize it as a significant axis of stratification and (dis)advantage, but also to treat the working class with respect and dignity. Nikkel* See how few of the cases of the suspension of the habeas corpus law, have been worthy of that suspension. They have been either real treason, wherein the parties might as well have been charged at once, or sham plots, where it was shameful they should ever have been suspected. Yet for the few cases wherein the suspension of the habeas corpus has done real good, that operation is now become habitual and the minds of the nation almost prepared to live under its constant suspension.1 INTRODUCTION On a cold December morning in 2002, United States military personnel entered a small wire cell at Bagram Airfield, in the Parwan province of Afghan- istan. There, they found Dilawar, a 20-year-old Afghan taxi driver, hanging naked and dead from the ceiling.2 The air force medical examiner who per- formed Dilawar’s autopsy reported his legs had been beaten so many times the tissue was “falling apart” and “had basically been pulpified.”3 The medical examiner ruled his death a homicide, the result of an interrogation lasting four days as Dilawar stood naked, his arms shackled over his head while U.S. inter- rogators performed the “common peroneal strike,” a debilitating blow to the side of the leg above the knee.4 The U.S. military detained Dilawar because he * J.D. Photographs taken by soldiers in Abu Ghraib prison changed the war in Iraq and changed America’s image of itself. Yet, a central mystery remains. Did the notorious Abu Ghraib photographs constitute evidence of systematic abuse by the American military, or were they documenting the aberrant behavior of a few “bad apples”? INTRODUCTION The Center for Constitutional Rights (CCR) and the European Center for Constitutional and Human Rights (ECCHR) present this dossier containing key information regarding the role played by DONALD H. RUMSFELD, the former U.S. Secretary of Defense, in the torture and other cruel, inhuman, and degrading treatment of detainees held in U.S. custody in Guantánamo Bay, Cuba. An extensive investigation in 2008 by the U.S. Senate Committee on Armed Services into the treatment of detainees in U.S. custody at Guantánamo Bay concluded that The abuse of detainees in U.S. custody cannot simply be attributed to the actions of a “few bad apples” acting on their own. The fact is that senior officials in the United States government solicited information on how to use aggressive techniques, redefined the law to create the appearance of their legality, and authorized their use against detainees.1 The U.S Senate Committee on Armed Services concluded that torture was official Department of Defense (DoD) policy. This dossier sets out RUMSFELD’s individual responsibility for this policy, detailing the role RUMSFELD played in the torture of detainees captured in the “war on terror” and detained at Guantánamo Bay as well as other locations. It describes how RUMSFELD oversaw the introduction of and approved the use of abusive interrogation techniques.
