PROSECUTION MOTION FOR ADMISSION OF EVIDENCE PURSUANT TO RULE 92ter (GH-135)

I. OVERVIEW

1. The Prosecution requests that the Chamber admit the evidence of witness GH-135 pursuant to Rule 92ter of the Rules of Procedure and Evidence of the Tribunal (“Rules”). The evidence is probative, relevant and reliable and meets the requirements for admission under Rule 92ter. Granting this motion will enable the Prosecution to present its case-in- chief in an efficient and expeditious manner, without compromising the fairness of proceedings.

2. The Annex to this motion contains a table identifying and describing the proposed Rule 92ter evidence of GH-135 (“Rule 92ter package”). The table also sets out the revised summary of the evidence of GH-135 along with the counts and paragraphs in the Indictment to which her evidence pertains, and the estimated time for examination-in- chief of this witness. The material contained within the witness’s Rule 92ter package is available to the Trial Chamber on eCourt.

II. THE TRIAL CHAMBER SHOULD ADMIT THE EVIDENCE OF GH-135 PURSUANT TO RULE 92TER

3. The written evidence of GH-135 meets the requirements for admissibility under Rule 92ter.1 The witness will be present in court at trial, at which time she will attest to the accuracy of her written evidence and will be available for cross-examination by the Defence and questioning by the Judges.

4. The Prosecution will tender GH-135’s ICTY witness statement and associated exhibits.2 This written evidence is relevant and probative to issues in this case. From May 1992 to August 1993, the witness was deployed as Civilian Affairs Coordinator (“CAC”) of the United Nations Protection Force (“UNPROFOR”) for Sector East, which covered parts of the Serbian Autonomous Region (“SAO”) of Eastern Slavonia, Baranja and Western Srem (“SBWS”). The witness was herself based in Erdut and was responsible for facilitating the implementation of the Vance Plan, which involved monitoring the demilitarization of Sector East, coordinating the efforts of UN Civilian Police (“CIVPOL”), as well as local and Republic of Serbian Krajina (“RSK”) police across Sector East, monitoring local prosecution services, and managing the flow of refugees into and out of the sector.

5. The witness describes the policy of “Serbianisation” of the government of the RSK which included forcing non- out of Sector East, re-populating the areas with Serbs from elsewhere, and obstructing the resettlement of Croatian refugees. She describes her investigations into forced mobilisation of non-Serbs, as well as crimes including murders, beatings, forced labour and the destruction of religious buildings that occurred throughout Sector East at the hands of the local authorities, RSK and local police, territorial defence organisations, and paramilitary groups, including the Red Berets and Arkan’s Tigers. The witness brought these unlawful acts as well as the continued movement of armed paramilitaries in the sector (in violation of the Vance Plan) to the attention of RSK authorities, including Goran Had`i}, at regular and ad hoc meetings.

6. Further, the witness describes the mass graves in Sector East, especially at Lovas, Ernestinovo and Tordinici, and the assistance rendered to Dr. Snowe and the UN

Commission on Human Rights in investigating and requesting permission for the exhumation of bodies from the mass grave at Ov~ara. The witness also describes reports she received from UNCIVPOL and other organisations and reports prepared or transmitted by her to her superiors or other individuals.

7. The Prosecution will require approximately 75 minutes to conduct the examination-in-chief of GH-135. During this time, the Prosecution will ask GH-135 clarifying questions concerning her reports and investigations into mass graves as well as her efforts to impede the policy of expelling and victimizing non-Serbs. She will also discuss documents relevant to these matters.

8. The Prosecution also seeks to tender into evidence 74 associated exhibits on which GH-135 provides evidence in her proposed Rule 92ter statement, and therefore, form an integral and inseparable part of her written evidence. The Annex lists for each associated exhibit its Rule 65ter number, ERN, description, any applicable protective measures and where in the statement the exhibit is addressed by the witness.

III. REQUESTED RELIEF

9. For the foregoing reasons, the Prosecution respectfully requests that the Trial Chamber:

a) Admit the Rule 92ter statement and associated exhibits of GH-135 pursuant to Rules 89 and 92ter, subject to compliance with the conditions stipulated in Rule 92ter when the witness is present in court;

b) Allow the Prosecution to examine GH-135 for 75 minutes; and

c) Take note of the revised summary for GH-135.

Summary

In May 1992, the witness was assigned as the UNPROFOR Civil Affairs Coordinator in Sector East in . Sector East covered SBWS. The witness describes the role of UNPROFOR in Sector East and her responsibilities.

The witness describes that one of her roles was to facilitate the implementation of the Vance Plan and to monitor the demilitarization of Sector East. She was to ensure the Sector was safe enough to permit the return of refugees. The witness recounts that the demilitarization failed to occur and many groups, including Serbian paramilitaries, remained armed. The security situation in Sector East remained unstable during her tenure there.

The witness describes her interactions with RSK authorities, including HAD@I]. The witness personally met with HAD@I] in September 1992. She will describe that meeting and reports drafted by her and her assistant detailing that meeting.

The witness describes the RSK’s policy of “Serbinisation” to force non-Serbs out of Sector East and re-populate the areas with Serbs from BiH and elsewhere. She recounts that in July 1992 alone, 17,000 Serbs were brought into the Baranja region. The witness describes organized expulsions and the mistreatment of non-Serbs in Sector East. The RSK and judiciary were unwilling to investigate or prosecute crimes committed against non-Serbs. The witness also describes the widespread destruction of Catholic churches and other acts taken by the RSK’s policy to erase all signs of Catholicism in Sector East.

The witness describes the conduct of Serbian paramilitary groups in Sector East, including the Red Berets and ARKAN’s Tigers. She describes their crimes and their links to President Slobodan MILO[EVI] and other Serb authorities.

The witness describes the mass graves in Sector East. The witness assisted Dr. SNOWE and the UN Commission on Human Rights in investigating a mass grave at Ov~ara. She liaised with RSK authorities to request permission to exhume the site, but that permission was denied. She also visited mass grave sites at Lovas, Ernestinovo and Tordinici.
