Rol N° 33817 Tipo de revocación: Temprana Santiago, 2 de mayo de 2020 VISTOS: PRIMERO: Que, con fecha 24 de febrero de 2020 se creó el expediente por el arbitraje electrónico relativo al nombre de dominio “harpersbazaar.cl” inscrito por GLORIYA KONSTANTINOVA, cuyo contacto administrativo es Gloriya Konstantinova (email: [email protected]); y cuyo Revocante es HEARST COMMUNICATIONS, INC., representado por don Bernardo Serrano Spoerer, abogado, ambos domiciliados para estos efectos en calle Avda. Alonso de Córdova Nº 5151, piso 8, comuna de Las Condes, Santiago; SEGUNDO: Que, habiéndose abierto la etapa de tachas, éstas se presentaron en tiempo y forma por la parte Revocante; TERCERO: Que, mediante oficio Nº 202003021221-33817 de fecha 2 de marzo de 2020, el Centro de Resolución de Controversias de NIC Chile comunicó a la suscrita su designación como árbitro para resolver el conflicto suscitado por la presentación de la solicitud de revocación del nombre de dominio “harpersbazaar.cl”; CUARTO: Que, con fecha 2 de marzo de 2019 la suscrita aceptó el nombramiento como árbitro y juró desempeñar fielmente el cargo, con la debida diligencia y en el menor tiempo posible; QUINTO: Que, ninguna de las partes solicitó la inhabilidad de esta juez árbitro en el período señalado, el que de acuerdo al sistema de NIC Chile finalizó con fecha 10 de marzo de 2020; SEXTO: Que, con fecha 18 de marzo de 2020 se efectuó la consignación de los honorarios arbitrales por parte de HEARST COMMUNICATIONS, INC., la que realizó en tiempo y forma; SÉPTIMO: Que, por escrito de fecha 27 de marzo de 2020, HEARST COMMUNICATIONS, INC. presentó demanda de revocación de nombre de dominio, en los siguientes términos: ANTECEDENTES DE HECHO Y FUNDAMENTOS DE DERECHO • Que los nombres de dominio presentan en la actualidad gran relevancia en el comercio, pues constituyen una forma de identificar, promocionar, atraer y comercializar diversos productos y servicios ofrecidos a los usuarios-consumidores en un mercado virtual como Internet. Añade que los nombres de dominio son únicos y como tales pueden ser asignados sólo a un titular, por lo cual la presente asignación puede llevar a toda suerte de confusiones o errores a los usuarios de la red, quienes podrían erróneamente direccionarse o bien asumir algún tipo de conexión y/o relación comercial entre las partes. • Que tiene un interés preferente, de acuerdo a lo establecido en los puntos 18 y siguientes de la “Reglamentación para el Funcionamiento del Registro de Nombres de Dominio CL” de NIC-Chile. Ante la falta de una definición reglamentaria, recurre al significado natural y obvio de sus expresiones. De acuerdo a la Real Academia Española de la Lengua, la expresión “interés” significa “provecho, utilidad, ganancia”, y “preferente” significa quien “tiene preferencia o superioridad sobre algo”, revelando la combinación de ambas expresiones un aprovechamiento de tipo económico y, por ende, de preeminencia comercial. • Que el artículo 21 de la Ley Nº 19.880 que establece las bases sobre los procedimientos administrativos que rigen los actos de la administración del Estado define como “interesados” en un procedimiento administrativo: (1) quienes lo promueven como titulares de derechos o intereses individuales o colectivos; (2) los que sin haber iniciado el procedimiento, tengan derechos que puedan resultar afectados por la decisión que en el mismo se adopte. Añade que el titular del nombre 2 de dominio se encuentra sujeto a una condición resolutoria pendiente y por lo tanto, si bien el nombre de dominio ha ingresado a su patrimonio, ha sido de forma precaria, en virtud de lo prescrito en los artículos 1490 y 1491 del Código Civil. • Que las normas UDPR establecen la importancia del “interés preferente”, establecido a favor de quien se presenta al mercado con un derecho preexistente como es el registro de una marca comercial y es conocido en el comercio precisamente bajo dicho signo distintivo. • Que HEARST COMMUNICATIONS, INC. es una empresa multinacional estadounidense especializada en los medios de comunicación de masas, con sede en la Torre Hearst de Nueva York, Estados Unidos. Indica que fue fundada en 1887 por William Randolph Hearst, siendo la familia Hearst la dueña y administradora de la empresa. • Que HEARTS es una empresa líder en medios, información y servicios globales y diversificados con más de 360 negocios. Señala que sus principales intereses incluyen la propiedad de redes de televisión por cable como A&E, HISTORY, Lifetime y ESPN; el líder mundial de servicios financieros Fitch Group; Hearst Health, un grupo de empresas de información y servicios médicos; activos de transporte, incluido CAMP Systems International, un importante proveedor de soluciones de software como servicio para gestionar el mantenimiento de aviones y helicópteros; 33 estaciones de televisión como WCVB-TV en Boston y KCRA-TV en Sacramento (California), que suman un total de 19% de la población de los Estados Unidos; periódicos como el Houston Chronicle, San Francisco Chronicle y Times Union (Albany, Nueva York); más de 300 revistas de todo el mundo, incluidas Cosmopolitan, ELLE, Men's Health, Car and Driver y Harper’s Bazaar; y empresas de servicios digitales como iCrossing y KUBRA; e inversiones en empresas emergentes de entretenimiento digital como Complex Networks. • Que más información acerca de HEARST, puede encontrarse en su página web oficial: https://www.hearst.com/home. • Que la revista Harper’s Bazaar, es una revisa de moda fundada en 1867 en Estados Unidos. Indica que las páginas de esta revista han sido el hogar de varios temas como instrucciones simples sobre cómo atar un arco a piezas de ficción, trabajo y vida social. Añade que muchos escritores escribieron columnas a lo largo de los años como Charles Dickens, Alice Meynell, George Elliot, Henry James, Daisy Fellowes y Eleanor Hoyt Brainerd. • Que Harper's Bazaar era una revista semanal dirigida a mujeres de clase media y alta, siendo publicada en 32 países y regiones. Añade que para celebrar el 150 aniversario, los directores de la revista publicaron una antología ilustrada de 712 páginas llamada An American Album: Ciento cincuenta años de la revista Harper's. 3 • Que en Chile, se lanzó la primera edición local de Harper’s Bazaar en abril del año 2015. • Que la marca “HARPER’S BAZAAR” cuenta con un reconocimiento de larga data, no solo en el mundo, sino que también en nuestro país, convirtiéndola en una marca de gran reputación. • Que es titular en Chile, de las siguientes marcas comerciales que, precisamente, son idénticas – desde un punto de vista gráfico y fonético - al nombre de dominio HARPERSBAZAAR.CL que se está revocando: - Registro N°931.463 “HARPER’S BAZAAR” (denominativa) para “Diarios y revistas y publicaciones periódicas”, de la Clase 16. - Registro N°1.183.323 “HARPER’S BAZAAR” (denominativa) para “Aplicaciones de software descargable para teléfonos móviles, ordenadores Tablets y portátiles y dispositivos electrónicos portátiles digitales de mano, en concreto, software para acceder a contenido e información, para visualizarlos, interactuar con ellos y descargarlos, en relación con la moda, belleza, viajes, decoración del hogar, relaciones, productos de lujo, salud y ejercicios físicos, tecnología, carreras, noticias, artes y revistas electrónicas de cultura (descargables); publicaciones electrónicas (descargables)”, de la Clase 9; y “Servicios de esparcimiento, en concreto, servicios de esparcimiento provistos a través de sitios web que contienen presentaciones fotográficas, de audio, video y prosa con temas de moda, belleza, viajes, decoración del hogar, relaciones, productos de lujo, salud y ejercicios físicos, tecnología, carreras, noticias, artes y cultura; publicaciones electrónicas no descargables del tipo de publicaciones electrónicas con presentaciones fotográficas, de audio, video y prosa con temas de moda, belleza, viajes, decoración del hogar, relaciones, productos de lujo, salud y ejercicios físicos, tecnología, carreras, noticias, artes y cultura”, de la Clase 41. • Que la única diferencia existente entre el nombre de dominio en revocación HARPERSBAZAAR.CL y las marcas registradas “HARPER’S BAZAAR” es el uso de una apóstrofe en las marcas registradas entre las letras “R” y “S”, por lo cual discrepancia no puede ser considerada en el contexto de los nombres de dominios ya que las apóstrofes no son caracteres autorizados para la inscripción de un nombre de dominio. • Que debido a una falta de renovación desafortunada, el nombre de dominio HARPERSBAZAAR.CL fue tomado por la demandada. Señala que esta práctica de vigilancia o monitoreo constante a través de robots informáticos de nombres de dominios de marcas reputadas por parte de personas o empresas que se encuentran en el extranjero y su posterior puesta en venta no es nueva, incluso, la demandada Gloriya Konstantinova, o quien sea que esté detrás de ese nombre, utiliza esta práctica constantemente en nuestro país. 4 • Que basta con visitar la reconocida aplicación “WAYBACKMACHINE” alojada en la página web www.archive.org y consultar acerca de la actividad pasada con respecto al nombre de dominio HARPERSBAZAAR.CL. Añade que entre el 27 de septiembre de 2015 y el 18 de enero de 2019, todas las páginas web
