Witkowski Marquette University, 2010 What was the legal status of women in early colonial Maryland? This is the central question answered by this dissertation. Women, as exemplified through a series of case studies, understood the law and interacted with the nascent Maryland legal system. Each of the cases in the following chapters is slightly different. Each case examined in this dissertation illustrates how much independent legal agency women in the colony demonstrated. Throughout the seventeenth century, Maryland women appeared before the colony’s Provincial and county courts as witnesses, plaintiffs, defendants, and attorneys in criminal and civil trials. Women further entered their personal cattle marks, claimed land, and sued other colonists. This study asserts that they improved their social standing through these interactions with the courts. By exerting this much legal knowledge, they created an important place for themselves in Maryland society. Historians have begun to question the interpretation that Southern women were restricted to the home as housewives and mothers. -

Jazz and Radio in the United States: Mediation, Genre, and Patronage Aaron Joseph Johnson Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in the Graduate School of Arts and Sciences COLUMBIA UNIVERSITY 2014 © 2014 Aaron Joseph Johnson All rights reserved ABSTRACT Jazz and Radio in the United States: Mediation, Genre, and Patronage Aaron Joseph Johnson This dissertation is a study of jazz on American radio. The dissertation's meta-subjects are mediation, classification, and patronage in the presentation of music via distribution channels capable of reaching widespread audiences. The dissertation also addresses questions of race in the representation of jazz on radio. A central claim of the dissertation is that a given direction in jazz radio programming reflects the ideological, aesthetic, and political imperatives of a given broadcasting entity. I further argue that this ideological deployment of jazz can appear as conservative or progressive programming philosophies, and that these tendencies reflect discursive struggles over the identity of jazz. The first chapter, "Jazz on Noncommercial Radio," describes in some detail the current (circa 2013) taxonomy of American jazz radio. The remaining chapters are case studies of different aspects of jazz radio in the United States. Chapter 2, "Jazz is on the Left End of the Dial," presents considerable detail to the way the music is positioned on specific noncommercial stations. Chapter 3, "Duke Ellington and Radio," uses Ellington's multifaceted radio career (1925-1953) as radio bandleader, radio celebrity, and celebrity DJ to examine the medium's shifting relationship with jazz and black American creative ambition. -

The sport became increasingly popular in the late nineteenth century and the Edwardian period. This paper examines the arguments and methods used in different anti-otter hunting campaigns 1900-1939 by organisations such as the Humanitarian League, the League for the Prohibition of Cruel Sports and the National Association for the Abolition of Cruel Sports. Introduction In 2010 a painting ‘normally considered too upsetting for modern tastes’ which ‘while impressive’ was also ‘undeniably "gruesome"’ was displayed at an exhibition of British sporting art at the Bowes Museum, Barnard Castle. The Guardian reported that the grisly content of the painting was ‘the reason why it was taken off permanent display by its owners’ the Laing Gallery in Newcastle.1 The painting, Sir Edwin Landseer’s The Otter Speared, Portrait of the Earl of Aberdeen's Otterhounds, or the Otter Hunt had been associated with controversy since it was first exhibited at the Royal Academy in 1844 Daniel Allen, Charles Watkins and David Matless 2 (Figure 1). -

Free Exercise in the Free State: Maryland's Role in Religious Liberty and the First Amendment KENNETH LASSON Perhaps it is both inevitable and appropriate that the bicen tennial of the Bill of Rights has generated a new and lively de bate over the scope and meaning of the First Amendment to the United States Constitution. Parameters of free speech, press, and assembly are frequently drawn, challenged, and recast. Few issues are argued more keenly than those involving reli gion: the constitutionality of creches on Christmas, school prayer, Sunday closing laws-even the propriety of having a preacher for president. The Supreme Court's docket is liberally sprinkled with petitions calling for renewed interpretation of the religion clauses. -

The White Slave Trade and the Yellow Peril: Anti-Chinese Rhetoric and Women’s Moral Authority A thesis submitted to the Department of History, Miami University, in partial fulfillment of the Requirements for Honors in History by Hannah E. Zmuda May 2021 Oxford, Ohio Abstract Despite the mid-to-late nineteenth and early twentieth century’s cultural preoccupation with white women’s sexual vulnerability, another phenomenon managed to take hold of public consciousness: “yellow slavery.” Yellow slavery was the variation of white slavery (known today as sex trafficking) that described the practice when Asian women were the victims. This thesis attempts to determine several of the reasons why Chinese women were included as victims in an otherwise exclusively white victim pool. One of the central reasons was the actual existence of the practice, which this thesis attempts to verify through the critical examination of found contracts and testimony of Chinese women. However, beyond just the existence of the practice of yellow slavery, many individuals used the sexual exploitation of Chinese women for their own cultural, religious, and political ends. Anti-Chinese agitators leveraged the image of the Chinese slave girl to frame anti-Chinese efforts as anti-slavery efforts, as well as to depict Chinese immigrants as incapable of assimilating into American culture and adhering to American ideals of freedom. Additionally, white missionaries created mission homes to shelter and protect the Chinese women and girls escaping white slavery. However, within these homes, the missionaries were then able to push their perceived cultural and religious superiority by pushing the home’s inmates into their ideals of Protestant, middle-class, white womanhood. -

Maryland Designe: The First Wall Between Church and State Courtesy the of Enoch Pratt Free Library By Thomas Penfield Jackson The Occasional Papers of The Center for the Study of Democracy Volume 3, Number 1, Fall 2008 The Center for the Study of Democracy: A Better Understanding of Maryland and the World Although we often focus on contemporary issues associated with democracy and liberty, the Center for the Study of Democracy was originally inspired by the historical importance of St. Mary’s City and the discussion of innovative 17th-century ideas about politics that helped establish effective civil government in the Maryland colony. This occasional paper brings us back to our 17th-century roots. Among the most important principles of civil government instituted at St. Mary’s City is ‘freedom of conscience’—a principle that remains in practice today and one that continues to act as the bedrock for many other core democratic values in the United States. This principle not only provides support for democratic liberties concerning freedom of speech and freedom of the press, but also directly supports the legal notion of separation of church and state. In the early years of Maryland’s founding, colonists, through the Assembly of Maryland, officially separated religion from civil government by passing An Act Concerning Religion. This act, as Judge Thomas Penfield Jackson points out “…represented the first time in the English-speaking world that government formally renounced by legislative enactment the right to dictate to its citizens what they must believe or how they must evince it.” It allowed settlers of different Christian faiths to vote and hold public office without a religious test and it remains a foundational civil liberty in the United States today; citizens of all faiths are entitled to freely participate in our democracy, irrespective of religious beliefs.
