Betts lthough downtown revitalization, innovative mixed-income redevelop- ment, and gentrification are reinvigorating deteriorated inner-city A neighborhoods in cities across the country, too little attention is paid to declining middle-income neighborhoods such as Hickory Hill in Memphis, Tennessee.1 In the absence of interest from either urban pioneers or targeted government programs, these neighborhoods continue to decline, and poverty enclaves are recreated within once middle-class housing markets. The signifi- cance of declining middle-class neighborhoods is underscored by a comparison of 1970 and 2000 census data, where the percentage of middle-income neigh- borhoods among all neighborhoods in metropolitan areas declined from 58% to 41%.2 Urban policymakers often have neither a fundamental understanding of what is happening in these housing markets nor a strategy to advance them. The Memphis Neighborhood Housing Markets Modeling project (the Memphis Model) is addressing this information gap using Hickory Hill, a destabilizing community southeast of downtown Memphis, as a pilot community. Ropiequet* Over its forty-two year history in The Business Lawyer, the Annual Survey on Consumer Financial Services Law, written by numerous members of the Consumer Financial Services Committee, has chronicled the developments in an ever-changing area of law that deals with the regulation of credit products for personal, family, and household purposes. From the enactment of the Truth in Lending Act in 1974 to the enactment of the Dodd- Frank Wall Street Reform and Consumer Financial Protection Act in 2010 to the present, the alphabet soup of new federal statutes and their alphabetized federal regulations has created an astonishingly complex legal structure that has in turn led to the establishment of an army of compliance lawyers and litigators who are devoted to dealing with it. This article describes what the Annual Survey has done to keep the profession abreast of the twists and turns in this fascinating field during several different eras that reflect larger eco- nomic developments like the go-go eighties and the housing foreclosure crisis that followed it, and the congressional reactions to perceived abuses.     Board of Governors of the Federal Reserve System Report to the Congress Rules on Home-Equity Credit under the Truth in Lending Act November 1996 FEDERAL RESERVE BOARD STUDY ON RULES ON HOME-EQUITY CREDIT UNDER THE TRUTH IN LENDING ACT INTRODUCTION The Truth in Lending Act requires lenders to give extensive disclosures when homeowners apply for home-secured credit. Different rules govern depending on whether a lender offers an open-end line of credit or the more traditional closed-end second-mortgage loan.1 In addition, substantive rules establish certain consumer rights. For example, homeowners have the right to cancel a transaction within three business days when the credit is secured by their principal dwelling. In 1994, the Congress amended the Truth in Lending Act to require additional disclosures for closed-end home-equity loans in which the borrower is paying rates and fees above a certain percentage or amount. The Home Ownership and Equity Protection Act (HOEPA) amendments were contained in the Riegle Community Development and Regulatory Improvement Act (RCDRIA) and became effective in October 1995. Under the HOEPA, the rules did not change for open-end home-equity lines of credit, as the congressional hearings that led to enactment of the new rules did not reveal evidence of abusive practices connected with open-end home-equity lending. Instead, the Congress directed the Federal Reserve Board to conduct a study and submit a report on whether the existing Truth in Lending rules provide adequate protections for consumers obtaining home- equity lines of credit. In addition, the Congress directed the Board to address whether a more appropriate interest-rate index should be used in determining the applicability of the HOEPA.
