    Establishing 15 IP Tribunals Nationwide, Chinese Courts Further Concentrate Jurisdiction Over IP Matters March 15, 2018 Patent and ITC Litigation China has continued to develop its adjudicatory framework for intellectual property disputes with the establishment of three Intellectual Property Tribunals (“IP Tribunals”) this month. This reform began with the establishment of three specialized IP Courts in Beijing, Shanghai, and Guangzhou at the end of 2014, and has been furthered with the establishment of IP Tribunals in 10 provinces and two cities/municipalities around the country. For companies facing an IP dispute in China, understanding this framework in order to select the appropriate jurisdiction for a case can have a significant impact on the time to resolution, as well as the ultimate merits of the case. Most significantly, through the establishment of these IP Tribunals many Chinese courts have been stripped of their jurisdiction over IP matters in favor of the IP Tribunals. This has led to a fundamental change to the forum selection strategies of both multinational and Chinese companies. The three IP Tribunals established on the first two days of March 2018 are located in Tianjin Municipality, and cities of Changsha and Zhengzhou respectively. This brings the number of IP Tribunals that have been set up across 10 provinces and two cities/municipalities in China since January 2017 to a total of 15. The most unique aspect of the specialized IP Tribunals is that they have cross-regional1 and exclusive jurisdiction over IP matters in significant first-instance2 cases (i.e., those generally including disputes involving patents, new varieties of plants, integrated circuit layout and design, technical-related trade secrets, software, the recognition of well-known trademarks, and other IP cases in which the damages sought exceed a certain amount)3.

    Rugao and Water Garden in Seventeenth Century China Yingzhi Zhao, The City University of Hong Kong, Hong Kong The IAFOR International Conference on the City 2016 Official Conference Proceedings Abstract My paper focuses on Rugao, a city on the northern bank of the Yangtze River, during the fall of the Ming dynasty and the consolidation of Qing rule in the mid and late seventeenth century. The unique status of Rugao was due to its location in one of the most prosperous and cultivated areas of China, as well as the area that suffered greatly in the war and violence during the dynastic transition. It also had the reputation of a literary city, thanks to a local writer Mao Xiao (1611-1693) and his estate, the Water Garden. Mao’s estate became ruins after the conquest, but it was a heaven for Mao and his politically marginalized friends, as the old sites on the ruins symbolized their aesthetics and sensibility. One such site was the Tree-Nest, a pavilion, built on an old tree beside a river. The Tree-Nest showed Mao’s attempt to emulate the ancients’ simple life, but it was also in tune with the Ming literati’s interest in strangeness and artfulness. Only when the pavilion collapsed and the tree alone was left after the conquest did the Tree-Nest recover its original significance and invite Mao and his friends to contemplate what it meant to live on a tree while no place was left for them in the world. By examining how the estate obtained new meanings, I will explore how the city survived the destruction, how destruction led to reconstruction, and how the literati culture of the Ming was commemorated.

The purpose of this study is to develop a framework to assess the change of urban-rural construction land and build a decision-support system for consolidating these lands. Four sub-layers were first built in the assessment framework, including the characteristic layer, the coordination layer, the potential layer and the urgency layer. Each layer encompassed specific indices for evaluating the change of urban-rural construction land in different aspects. The entropy method was then applied to the data resources from Landsat TM (Thematic Mapper) images, statistical data and overall land-use and land consolidation planning of Nantong city in coastal China to allocate weightings to the indices in each sub-layer.
