ENGINEERING DEPARTMENT CHANDIGARH ADMINISTRATION TRANSFER OF EMPLOYEES TO MC, CHANDIGARH OPTION NOTICE URGENT/IMPORTANT In compliance with the judgment/order(s) dated 24.2.2006 and 30.03.2007 of the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, regarding transfer of Chandigarh Administration employees to the Municipal Corporation, Chandigarh, four opportunities have already been given to the surplus employees through option notices published in various newspapers. As per the options exercised, the list of surplus employees were drawn up. Some of the employees who had been rendered surplus filed Original Applications in the Central Administrative Tribunal, Chandigarh Bench, Chandigarh challenging the manner in which they had been held to be surplus. These Original Applications were last heard by the Hon’ble Central Administrative Tribunal, Chandigarh on 31.03.2008 when Sh. Anupam Gupta, Senior Standing Counsel of the Chandigarh Administration apprised the Hon’ble Bench that the Chandigarh Administration is very keen that there should be no retrenchment as a result of bifurcation between the Chandigarh Administration and the Municipal Corporation. The Hon’ble Bench was informed that while 536 employees belonging to different categories have been found to be surplus and are liable to be retrenched, 428 posts are still vacant in the Municipal Corporation and that accordingly, the Administration wishes to give another opportunity to the surplus employees to opt for transfer to the Municipal Corporation. Now, therefore, the Chandigarh Administration requests all individual employees as well as Employees’ Unions to appreciate the urgency and gravity of the situation. Repeated option notices in the past have failed to draw the desired response and have resulted in a stalemate. If the response continues to be lukewarm, the Administration will have no choice but to wield the axe of retrenchment. As stated by the Administration before the Hon’ble CAT, this is something that Administration would like to avoid. It would be pre-eminently in the interest of the employees themselves to avert what would otherwise become inevitable. The Administration appeals to the Employees’ Unions, in particular, to consciously and actively mobilize the employees to respond to this option notice in order to protect their own careers. The Chandigarh Administration would also like to use this opportunity to allay the apprehensions of the employees regarding payment of pensionary benefits after transfer to the MC. It is informed that the Government of India, Ministry of Home Affairs vide Notification No. G.S.R.-392 dated 10th November, 2005, has amended the Conditions of Service of Union Territory of Chandigarh Employees Rules, 1992, by adding the following proviso to Rule-2: “Provided further that all charges on account of retirement benefits such as pension, gratuity, provident fund etc. to the employees transferred from the Administration of Chandigarh to the Municipal Corporation of Chandigarh by virtue of clause (h) of sub section (2) of Section 428 A of the Punjab Municipal Corporation Law (Extension to Chandigarh) Act, 1994 as may be applicable for the period the transferred employees served in the Corporation would be borne by the Administration of Chandigarh”. In view of the above, it is clarified that the Chandigarh Administration would bear the financial liability of pensionary benefits of employees transferred to the Municipal Corporation and the dues shall be released/paid by the Municipal Corporation accordingly. The following employees who have been found surplus in the respective categories are hereby given one more opportunity to opt for their transfer to the Municipal Corporation, Chandigarh in their own interest or to face retrenchment.
