The Development Control Manager drew Members’ attention to the Update Report. A statement had been received from Pluckley Parish Council which was contained in the Update Report and read out in full.

In accordance with Procedure Rule 9.3 Ms Przyjemski, the agent, spoke in support of the application. She advised that the proposal was to enable the long term use of the site for equestrian use. The proposal included the removal of the two buildings situated nearest the road which would minimise the impact of the site on the surrounding area, and additional trees were to be planted which would also help to alleviate the impact of the site from the road. The applicant found the Section 106 agreement to be acceptable and she hoped that the Committee would allow the application.

One of the Ward Members attended and spoke on the application.

The Development Control Manager drew Members’ attention to the Update Report. There were several points to take note of: three letters of support from local residents had been received. There were revisions to part of the recommendation as detailed in the Update Report, these were read out in full.

In accordance with Procedure Rule 9.3 Mr Ford, the agent, spoke in support of the application. He advised that he had been involved in the negotiations surrounding the listed barn and the application before Members. The process had been one of realisation and compromise and had shown real commitment from the applicant. The applicant wanted to retain the listed barn and was willing to enter into a unilateral agreement which would help to guarantee the retention of the barn and reasonable access to it for local interest. English Heritage had advised that they did not support an intensive use of the barn and so it was hoped that the Committee would find in favour of the application. Whilst the application was only for outline permission it should be noted that care would be taken with materials and should the application be permitted then the application for the residential conversion of the barn would be withdrawn.

One of the Ward Members attended and spoke in support of the application.

Resolved:

A) That for the following reasons the Planning Committee permit this application:

1. The site is located in a rural area where new dwellings are not normally permitted. The benefits of securing the restoration, long term maintenance and future public and community access to the grade II* barn at Court Lodge is a material planning consideration that outweighs the harm to the local environment caused by the new dwelling and is sufficient to outweigh the requirements of the development plan

2. The dwelling will not adversely affect the residential amenities of adjoining residents significantly.

3. Any potential impacts on the countryside or neighbours can be satisfactorily mitigated by careful siting of the proposed dwelling and the imposition of appropriate conditions.

4. The development makes adequate provision for parking of vehicles within the application site.

5. Adequate sight lines can be provided at the access.

B) Subject to an agreement being reached on the definition of ‘suitable local and community uses’, and subject to the applicant entering into a unilateral undertaking acceptable to the Development Control Manager and the Head of Legal and Democratic Services in relation to the matters mentioned in the report in respect of Court Lodge Barn, the application site and land adjoining the application site

C) Permit

Subject to the following conditions:

1. Approval of the details of the access, scale, landscaping, layout and appearance (hereafter called "the Reserved Matters") shall be obtained from the Local Planning Authority in writing before development commences and the development shall be carried out as approved.

Reason: To comply with the provisions of Article 3 of the Town and Country Planning (General Development Procedure) Order 1995 and Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

2. (a) Application for approval of the Reserved Matters shall be made to the Local Planning Authority not later than the expiration of 3 years from the date of this permission.

(b) The development hereby permitted shall be begun either not later than 3 years from the date of this permission or before the expiration of 2 years from the date of approval of the last of the Reserved Matters to be approved, whichever is the later.

Reason: To comply with the provisions of Article 3 of the Town and Country Planning (General Development Procedure) Order 1995 and Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

3. Details of motor vehicle parking facilities shall be provided with details submitted under condition 01 and shall be provided before the development to which they relate is brought into use and they shall thereafter be retained available for ancillary parking of motor vehicles and access to the facilities shall not be precluded.

Reason: To ensure the provision and retention of adequate off-street parking facilities for vehicles in the interests of highway safety.

4. No development shall take place until full details of both hard and soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. The works shall be carried out prior to the occupation of the dwelling or in accordance with the programme agreed with the Local Planning Authority; and any trees or plants whether new or retained which within a period of 5 years from completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

Reason: In order to protect and enhance the amenity of the area.

5. All hard and soft landscape work shall be carried out in accordance with the approved details. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any other Order or any subsequent Order revoking or re-enacting that Order, no further development whether or not permitted by Article 3 and Schedule 2 Part 1 classes A, B, C and, E of that Order shall be carried out without the prior permission of the Local Planning Authority in writing.

Reason: In the interests of the visual amenity of the area.

In accordance with Procedure Rule 9.3 Ms Dawson, on behalf of the applicant, spoke in support of the application. She handed Members photographs of the application site, which showed the improvements that the Sulovari family had made to the site since it had been in their ownership. A petition supporting the application which contained 385 signatures had been received by the Council. With the installation of 11 CCTV cameras the Sulovari family had helped to make the area safer and more secure than previously. The proposed opening hours were to coincide with the opening hours of the shop. The family were happy to comply with the conditions set out in the report and should it be deemed necessary they felt it would be reasonable to accept a condition that limited the permission to the family.

The Ward Member attended and spoke in support of the application.

• Amended plans had been received – the additions/deletions were detailed in full and summarised to the Committee. • An additional representation had been received from Kent Highway Services – this was detailed in full along with responses from the Joint Development Control Managers. • A revised recommendation A was proposed and read out in full to the Committee. • There was also an additional informative in respect of the comments from Kent Highway Services.

Resolved:

A) That for the reasons set out in (B) below and subject to the conditions identified in (C) below, the Planning Committee approve the Reserved Matters application subject to;-

(i) the Environment Agency withdrawing its objection, and,

(ii) satisfactory resolution of the Housing Manager’s requests in relation to minor alterations to the provision of affordable housing, and,

(iii) checking that the amended details received deal satisfactorily with any outstanding matters related to parking provision and layout, design approach and associated materials in the public realm (outside of those matters of technical detail most appropriately dealt with at s.38

B) That for the following reasons the details be approved subject to conditions identified in (C) below:-

1. The development would respect the context of the site.

2. The scale, location and design of the development would preserve the context of the site and preserve the visual amenities of the locality.

3. The development would not be harmful to the residential amenities of nearby dwellings.

4. The site is within the defined limits to the East Stour village development at Cheeseman’s Green and the principle of the proposed development proceeding has therefore been accepted.

5. The spatial distribution of the proposed uses of land is acceptable.

6. The traffic movement generated by the development could be accommodated without detriment to highway safety through the hierarchy of streets proposed within the East Stour Village development and through the proposed access arrangements from the A2070.

7. Parking provision is acceptable.

8. The proposal generally accords with the provisions of the adopted South of Ashford Cheeseman’s Green Development Brief (February 2003) and the development plan and in instances where it varies the approach proposed is considered acceptable in planning terms.

C) Approve Reserved Matters details:-

Subject to the following conditions:

1. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1195 or any other Order or any subsequent Order revoking or re-enacting that Order, the approved car barns shall be provided in accordance with the detailing shown on the approved plans and shall not be further altered through the addition of lockable entrance doors without the prior permission of the Local Planning Authority in writing.

Reason: To ensure that the enclosed space is retained available for the storage of a vehicle when not in use in order to prevent the displacement of car parking and inappropriate car parking.

2. Unless otherwise agreed in writing by the Local Planning Authority a bat or bird nest box shall be installed on every dwelling (to a 50:50 ratio) prior to first occupation to a specification and in locations that have previously been agreed in writing by the Local Planning Authority.

Reason: To sustain and enhance biodiversity.

3. Upon confirmation being given by either the Local Planning Authority or Kent County Council that a bus service will be brought into operation along Distributor Road ‘A’ via the non-signalised junction between the Principal Access Road and Distributor Road ‘A’, the temporary bus stop shown on Drawing No. 3653/RM/003 (or any subsequent revision thereto agreed in writing by the Local Planning Authority) shall then be provided in accordance with a timescale to be agreed in writing with the Local Planning Authority.

Reason: To ensure that patronage of bus services being brought into operation is maximised through the presence of sheltered waiting facilities.

4. Prior to the commencement of any works that may affect dormice or their breeding sites or resting places, a detailed mitigation strategy shall be submitted to and approved in writing by the Local Planning Authority. All works shall then proceed in accordance with the approved strategy unless any variations have been agreed in writing by the Local Planning Authority.

Reason: In order to ensure dormice are adequately protected.

5. Prior to the commencement of any works which may affect reptiles or their habitat, a detailed mitigation strategy shall be submitted to and approved in writing by the Local Planning Authority. All works shall then proceed in accordance with the approved strategy unless any variations have been agreed in writing by the Local Planning Authority.

Reason: In order to ensure dormice are adequately protected.

6. The fine detail of the central space to the non-signalised junction involving the Principal Access Road and Distributor Road ‘A’ in terms of planting, materials, any structures or public art to be erected shall be submitted to and approved by the Local Planning Authority in writing prior to the junction being brought into use.

Reason: In order to ensure that fine detail is appropriate.

7. Prior to usage in any dwelling, full details of proposed external bricks/tiles and cladding materials (including samples) shall have been submitted to and approved by the Local Planning Authority in writing and thereafter only those approved external materials shall be used in the construction of the development.

Reason: In the interests of visual amenity.

8. Prior to usage in any building to be constructed, the following details (at a scale of 1:20 or 1:50 as may be appropriate) shall have been submitted to and approved by the Local Planning Authority in writing and no further additions shall be made without subsequent further approval by the Local Planning Authority:-

i all eaves treatments, including an eaves enhancement strategy for the north-south car free street linking Distributor Road ‘A’ with the crescent,

ii. windows and doors (including depth of reveals within openings) and other external joinery,

iii. any dormer windows,

iv. porch canopies (including materials and finish colour),

v. external extracts/vents/terminals (including any proposed venting to roofs) and details of final finish colour,

vi. the form and location of external meter boxes (including visual screening by landscaping),

vii. rain water goods down-pipes and final finish colour,

viii. any other external fittings to dwellings (including aerials, dishes and amenity lighting),

ix. brick boundary wall pier and coping details, and,

x. any roof balcony railings and details of ‘Juliet’ and other external balconies

Reason: In the interests of visual amenity.

9. Prior to the occupation of each dwelling a rainwater butt shall be provided and connected to a rainwater downpipe on each property. The rainwater butts and connections shall thereafter be retained.

Reason: To allow for the storage of rainwater on site and thereby reduce the demand for mains water on site.

10. No doors shall be affixed to the front elevation of any of the car barns hereby approved without the prior written consent of the Local Planning Authority.

Reason: To ensure that the car barns remain available for use as such and are not used for secure household storage.

Notes to Applicant

1. This approval discharges conditions 2, 5, 6, 17, 22 and 27 attached to outline planning permission reference 02/00278/AS insofar as details of the proposed development for the land parcel concerned are required to be submitted to and approved by the Local Planning Authority. Any variation to the approved details will, however, need to be submitted for further approval before the relevant work is carried out.

2. The applicant is reminded of the outstanding requirement for details to be submitted and approve under conditions of outline planning permission 02/00278/AS as well as the continuing obligations imposed by some conditions as the development progresses and is completed.

The Strategic Sites and Design Manager advised that an announcement had been made in respect of the preferred route for Junction 10A of the M20 and advised that this would involve the removal of Wyevale Garden Centre from its premises in . She then drew Members’ attention to the Update Report. There were several points to take note of, including:

• A letter and email had been received from Kent County Councillor Mrs E Tweed, objecting to the application – these were detailed in full in the Update Report. • Additions and amendments to the recommendation were detailed in full in the Update Report. • Comments had been received from the Environmental Health Officer (Health and Safety) and Kent Highway Services - these were detailed in full in the Update Report.

In accordance with Procedure Rule 9.3 Ms Lidington, a development consultant representing an objector and local residents, spoke in objection to the application. She advised that she was representing Bybrook Barn Garden Centre and local residents in objecting to the application. The application was controversial and there had been over 1300 objections to the scheme. Bybrook Barn had objected due to the close proximity of the proposed scheme and had a number of concerns including the impact on the businesses at Bybrook Barn. National Planning Guidance contained within PPS4 stated that impact on local employment was an important issue to be considered. It was a great concern that should the scheme be permitted then it could result in a loss of jobs elsewhere. Bybrook Barn had a lot to offer and had a wealth of 873 P310310 ______

support although it would be short-sighted for them to rely upon its established customer base and there was a need to attract new customers which the proposal before the Committee had the potential to threaten.

In accordance with Procedure Rule 9.3 Mr Wright, on behalf of the applicant, spoke in support of the application. He advised that he was a Director of Dobbies and hoped to outline the ambitions of the company and put to rest many of the misconceptions surrounding the application. Ashford was an ambitious town with a growing population and it was hoped that the company would grow with the town. Dobbies was a 145-year-old company which had been owned by Tesco for the last two years, however Dobbies was still run by its own board. The application was for a garden centre and they were happy to accept conditions on the permission should it be granted. They would sell farm food in a small section of the store, 350sq m which amounted to only 3.5% of the total area of the proposal. Dobbies were inspired to educate and entertain their customer base and worked closely with schools to provide nature-based projects for their pupils. In conclusion Mr Wright advised that Dobbies were aiming to enhance customer choice and knowledge.

The Ward Member and Portfolio Holder for Development, Partnerships and Personnel both attended and spoke in objection to the application.

Resolved:

1. Deferred to allow time for Officers to prepare a report back to the Planning Committee with considered and detailed reasons for refusal of permission, in the light of Members’ views.

2. That the Planning Committee is Minded to Refuse the application for the following reasons:-

(i) The proposal is contrary to the provisions of the Development Plan which allocate the site for B1 employment use, and the applicants have not demonstrated sufficient material considerations to justify setting aside the Development Plan.

(ii) The proposed development would have an unacceptable impact on the highway network in terms of congestion.

(iii) There is no over-riding reason why a garden centre operation needs to be located on this site adjoining leisure uses.

In accordance with Procedure Rule 9.3 Mr Bennett, the applicant, spoke in support of the application. He advised Members that the issue was whether the site was within the confines of the village. The site was located next to a large property and The Old Dairy and was within the confines of the village. Appledore Parish Council had given their full support to the scheme. He concluded by saying that the village had lost one of its public houses and he hoped that the proposal would benefit the village.

In accordance with Procedure Rule 9.3 Mr Winter of Appledore Parish Council, spoke in support of the application. He advised that he was the Vice-Chairman of Appledore Parish Council and was representing the Parish Council to confirm their support for the proposal. He gave a detailed explanation of the location of the site. It was felt that the proposal was within the established building area of the site. He concluded by saying that Appledore Parish Council considered that the application should be permitted.
