The report was managed by Efraim Jimenez, Lead Procurement Specialist acting as Country Procurement Specialist in Brazil. The report is the work of a World Bank (WB) team consisting of Bernard Becq, Lucian0 Wuerzius, Alexandre Borges de Oliveira, Anemarie Proite, Tiinia Lettieri and Andre L. Ramalho, Consultant. Mr. Jose August0 Carvalho and Mr. Jose Baigorria Pera, Consultant, provided useful comments to the report. Meetings with the consulting industry in Rio de Janeiro were organized and executed by a Professional Association on Consulting Services (ABCE) team managed by Mr. Helio Amorin. The CPAR is intended to contribute to a dialogue with the government on its procurement policy and management agenda by surveying the existing situation, assessing the situation in light of appropriate standards, indicating a meaningful array of issues that could be incorporated into the government’s agenda, and examining the desirability and workability of practices that would address those issues. Through the CPAR, the World Bank (WB) is capable of making this contribution due to its long-standing engagement with the country’s public management policies, including those related to procurement, and to its knowledge of worldwide government practices in this area of public management. Therefore, this report represents an effort by the WB to seek further ways to support the reform and modernization ofgovernment procurement in Brazil. Consequently, two main audiences will benefit from this report: (i) the Government of Brazil, which may wish to marshal its program of modernization of the government’s procurement by taking the findings presented in this report into account and (ii)the staff of the WB assigned to Brazil. Such findings are based on interviews carried out with representatives from about 50 public agencies of the Federal Government, close cooperation with local counterparts, and workshops with key stakeholders. The next section presents a summary of the main findings, including an assessment of key aspects that characterize federal government procurement. Additionally, it also signals the aspects of the national law or regulations to which exceptions should be made in the individual loan agreements

Additionally, and especially, it looks at their daily work to instill the value of education, as well as practices and commitments between generations of mothers and children with the aim of preparing children with the aim of preparing the new generations to reach a higher level of human development, greater autonomy and increased well- being in their future trajectories. The qualitative methodology was applied: sixteen interviews with beneficiary mothers of social policies in the Metropolitan Region of Salvador, and results were explored with the method of Speech Analysis. Results show that mothers from poor families who receive the benefits of social policies are inter- generationally involved with their commitments. Mothers were even returning to schools, both for personal fulfillment and to give their children an example of the high value that they give to education.

    Pro Bono Practices and Opportunities in Brazil INTRODUCTION Brazil is Latin America’s largest country and arguably the region’s leading economy, home to a vibrant and developed legal community. Despite these and its many other positive attributes, it is also a country suffering from widespread inequality. While this combination would appear to present meaningful opportunities for the provision of pro bono legal services, the Brazilian legal community does not have a long-standing tradition of providing such services. The Brazilian Federal Constitution (the “Constitution”) sets forth as fundamental rights the right to access to justice and the right to free legal assistance, but in practice such fundamental rights are not yet fully accessible for a significant part of the population. Pro bono work could help provide assistance where State-funded legal aid is not available, but regulatory restrictions that were in force until recently have significantly hindered the development of pro bono work in the country. However, there have been important changes in the last few years, with gradual but clear signs of evolution in terms of regulation and the mentality of the legal community in general. Law practitioners in Brazil have been devoting increasing resources to pro bono activities and pro bono services are expected to increase in the future.     ANALYSIS OF THE LEGAL COOPERATIVE FRAMEWORK Within the ICA-EU Alliance NATIONAL REPORT for BRAZIL I. Introduction This report was produced within the Cooperative Structure Legal Analysis investigation initiated by the International Cooperative Alliance (ICA) and its regional offices. The research is carried out within the framework of an alliance between the European Union and ICA for the period 2016-2020, the main objective being to strengthen the cooperative movement and its ability to promote international development. The analysis of the legal framework seeks to improve knowledge and evaluation of cooperative law, with the aim of ensuring that legal regulations recognize the specificities of the cooperative model and the level playing field when compared with other forms of association. Similarly, this analysis will be useful to ICA members as advocacy material and recommendations on the establishment or enhancement of legal frameworks, to document the implementation of cooperation laws and policies, and to monitor their development. According to the objectives set by the ICA-EU Project, this report aims to provide a general understanding of Brazilian cooperative law and an assessment of the degree of its ability to foster the development of cooperatives. Similarly, recommendations to improve the law have been formulated to overcome some difficulties that cooperatives currently face. Often, in the discussion of agrarian reform, this aspect has been ignored by the non-communist writer or adviser: perhaps, it is supposed that there shall appear in a particular country liberal elements who will legislate the necessary reforms without pressure from the appropriate class, but this has not been the case in the under- developed countries, nor, for that matter, in the economical- ly developed nations.

    Qua Patet Orbis Roman Dutch Law in Dutch Brazil (1630–1654) Paul Russell & Reinier Russell * 1. Introduction “As far as the world extends” was the motto of Johan Maurits van Nassau- Siegen. It was an appropriate maxim for the German Renaissance Count who was not only the Governor General of Dutch Brazil but also governed Cleves on behalf of the Elector of Brandenburg and built the Mauritshuis, his magnificent residence in The Hague.1 “As far as the world extends” also applies to the influence of the Roman Dutch Law that today is still of relevance for the legal systems of for instance South Africa, Sri Lanka and Guyana.2 All these territories were, for some time, ruled by Dutch trading companies that turned to the Roman Dutch Law as a source of law for the administration of justice. As both an author and supervisor, Eltjo Schrage has paid due attention to the legal systems in these countries.3 * The authors are lawyers at Russell Advocaten in Amsterdam. Besides, mr. drs. R.W.L.
