The Work Session was called to order at approximately 5:00 p.m. on Thursday, April 8, 2021 at the St. Peters Justice Center located at 1020 Grand Teton Drive. Patty Smith, City Clerk, called the roll. The following were present: Mayor Pagano; Board President Reitmeyer; Alderman Barclay; Alderman Reimer; Alderman Sartorius; Alderman Townsend; Alderman Trupiano; and Alderman Violet. Staff present includes: Rick Struttmann, Police Chief; Cathy Pratt, Staff Support Services Manager; Burt Benesek, Transportation Development Services Manager; Russ Batzel, City Administrator; Randy Weber, City Attorney; and Patty Smith, City Clerk. Bill Malach, Water Environmental Services Manager and Dan Emrick, Parks & Recreation Services Manager were absent. Alderman Bateman arrived while meeting was in progress at 5:22 p.m.

Alderman Townsend moved and Alderman Sartorius seconded the motion to remove Chapter 205 Animal Regulations Code Amendment from the agenda for discussion. The motion was approved.

CHAPTER 205 ANIMAL REGULATIONS CODE AMENDMENT – BENESEK

Mr. Benesek gave a slideshow presentation and explained the proposed Animal Control Code Updates to Chapter 205.130, Barking Dogs; 205.180, Redemption Fees; and 205.290 Additional Services Provided. With Board approval, a draft ordinance will be placed on the April 22, 2021 Board of Aldermen meeting agenda for consideration. No further comments or questions from the Board of Aldermen. Alderman Reitmeyer moved and Alderman Townsend seconded the motion to place this item on the April 22, 2021 Board of Aldermen meeting agenda for consideration. All in favor, the motion was approved. MISCELLANEOUS UPDATES – BATZEL

REC-PLEX SOUTH COOLING TOWER REPLACEMENT UPDATE

Mr. Benesek presented a slideshow on the replacement recommendation of the Rec-Plex South Cooling Tower that was approved during the February 2, 2021 Pre-CIP Meeting. Rec-Plex South houses two Olympic sized ice rinks and the ice system relies on a cooling tower to dissipate waste heat. It has reached the end of its useful life and requires replacement; and the replacement cost was estimated at $85,000 at the time of the meeting. Replacement requires the ice system to be shut down for 1-2 weeks. Staff recommends replacement during the 2021 State Wars Inline Hockey Tournament July 20 – August 2 to eliminate disruption. An Evapco Unit is recommended to work properly with the existing ice system. Bluvas & Associates is the sole St. Louis supplier of Evapco. The lead time to purchase and manufacture the required replacement cooling tower is 8 – 10 weeks. Staff recommends executing a purchase order agreement with Bluvas & Associates in the amount of $91,000 to begin manufacture of the replacement cooling tower. During the Pre-CIP meeting, removal and installation cost was not factored in, so staff will concurrently competitively solicit bids for removal and installation of the existing cooling tower unit from qualified contractors; which the cost is estimated at $35,000, with a total estimated cost of $126,000. No further comments or questions from the Board of Aldermen. Alderman Townsend moved and Alderman Reitmeyer seconded the motion to place this item on one of the May Work Session and Board of Aldermen meeting agendas for consideration. Launer, 21 Heather Valley Circle, St. Peters (Ward 3) for a term expiring January 31, 2022. Mr. Launer will be filling the vacancy of Sam E. Anderson, who resigned. Steve Tripi, Senior Manager with Schowalter & Jabouri, P.C. presented via Zoom the Report on Fiscal Year 2020 Independent Audit for the City of St. Peters. The City of St. Peters Comprehensive Annual Financial Report Fiscal Year Ended September 30, 2020, will be available for viewing on the City of St. Peters website.

REZONING PETITION RZ 21-03 – CJBD 94, LLC C/O JOSHUA CASTELLO (DETAIL DRIVEN CARWASH) – POWERS

Ms. Julie Powers, Director of Planning, Community and Economic Development, reported on the Petition RZ 21-03 by CJBD 94, LLC c/o Joshua Castello (Detail Driven Carwash), who is requesting an amendment to a Planned Urban Development District (PUD) for a carwash. Since 2003 the parcel is designated as mixed use and C-3. The property is on approximately 1.12 +/- acre parcel located on the south side of Highway 94, east of Florence Drive. A public hearing was held during the Planning & Zoning Commission meeting on March 3, 2021. Ms. Powers stated that prior to the March 3, 2021 Planning and Zoning meeting, 258 property owners within 1000 feet, as required by City Code, were notified by the City of the public hearing; the site was posted and a notice was placed in the Post-Dispatch. During the Planning and Zoning meeting, 13 persons spoke, raising concerns regarding noise, traffic, property values, and proximity to daycare, drainage, safety, and visual impact of this use. Staff has received 17 emails and letters submitted to the Planning and Zoning Commission. Staff recommended approval of this petition as detailed in the summary and staff report, which was emailed to the Mayor and Board of Aldermen on March 29, 2021; and Ms. Powers summarized staff’s recommendations during her report. The Planning and Zoning Commission voted to not recommend approval of this Rezoning Petition to the Board of Aldermen, by a vote of six (6) yes and four (4) no and one (1) absent. Ms. Powers addressed questions and comments from the Board of Aldermen. This is Business Item I-01 on tonight’s Board of Aldermen meeting agenda.

Josh Castello, 107 Riparian Drive, Dardenne Prairie, owner and operator of Detail Driven Carwash, spoke in favor of the proposed business operations at this site; and of the alterations that were made after speaking with area residents.

Barbara Rellmann, 402 Via Roma Court, St. Peters, spoke in opposition of the petition, citing concerns of traffic flow and accident study.

Dustin Riechmann, 411 N 10th, St. Louis, MO, Traffic Engineer for Lochmueller Group, spoke in favor of the petition.

Cory McCoy, 123 Venice Circle, St. Peters, spoke in opposition of proposed exception of the carwash.

Brad Goss, SmithAmundsen LLC, 120 S. Central, St. Louis, spoke in favor of the petition and addressed various resident concerns. A hand out was provided to the Mayor and Board of Aldermen from Mr. Goss, which is attached hereto and made a part hereof.

Ted Jaenke, 336 San Marco Way, St. Peters, spoke in opposition of carwash. Mr. Jaenke provided the Mayor and Board of Aldermen a handout from the Montecito Master Homeowners Association, which is attached hereto and made a part hereof. AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE MUNICIPAL CODE OF THE CITY OF ST. PETERS, MISSOURI; TITLE IV: LAND USE PERTAINING TO ZONING AND PROPERTY WITHIN SAID CITY IN RESPONSE TO REZONING PETITION NUMBER RZ 21-04 AUTONATION BY MAKING CERTAIN CHANGES IN THE DESIGNATED DISTRICTS IN CERTAIN SECTIONS OF SAID CITY

WHEREAS, by Petition Number RZ 21-04 AutoNation the Board of Aldermen was requested to make a certain change in the Zoning Ordinances of the City; and

WHEREAS, the Board of Aldermen of the City of St. Peters, Missouri did first refer this Petition to the City's Planning and Zoning Commission; and

WHEREAS, the Planning and Zoning Commission did hold a Public Hearing on this proposed change; and

WHEREAS, at the Public Hearing persons in interest and citizens were given an opportunity to be heard on this proposed change; and

WHEREAS, said Planning and Zoning Commission did consider this Petition and did recommend approval to the Board of Aldermen.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF ST. PETERS, MISSOURI, AS FOLLOWS:

SECTION 1.

Certain sections of the St. Peters City Code, Title IV: Land Use are hereby amended by making the following changes in the Zoning District Map, which map is on file in the Office of the City Clerk, to rezone a 8.12+/- acre tract from C-3 General Commercial District to Commercial Planned District (CPD), which tracts are collectively described in Exhibit A (the “Property”):

SECTION 2. The Property shall comply with the following development criteria:

A. AutoNation (“Applicant”) and Kaplan Lumber Company Inc. (“Owner”) will operate the Planned Commercial Development in accordance with the Site Development Plan filed with the City as described in Exhibit B attached hereto, or in accordance with a revised Site Development Plan, if any such revision be proposed by Applicant or Property Owner, its successors or assigns, and subsequently be approved by the City, all in conformance with the then controlling sections of the Municipal Code of the City of St. Peters, Missouri (the “City Code”).

B. The Applicant or Property Owner will provide the City with all information required by the appropriate sections of the City Code for a Planned Commercial Development, and if any information is inadvertently omitted it will be provided upon request, as soon as it may reasonably be obtained.

C. The Applicant and Owner of the Premises, may use the Premises for the sale, barter, exchange or rental of new or used motor vehicles, suvs, and light trucks in addition to all permitted uses in the C-3 General Commercial District.

D. The parking of vehicles may only be conducted as part of a new or used car operation. In addition, the vehicles from related motor vehicle sales operations may be parked at the site in striped parking spaces.

E. No vehicle parked on the property shall be in disrepair or damaged including but not limited to, broken glass, deflated tires, substantially damaged body panels, substantial rust, or other such disrepair.

F. The vehicle inventory/display parking area shall be generally as shown on the site plan in Exhibit B.

G. The auctioning of used motor vehicles from the site is not permitted.

H. The repair, maintenance, and conditioning of vehicles shall only be conducted inside the building.

I. Site Plan.

1. The configuration of the Property shall be shall be as substantially shown on Exhibit B attached hereto. Any minor modifications to the Property or the Premises from that shown on the Site Plan shall be as approved by the Planning Department. Any substantive changes to the approved building shall first be approved by the Planning and Zoning Commission.

2. Vehicle theft deterrence such as, but not limited to, bollards or boulders shall be decorative and low profile as approved by the Planning Department.

J. Building Design.

1. Architectural treatment of the building shall be in compliance with the elevation shown in Exhibit C attached hereto. Substantive changes to the building shall first be approved by the Planning and Zoning Commission. Minor changes shall be as approved by the Planning Department.

K. The Property Owner shall comply with all requirements of the Zoning and Subdivision Regulations of the City Code and any other city, state, or federal regulations that are applicable unless otherwise stated herein.

L. All rights and responsibilities identified herein with respect to Property Owner shall be the sole responsibility and rights of Property Owner or its successors and assignees.

M. Any new electric service shall be installed underground per St. Peters City Code.

N. The City hereby approves the Site Development Plan as attached to this Ordinance, subject to the qualifications contained herein

O. Any improvements shall be constructed to meet all applicable state and local codes and shall comply with all of the City’s applicable Ordinances.

SECTION 3. Savings.

Nothing contained in this Ordinance shall in any manner be deemed or construed to alter, modify, supersede, supplant or otherwise nullify any other Ordinance of the City or the requirements thereof whether or not relating to or in any manner connected with the subject matter hereof.

SECTION 4. Severability.

If any term, condition, or provision of this Ordinance shall, to any extent, be held to be invalid or unenforceable, the remainder hereof shall be valid in all other respects and continue to be effective and each and every remaining provision hereof shall be valid and shall be enforced No.

to the fullest extent permitted by law, it being the intent of the Board of Aldermen that it would have enacted this Ordinance without the invalid or unenforceable provisions. In the event of a subsequent change in applicable law so that the provision which had been held invalid is no longer invalid, said provision shall thereupon return to full force and effect without further action by the City and shall thereafter be binding.

SECTION 5. Effective Date.

This Ordinance shall be in full force and take effect from and after the date of its final passage and approval.

SECTION NO. 2. That the Board of Aldermen of the City of St. Peters, Missouri, does hereby enact a new Section 205.130 Barking Dogs, of Chapter 205: Animal Regulations, Article III Other Provisions And Regulations, of Title II: Public Health, Safety and Welfare, in lieu thereof, to wit:

Section 205.130 Barking Dogs. A. No person shall own, keep or harbor any dog that they permit to annoy neighbors or other persons living within the immediate vicinity of the City of St. Peters by frequent or habitual barking, howling or yelping for a period of more than 20 continuous minutes between the hours of 7:00a.m. and 10:00 p.m. or for a period of more than 10 continuous minutes between the hours of 10:00 p.m. and 7:00 a.m. “Continuous” is defined as uninterrupted, unbroken, or so persistently repeated at short intervals as to constitute a virtually unbroken series. “Continuous” shall not mean intermittent or occasional. 1. The First (1st) offense shall result in a verbal or written warning advising the owner or harborer of the complaint. The animal owner will also receive information regarding the ordinance and provisions of this code. Subsequent complaints may result in a summons being issued. 2. Evidence, including video recordings with audio or a barking dog log and complaint form, may be collected from the complainant, but must be accompanied by a signed statement if a summons is to be issued. Animal Control Officers may also act as witnesses, however, the complainant is expected to act as the primary witness. B. Upon complaint to the Animal Control Department or upon Animal Control’s receipt of a complaint taken by the Police Department, the Animal Control Department may investigate and, upon a finding that the owner of the animal has violated Subsection (A), may request further legal action if either the complainant agrees in writing to testify against the violator of this Section or if the Officer’s investigation results in evidence of the violation of Subsection (A). No legal action will be taken on an anonymous concern. C. In any proceeding before the Municipal Court upon a complaint made and filed under this Chapter, if the Court shall find the dog in question has committed the prohibited acts alleged in the complaint, then there shall be a presumption that the defendant owner, possessor or harborer has permitted said dog to commit the prohibited acts alleged in the complaint, and it shall not be necessary that the complainant prove the defendant’s knowledge or intention or scienter. D. This Section shall not apply to kennels or other commercial animal establishments operating under licenses issued by the City under Section 205.100. E. Violations of this Section shall be deemed to be a public nuisance, and may also be punishable as provided for in Sections 215.010, et seq. F. It shall be a defense of such violation if the owner of the dog proves by a preponderance of evidence that the only reason the dog was howling or barking was that the dog was being provoked by a person or was otherwise being incited, or was acting as a guide dog, hearing dog, service dog or police work dog. G. A "no bark" collar may be available from the St. Peters Health Department, at no charge, to residents possessing a valid resident privilege card.

Third (3rd) offense: forty dollars ($40.00). 2. Dogs, cats, other domestic without valid license tag: a. First (1st) offense: forty dollars ($40.00). b. Second (2nd) offense: fifty dollars ($50.00). c. Third (3rd) offense: sixty dollars ($60.00). 3. Dogs, cats, other domestic without valid license tag and vaccination: a. First (1st) offense: eighty dollars ($80.00). b. Second (2nd) offense: ninety dollars ($90.00). c. Third (3rd) offense: one hundred dollars ($100.00). 4. Animals impounded for quarantine and dangerous impoundments: Set by agreement with impounding agency. 5. If an animal is apprehended while running at large, as a 4th or subsequent offense, the following may occur: a. Fourth (4th) or subsequent offense: one hundred dollars ($100.00) redemption fee. b. The circumstances of the case will be reviewed to determine if the animal meets the requirements to be declared Habitually At Large, as described in Section 205.125.

A. Additional services provided are as follows: 1. Disposing of fatally injured animals, or those who have died of natural causes. 2. Loaning no-bark collars to residents possessing a valid resident privilege card. 3. Impounding, apprehending, catching, trapping, tranquilizing or treating any animal, subject or not to this Chapter during or after normal business hours of the Health Department, at the discretion of the Health Department and subject to policies of this department, consistent with any State and/or Federal regulations. 4. The City is authorized to recover the cost of performing these services or any others pertaining to animal control. a. Disposal of wildlife from private property: ten dollars ($10). b. Pickup of privately owned animal: 1) Deceased privately owned animal: a) Forty (40) pounds or less: twenty-five dollars ($25.00). b) Over forty (40) pounds: fifty dollars ($50.00). 2) Alive privately owned animal: thirty-five dollars ($35.00). c. Live snake removal: twenty dollars ($20.00). 5. Live Animal Traps. a. WILDLIFE - Live traps may be loaned to residents for nuisance wildlife ONLY. Residents must have a valid resident privilege card and be willing to accept the terms of the trapping agreement. Trapping privileges may be revoked due to non- compliance. b. RESOLUTION NO.

A RESOLUTION URGING STATE SENATORS AND STATE REPRESENTATIVES TO VOTE AGAINST HOUSE BILL 920, WHICH WOULD ELIMINATE APRIL MUNICIPAL ELECTIONS

WHEREAS, there are limited options throughout the year to hold elections, and decreasing these options negatively impacts the ability for voters to be engaged on local issues; and WHEREAS, moving the municipal election to November will make it more costly to educate voters about local ballot measures; and WHEREAS, the April ballot includes important local races for city council members, aldermen, and school board officials; voters have come to expect that; and WHEREAS, April elections are intentionally tailored to community-specific issues such as electing local officials, local tax measures and other local community initiatives; and WHEREAS, a specific ballot question or candidate is more of a stimulant to voter turnout than the date of an election; and WHEREAS, there is no evidence to suggest that changing election dates for cities and school districts to November will result in enhanced voter knowledge of local ballot measures; and WHEREAS, including local ballot measures in an already voluminous number of County, State and Federal candidates will create ballot fatigue to the voter and may disrupt the focus on municipal ballot questions; and WHEREAS, a ballot that has too many candidates and questions will likely result in a less- prepared voter; and WHEREAS, mixing partisan and non-partisan candidates and questions may complicate election ballot logistics for County election authorities; and WHEREAS, much longer ballots mean much longer lines at voting precincts, particularly when including constitutional amendment questions; and WHEREAS, local questions are generally non-partisan and focus on community; including local officials and questions on a partisan ballot may cause them to be overshadowed by passionate and often negative partisanship, potentially skewing outcomes on community issues; and WHEREAS, local ballot measures will be located at the bottom of the November ballot and receive little attention; and

WHEREAS, this will likely stifle progress and development in communities across the state.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE BOARD OF ALDERMEN OF THE CITY OF ST. PETERS, MISSOURI, AS FOLLOWS:

SECTION 1. The Mayor and the Board of Aldermen of the City of St. Peters hereby urges our State Senators and State Representatives to vote against House Bill 920.
