1961] THE CONCEPT OF STATEHOOD IN UNITED NATIONS PRACTICE * ROSALYN COHEN t The topic of "statehood under international law" has long been a favorite with jurists. The problem of what constitutes a "state" has been extensively examined and discussed, but all too often in absolutist terms confined to drawing up lists of criteria which must be met before an entity may be deemed a "state." The very rigidity of this approach implies that the term "state" has a fixed meaning which provides an unambiguous yardstick for measuring without serious fear of error, the existence of international personality. The framework of examination being thus constricted, traditional inquiry has endeavored to meet some of its inadequacies by ancillary discussions on the possi- bility of a "dependent state" in international law, of the desirability of universality in certain organizations set up by the international com- munity, and of the rights of peoples to national self-determination. It would appear, however, that these questions, far from being ancillary, are integral to any discussion of "statehood." Even the language of the law-or perhaps especially the language of the law-contains ambiguities which are inherent in any language system, and the diffi- culties presented by this fact can only be resolved by an analysis which takes full cognizance of the contextual background. Thus, when ex- amining what is meant by the word "state," an appraisal of the com- munity interests which will be affected by the decision to interpret it in one way rather than in another is necessary. Discussions, for example, of whether a "dependent state" can exist under international law become meaningless unless there is first an examination of whether the community of nations would find it appropriate, in the light of its long range objectives, to afford the rights which follow from "state- hood" to entities fettered by restrictions which impair their independ- ence. -

This is a report from a committee of MPs to Parliament. It explains their actions against the leaders of the Levellers. One of the men they arrested was John Lilburne, a key figure in the Leveller movement. What’s the background to this source? Before the war of the 1640s it was difficult and dangerous to come up with new ideas and try to publish them. However, during the Civil War censorship was not strongly enforced. Many political groups emerged with new ideas at this time. One of the most radical (extreme) groups was the Levellers. -

In general, people define a place as part of New Germany if it utilizes most of the services offered in New Germany. HISTORY New Germany was developed by German settlers. According to some respondents, New Germany was started by Reverend Posselt when he launched a Lutheran Church missionary in the area in 1848. Nevertheless, other sources suggest that New Germany was founded by Jonas Bergtheil around the same time. The settlers were mostly impoverished Germans who just arrived looking for jobs since conditions were difficult in Germany. These settlers bought the land to plant cotton but later used it for vegetables as it was not suitable for cotton. New Germany was later bought for use as a golf course estate. As time progressed, houses were developed on that land and the area then became an entry point into the housing market for many white people. -

Ivan Matić Original Scientific Paper University of Belgrade UDK 321.728:321.01 141.7 THE CONCEPT OF MIXED GOVERNMENT IN CLASSICAL AND EARLY MODERN REPUBLICANISM Abstract: This paper will present an analysis of the concept of mixed government in political philosophy, accentuating its role as the central connecting thread both between theories within classical and early modern republicanism and of the two eras within the republican tradition. The first part of the paper will offer a definition of mixed government, contrasting it with separation of powers and explaining its potential significance in contemporary political though. The second part will offer a comprehensive, broad analysis of the concept, based on political theories of four thinkers of paramount influence: Aristotle, Cicero, Machiavelli and Guicciardini.1 In the final part, the theories and eras of republican tradition will be compared based on the previous analysis, establishing their essential similarities and differences. Key words: Mixed Government, Classical Republicanism, Florentine Realism, Early Modern Republicanism, Aristotle, Cicero, Machiavelli, Guicciardini. Introduction The roots of republican political thought can be traced to the antiquity and the theories of ancient Greek and Roman philosophers. As might be expected in the two and a half millennia that followed, our understanding of republicanism has been subject to frequent and, sometimes, substantial change. Yet, one defining element has always remained: the concept embedded in its very name, derived from the Latin phrase res publica (public good, or, more broadly, commonwealth), its implicit meaning being that the government of a state is meant to be accessible and accountable to all citizens, its goals being the goals not merely of certain classes and factions, but of society as a whole. -

Elections Without Democracy THE RISE OF COMPETITIVE AUTHORITARIANISM Steven Levitsky and Lucan A. Way Steven Levitsky is assistant professor of government and social studies at Harvard University. His Transforming Labor-Based Parties in Latin America is forthcoming from Cambridge University Press. Lucan A. Way is assistant professor of political science at Temple University and an academy scholar at the Academy for International and Area Studies at Harvard University. He is currently writing a book on the obstacles to authoritarian consolidation in the former Soviet Union. The post–Cold War world has been marked by the proliferation of hy- brid political regimes. In different ways, and to varying degrees, polities across much of Africa (Ghana, Kenya, Mozambique, Zambia, Zimbab- we), postcommunist Eurasia (Albania, Croatia, Russia, Serbia, Ukraine), Asia (Malaysia, Taiwan), and Latin America (Haiti, Mexico, Paraguay, Peru) combined democratic rules with authoritarian governance during the 1990s. Scholars often treated these regimes as incomplete or transi- tional forms of democracy. Yet in many cases these expectations (or hopes) proved overly optimistic. Particularly in Africa and the former Soviet Union, many regimes have either remained hybrid or moved in an authoritarian direction. It may therefore be time to stop thinking of these cases in terms of transitions to democracy and to begin thinking about the specific types of regimes they actually are. In recent years, many scholars have pointed to the importance of hybrid regimes. Indeed, recent academic writings have produced a vari- ety of labels for mixed cases, including not only “hybrid regime” but also “semidemocracy,” “virtual democracy,” “electoral democracy,” “pseudodemocracy,” “illiberal democracy,” “semi-authoritarianism,” “soft authoritarianism,” “electoral authoritarianism,” and Freedom House’s “Partly Free.”1 Yet much of this literature suffers from two important weaknesses. -

This means that the government has separate branches that deal with different as- pects of governing. These three branches are the legislative, executive, and judicial branches. This system is in place for both the federal (national) and state governments. The legislative branch, which on the national level is the U.S. Congress, passes new laws. The executive branch, headed by the president, enforces laws. The judicial branch, headed by the U.S. Supreme Court, inter- prets laws. But does the court before which you are practicing (or, in law school, the jurisdiction to which you have been assigned) have to follow the case? Stare decisis is the common law principle that requires courts to follow precedents set by other courts. Under stare decisis, courts are obliged to follow some precedents, but not others. Because of the many layers of our federal system, it can be difficult to figure out which decisions bind a given court. This handout is designed to help you determine which decisions are mandatory and which are persuasive on the court before which you are practicing. Binding versus Persuasive Authority: What’s the Difference? • Binding authority, also referred to as mandatory authority, refers to cases, statutes, or regulations that a court must follow because they bind the court. • Persuasive authority refers to cases, statutes, or regulations that the court may follow but does not have to follow. To get started, ask yourself two questions: 1) Are the legal issues in your case governed by state or federal law? and 2) Which court are you in? Once you know the answers to these questions, you are well on your way to determining whether a decision is mandatory or persuasive. Step 1: Are the Legal Issues in Your Case Governed by Federal or State Law? First, a lawyer needs to know the facts and issues of the case.
