    Statement of reasons for decision 18 September 2019 Bylong Coal Project (SSD 6367) 1 INTRODUCTION On 4 October 2018, the NSW Independent Planning Commission (Commission) received from the NSW Department of Planning and Environment (Department) a State significant development application (SSD) 6367 from KEPCO Bylong Australia Pty Ltd (Applicant) to develop and operate an open cut and underground coal mine to recover approximately 124 million tonnes (Mt) of run-of-mine (ROM) coal at a combined rate of up to 6.5 million tonnes per annum (Mtpa) of ROM coal for a period of 25 years (Project). The Commission is the consent authority in respect of the Applicant’s development application under section 4.5(a) of the Environmental Planning and Assessment Act 1979 (EP&A Act) and clause 8A of State Environmental Planning Policy (State and Regional Development) 2011 (SEPP SRD). This is because: • the Project is SSD under section 4.36 of the EP&A Act as the Project constitutes development for the purposes of coal mining, consistent with Schedule 1, clause 5 of the SEPP SRD; and • the Department received more than 25 submissions from the public objecting to the Project. Professor Mary O’Kane AC, Chair of the Commission, nominated Gordon Kirkby (Panel Chair), Wendy Lewin, and Steve O’Connor to constitute the Commission determining the Bylong Coal Project. 1.1 Site and locality According to the Applicant’s Bylong Coal Project Environmental Impact Statement, dated September 2015 (EIS), the Project is a proposed open cut and underground thermal coal mine for a greenfield site in the Bylong Valley.

    New South Wales Water Sharing Plan for the Murrumbidgee Unregulated and Alluvial Water Sources Amendment Order 2016 under the Water Management Act 2000 I, Niall Blair, the Minister for Lands and Water, in pursuance of sections 45 (1) (a) and 45A of the Water Management Act 2000, being satisfied it is in the public interest to do so, make the following Order to amend the Water Sharing Plan for the Murrumbidgee Unregulated and Alluvial Water Sources 2012. Dated this 29th day of June 2016. NIALL BLAIR, MLC Minister for Lands and Water Explanatory note This Order is made under sections 45 (1) (a) and 45A of the Water Management Act 2000. The object of this Order is to amend the Water Sharing Plan for the Murrumbidgee Unregulated and Alluvial Water Sources 2012.     Changes to Driver Licence Sanctions in Your CLSD Region In 2020, Revenue NSW introduced a hardship program focused on First Nations people and young people. As a result, the use of driver licence sanctions for overdue fine debt changed on Monday 28th September 2020 in some locations. How are overdue fines and driver licence sanctions related? If a person has overdue fines, their driver licence may be suspended. The driver licence suspension may be removed if the person: • pays a lump sum to Revenue NSW, or • enters a payment plan with Revenue NSW, or • is approved for a WDO. A driver licence suspension can be applied for multiple reasons, so even after being told that a driver licence suspension for unpaid fines has been removed, people should always double check that it is OK to drive by contacting Service NSW. Driver licence restrictions can also be put on interstate licences and cannot be removed easily. If you have a client in this situation, they should get legal advice. What has changed? Now, driver licence sanctions will not be imposed as a first response to unpaid fines for enforcement orders that were issued on or after 28 September 2020 to First Nations people and young people who live in the target locations. What are the target locations? Locations that the Australian Bureau of Statistics classifies as: • very remote, • remote • outer regional, and • Inner regional post codes where at least 9% of the population are First Nations People. Included target locations on the South Coast are the towns of Batemans Bay, Bega, Bodalla, Eden, Eurobodalla, Mogo, Narooma, Nowra Hill, Nowra Naval PO, Merimbula, Pambula, Tilba and Wallaga Lake.
