BEITRÄGE ZUM ZIVIL- UND WIRTSCHAFTSRECHT Dr. Thomas Schwenke Private Nutzung von Smartglasses im öffentlichen Raum Smartglasses erweitern und ergänzen die sinnliche Wahrnehmungsfähigkeit der Menschen und stellen so effiziente Mensch-Maschine-Schnittstellen dar, die Menschen zur Selbstbehauptung in einer datafi- zierten Welt befähigen. Zu diesem Zweck müssten Smartglasses jedoch die physische Welt möglichst detailreich erfassen, womit Menschen im öffentlichen Raum einer permanenten Beobachtung und einem Verlust von Rückzugmöglichkeiten ausgesetzt sein würden. Dr. Thomas Schwenke untersucht, ob Smartglasses sich angesichts dieser Gefährdung der Privatsphäre in den Alltag von Menschen inte- grieren und so überhaupt ihre technischen Vorteile ausspielen können. Die Untersuchung ist durch einen Dreiklang der technischen und gesellschaftlichen Betrachtung sowie deren rechtlicher Würdigung gekennzeichnet. Sie beginnt mit der Darstellung technischer Architektur sowie Funktionen und Einsatzbereichen von Smartglasses. Dabei werden insbesondere die möglichen Einsatzfelder herausgestellt, auf deren Grundlage die schützenswerten Interessen ihrer Nutzer heraus- gearbeitet werden. Für die Zwecke der Veranschaulichung werden Beispiele konkreter Geräte vorge- stellt, und es wird auch ein Ausblick in mögliche künftige Entwicklungen gegeben. Anschließend widmet sich die Untersuchung den gesellschaftlichen Auswirkungen der Smartglasses- Technologie und den Reaktionen von Menschen auf die „Cyborgs“, wie deren Nutzer häufig bezeich- net werden. Danach werden das Konzept der Privatsphäre, dessen Grundlagen sowie seine historische Entwicklung dargestellt, um die Bedeutung der Privatsphäre sowie ihre Beeinträchtigung, aber auch ihre gegenwärtige und künftige Daseinsberechtigung beurteilen zu können. Im nächsten Schritt wird untersucht, inwieweit die Privatsphäre einen verfassungsrechtlichen Schutz erfahren hat und wie dieser durch den Einsatz von Smartglasses beeinträchtigt wird. Neben der Prüfung des Rechts auf informationelle Selbstbestimmung werden die Kriterien zur Bestimmung der Nützlichkeit und der Ein- griffsintensität von Smartglasses zum Zweck der Interessenabwägung auf der Ebene des einfachen Rechts herausgearbeitet. Die rechtliche Prüfung wird durch die Möglichkeiten zur sofortigen Abwehr Betroffener sowie den Einfluss der EU-Datenschutzgrundverordnung auf die gewonnenen Ergebnisse abgeschlossen. Der Schlußteil der Untersuchung beginnt mit Prognose künftiger technischen und sozialer Entwick- lungen. Ihr folgen Vorschläge für Maßnahmen, die eine privatsphärenschonende Nutzung von Smart- glasses im öffentlichen Raum ermöglichen sollen. In fact, due to medical necessity, there are currently millions of people worldwide equipped with prosthetic devices to restore lost functions, and there is a growing DIY movement to self-enhance the body to create new senses or to enhance current senses to “beyond normal” levels of performance. From prosthetic limbs, artificial heart pacers and defibrillators, implants creating brain–computer interfaces, cochlear implants, retinal prosthesis, magnets as implants, exoskeletons, and a host of other enhancement technologies, the human body is becoming more mechanical and computational and thus less biological. As the market for on-body wearable technology grows, the importance of efficient interactions through such technology becomes more significant. Novel forms of communi- cation is made possible due to the highly mobile nature of a wearable computer coupled to a person. A person can, for example, deliver live video, audio and commentary from a re- mote location, allowing local participants to experience it and interact with people on the other side. In this way, knowledge and information can be shared over a distance, passing through the owner of the wearable computer who acts as a mediator. To enable the mediator to perform this task in the most efficient manner, the interaction between the user, the wear- able computer and the other people involved, needs to be made as natural and unobtrusive as possible. One of the main problemsof today is that the virtualworld offered by wearable computers can become too immersive, thereby distancing its user from interactions in the real world. At the same time, the very same immersion serves to let the user sense the remote participants as being there, accompanying and communicating through the virtual world. The key here is to get the proper balance between the real and the virtual worlds; remote participants should be able to experience a distant location through the user, while the user should similarly experience their company in the virtual world.

Since the coining of the phrase "Augmented reality" in 1990, the technology has come a long way from research laboratories and big international companies to suit the pockets of millions of users all over the world. AR’s popularity among younger generations has inspired an effort to utilize AR as a tool for education. For teachers, starting with AR educational authoring, we selected some important milestones of the history of the field with the focus on the specific domain of educational applications. We comment on Videoplace and Construct3D projects in more detail. Finally, we draw a few implications from the available literature for educational authoring.
