WHEREAS, in SMITH COUNTY, Texas, on FARM TO MARKET ROAE 344, the County acquired certain land in the State's name for highway purposes at no cost to the State Highway Department, said land being conveyed to the State by instrument of record as Cause No. 9464 of the Civil Minutes of Smith County, Texas, and by instruments oi record in Volume 11, Page 609, and Volume 13, Page 26, of the Civil Minutes of Smith County, Texas; and

WHEREAS, a portion of said land is no longer needed for highway purposes or for use of citizens as a road, said surplus land being more particularly described in Exhibit A, attached hereto and made a part hereoi and

WHEREAS, the Commissioners' Court oi Smith County, Texas, has, by resolution requested that the State quitclaim said surplus land to Smith County, Texas; and

WHEREAS, Article 6673a, V. A. C. S., authorizes the State's quitclaiming to the County the State's rights, title and interest in such surplus land purchased by the County in the State's name; and

WHEREAS, by instrument executed by the Governor oi Texas March 9, 1971, recorded in Volume 1365, Page 622, of the Deed Records of Smith County, Texas, the State granted to the Upper Neohes River Municipal Water Authority the right to permanently flood and inundate a portion of said land to an elevation of 345 feet above mean sea level and to intermittently flood and inundate a portion of said land to an elevation oi 355 ieet above mean sea level as necessary ior the construction, operation and maintenance oithe Blackburn Crossing Reservoir, which rights are to be continued in force and effect; and

WHEREAS, it is the opinion oi the State Highway Commission tha it is proper and correct that the State quitclaim its interest in said surplus land to Smith County, Texas, subject to the aiorementioned subordination to the Upper Neohes River Municipal Water Authority, in consideration oi relieving the State Highway Department of the responsibility and cost of maintenance of the surplus land and in consideration of the land having been originally purchased by the County in the State's name at no cost to the State Highway Department;

NOW, THEREFORE, in consideration oi the foregoing premises an in accordance with the provisions and within the purview of the aforemen­ tioned Statute, it is hereby rcommended by the State Highway Commission subject to approval by the Attorney General, that the Governor oi Texas execute a proper instrument quitclaiming the State's rights, title and interest in said surplus land to Smith County, Texas, subject to the flooding rights previously granted to the Upper Neohes River Municipal Water Authority, as set out above, said surplus land being more particu­ larly described in Exhibit A, attached hereto and made a part hereof.

WHEREAS, Item I.B. 4. of the 1969-197 0 Budget for the Texas Highway Department as approved by the Texas Highway Commission budgets a sum of $7, 302, 006. 00 for Motor Vehicle Registration; and

WHEREAS, $3,403, 000.00 of the above stated $7,302, 006.00 represents the original amount requested for the manufacture, inspection, testing, and delivery of 14,950,000 single license plates to the Counties for the 1971 Registration Year; and

WHEREAS, the total number of 1971 license plates was under­ estimated due to an unanticipated increase in the overall vehicle regis­ tration, especially in the Motorcycle and House Trailer classification; and

WHEREAS, it is now apparent that approximately 452,000 addi­ tional single 1971 license plates will be needed in the hands of the various 254 County Tax Assessor-Collectors for the remainder of the 1971 Registration Year;

NOW, THEREFORE, BE IT ORDERED by the Commission that an additional $100, 000.00 or as much thereoi as may be required be appro­ priated to pay for the manufacturing, inspection, testing, and delivery to the Counties of the additional 1971 vehicle license plates.

WHEREAS, House Bill 655 of the Regular Session of the 59th Texas Legislature specifically directed the Texas Highway Department to promulgate procedures for the issuance oi special personalized license plates and to establish a deadline for the receipt oi applications therefor; and

WHEREAS, Minute Order No. 55852 was issued on May 1, 1965, stating that renewal applications for special personalized license plates should be submitted to the Department not later than January 1; and WHEREAS, experience has shown that these special personalized license plates cannot be manufactured on the mass-production basis as other regular license plates; and

WHEREAS, the slower manufacturing process necessary to pro­ duce these special plates precludes their production in time to reach all County Tax Assessor-Collectors by February 1; and

WHEREAS, the applicants ior such special personalized license plates expect their plates to be available in the County Tax Assessor- Collectors' offices when regular plates are available to the public; and WHEREAS, an extra month is needed to process the applications, prepare the production schedules, and to manufacture and transport these special personalized license plates to the various 254 County Tax Assessor-Collectors by February 1;

NOW, THEREFORE, BE IT ORDERED that paragraph (6) of Minute Order No. 55852 be amended to provide that renewal applications for personalized plates should be submitted to the Department not later than December 1, preceding the forthcoming Registration Year.

Upon acceptance of the provisions of this Order by the appropriat officials of the City of Killeen, IT IS ORDERED that Fort Hood Street, ex­ tending from U. S. Highway 190 north to Rancier Avenue, a distance of approximately 0.7 mile, be and is hereby designated as a TOPICS STREET and the State Highway Engineer is directed to enter into agreement with the City of Killeen covering the details of the proposed improvements, to proceed with the engineering development of the project and after the City has fulfilled its responsibilities, proceed with construction as authorized herein in the most feasible and economical manner, financing the cost in the Federal TOPICS Program.

WHEREAS, in BEXAR COUNTY, the City oi San Antonio is planning the reconstruction of Pecan Valley Drive and Artesia Avenue; and WHEREAS, the City of San Antonio has requested revision of the median on U. S. HIGHWAY 87 at this location to provide left-turn storage lanes and has tendered financial participation in the cost of the work to the extent of one half of the estimated cost; and WHEREAS, the reguested improvements will provide for greater traffic saiety; NOW, THEREFORE, the State Highway Engineer is directed to proceed in the most feasible and economical manner with revision of the median on U. S. Highway 87 at the intersection with Pecan Valley Drive and Artesia Avenue, at an estimated cost of $12,250.00, subject to the condition that the City of San Antonio will furnish the fixed sum of $6,125. 00, as its portion of the cost oi the work.

The State Highway Engineer is also directed to iinance the State's portion oi the cost with funds available through the Maintenance Division for the improvement of State and U. S. Highways.

WHEREAS, in BRAZOS COUNTY, on STATE HIGHWAY 6, approxi­ mately 6. 0 miles north of Bryan, construction of a major rest area is not feasible at present as a result of problems encountered in obtaining water disposing of sewage effluent, and reconstruction of the highway; and

IT IS ORDERED that the project as authorized in Minute Order No. 62027, passed March 7, 1969, in the amount of $35,000.00 be cancelled.

Highway 79 near Buffalo, northwest to Navarro County Line, a distance of approximately 36.2 miles, the State Highway Engineer is directed to proceed in the most feasible and economi cal manner with the construction of signing, at an estimated cost of $167, 000.00, financing the cost in the 1969-1972 Interstate Construction and Right oi Way Program.

64753 WHEREAS, in LIBERTY COUNTY on STATE HIGHWAY 105, Minute D-5 Order 55023, dated August 31, 1964, authorized advance planning for con­ struction of a new structure across the Trinity River near Rom ay or; and I WHEREAS, in furtherance of this project Liberty County has acquired 3 of 5 right of way parcels needed for the alignment and design which was originally developed from the advance planning study; and

WHEREAS, subsequent thereto the 89th Congress oi the United States by enactment oi Public Law 89-298 required that crossings oi the Trinity River provide for Navigation; and WHEREAS, the proposed Trinity River Navigation Channel at this location reguires a realignment of the east highway approach and a high level bridge; and

WHEREAS, the resulting changes in reguired right oi way make it impractical to continue with the County on the initial right of way acquisi­ tion; and

WHEREAS, Liberty County has proposed that it pay to the High­ way Department $22, 5 00. 00 which together with the right oi way previously acquired will constitute complete fulfillment of the County's right of way obligation for this project.

NOW, THEREFORE, the State Highway Engineer is authorized to enter into an agreement with the United States Corps of Engineers for I payment to the State of the additional costs of right of way and construc­ tion occasioned by the navigation requirements, whereby the Corps will pay for its portion of the cost with funds available and with additional funds to be made available by the U.S. Congress in future appropriation acts.

It is further ordered that the County's proposal including the $22,500. 00 payment be accepted and upon receipt oi the County's pay­ ment and execution of the above referenced agreement with the U.S. Corps of Engineers, the State Highway Engineer is authorized to acquire as a staff operation the additional needed right of way for the realignment of State Highway 105 for a Navigation Crossing at an estimated total cost of $81,000. 00.

In accordance with Minute Order 55 023 and at such a time as necessary right of way is acquired, the State Highway Engineer is directec to report back to the Highway Commission for consideration of finance for construction.

64754 In LUBBOCK COUNTY on U. S. HIGHWAY 87, IT IS ORDERED that JCD Minute Order 61448 which authorized a co-operative project with the City of Lubbock for the widening of pavement from 45th Street to 60th Street, I a distance of approximately 1.2 miles, be and is hereby cancelled. 64755 WHEREAS, in MONTAGUE COUNTY on U. S. HIGHWAY 82, the JCD appropriate County oiiicials have advised that they are now ready to enter into agreement to purchase right of way across Montague County; and

NOW, THEREFORE, the State Highway Engineer is directed to proceed with engineering surveys, the preparation of schematics, deter­ mination of right of way requirements and to hold public hearings.

This action is taken in the interest oi advance planning with the understanding that State funds are not now available for the purchase of right oi way and construction but that State funds for the purchase of right of way will be provided as needed, in future programs of work.

WHEREAS, in MONTGOMERY and HARRIS COUNTIES. W. D. York & Harold Martin Construction Co., Inc. were awarded a contract in the amount of $2,243,347.42 ior grading and structures on U. S. HIGHWAY 59_, Project F 514 (50), C 177-5-19 & 177-6-19; and

WHEREAS, W. D. York upon completion oi the project filed a claim with the Highway Department in the amount oi $78,465.51 ior addi­ tional payment due to a Borrow Under-run of 25.9%; and

WHEREAS, after careful study and consideration by the Claims Committee of all factors involved in the claim as well as reports furnished by the District, the Construction Division and a personal discussion with W. D. York, it is the recommendation of the Claims Committee that the entire claim in the amount of $78,465.51 be paid to W. D. York.

NOW, THEREFORE, IT IS ORDERED by the State Highway Com­ mission that the entire claim in the amount of $78,465.51 be paid to W. D. York in full settlement oi this claim and that acceptance and negotiation of the warrant by W. D. York shall relieve the Department from any further claims by the contractor, W. D. York and Harold Martin Construction Co., Inc. , for the construction of said project or ior any items of whatever nature related thereto.

IT IS FURTHER ORDERED that copies of this Minute be furnished separately to the two contractors involved, W. D. York and Harold Martin Construction Co., Inc., and a revised final estimate be prepared to implement this payment of $78,465.51 to W. D. York.

In NUECES COUNTY on STATE HIGHWAY 358, IT IS ORDERED that funds in the amount of $100,000.00, be and are hereby transferred from the project presently authorized for the purchase of right of way from Davis Drive near Naval Air Station to State Highway 286, to the project providing for the purchase of right oi way between State Highway 286 and Interstate Highway 37 in the City of Corpus Christi.

WHEREAS, in ORANGE COUNTY on STATE HIGHWAY 87 and LOOP 358, the City oi Orange has requested assistance in the installation and replacement of traffic signals and street lighting on State Highway 87 between Interstate Highway 10 and Loop 358 and the installation oi traffic signals at the intersection oi 15th Street and Loop 358; and

WHEREAS, it has been determined that such work is eligible ior participation in the Federal TOPICS Program; and

WHEREAS, it is the desire of the Texas Highway Department to assist the City of Orange in such work;

NOW, THEREFORE, the State Highway Engineer is directed to tender the iollowing proposal to the City of Orange for development of such a project:

The Texas Highway Department will provide for the installation and replacement oi traffic signals at warranted locations and provide for I the installation of illumination along 16th Street from Interstate Highway 10 south to Loop 358, a distance oi approximately 1.9 miles, at an esti­ mated cost of $229, 000.00.

Upon acceptance of the provisions of this Order by the approprial officials oi the City oi Orange, the State Highway Engineer is directed to enter into agreement with the City covering the details of the proposed improvements, to proceed with the engineering development oi the project and construction in the most ieasihle and economical manner, financing the cost in the Federal TOPICS Program.

This Order shall become operative upon acceptance by the City of Orange and if not accepted within 90 days oi the date hereof, the actior herein contained shall be automatically cancelled.
