The meeting started in the Cantonment Board office with the President Cantonment Board welcoming all the members present. Thereafter, Col. Pankaj Tuknait, Adm Comdt, HQ 31 Sub Area took oath as nominated member of the Board and was congratulated by rest of the members of the Board with the permission of the President, following agenda were introduced and deliberated upon-

Agenda No. 1 CONFIRMATION/ NOTING i. To note PCB approval dt. 09-11-2015 for repairing and installation of 04 pole L.N.T 50K MCCB main switch, cable 150SQMM 31/2 coir 1100 volt & thimble almonium 150 mm for Indra Nagar sump house. ii To note action taken by CEO for purchase of 10 no. of racks (20 gage iron make) for a sum of Rs. 48,000/-. ii. To note action taken by CEO regarding purchase of 08 no. of Heat pillars (Maurice make) for a sum of Rs. 38,400/-.

Agenda No. 2 GRANT OF ROUTINE PROMOTION ON SENIORITY BASIS.

The Accountant of Cantt Board retired from service of this Board on 31.03.2015 after attaining the age of Superannuation . The daily routine work of Account section is run by Senior Assistant in officiating capacity from Ist April 2015. The below mentioned posts are declared as Supervisory posts under Cantt. Board of Badami-Bagh.

Agenda No. 3 GRANT OF ADVANCE INCREMENTS TO DEGREE HOLDER ENGINEER OF CANTT BOARD CANTT SRINAGAR.

The Board considered and resolved in Board meeting dated 06.07.2015 to constitute a committee of three Board members, namely Sh. Ab. Sami Wani, Sh. Parvaiz Ahmed & Sh. Mohd Ashraf Lone , who will verifying /peruse the all connected documents along-with genuineness of degree certificate of Sh. Tariq Ahmed Khanday J.E and directions of J & K High Court , the Board further resolved that recommendation of committee to be placed for Board after complication of supply jobs.

OFFICE NOTE :- In this regard, this office already taken up the matter with Bangalore University authorities vide letter dated 30.06.2015 & 17.08.2015 . The University authorities of Bangalore vide their letter dated 04.09.2015 has intimated to deposit Demand Draft of Rs. 550/- as prescribed fee for verification of Degree certificate of Mr. Tariq Ahmed Khanday whose registration No. 92HAO36 of Bachelor of Engineer (Civil) passed Degree in Feb 1997 . This office has forwarded the Demand Draft of Rs. 550/- vide letter dated 21.10.2015 . The final reply is awaited from University authorities of Bangalore .

Considered and resolved that a reminder be sent to University of Bangalore. The university shall also be informed they will be arrayed as a party respondent to the writ petition filed by Shri Tariq Ahmed Khanday in case verification report is not received by the Board latest by 15-02-2016.

Agenda No. 4 ENHANCEMENT OF HONORARIUM IN RESPECT OF TEACHING AND NON –TEACHING STAFF OF CANTT. BOARD PUBLIC SCHOOL

Reference application received from Smt. Manjeet Kour, Smt. Saima Shah and Sh. Mohammad Ashraf Lone, Elected Board Members (School Management Committee) regarding enhancement of honorarium in respect of teaching and non teaching staff of Cantt. Board Public School.

OFFICE NOTE

The previous enhancement of honorarium in respect of teaching and non teaching staff of Cantt. Board Public School engaged through Contractor was approved by the Board vide CBR 12 dated 27/10/2014 by enhanancing honorarium @ Rs.1000/- per month . The existing honorarium details of teaching and non teaching staff is as under :

Considered and resolved that the School Management Committee (SMC) shall study the matter and submit its recommendations to the Board by 31/03/2016. The SMC may take into account nerrick rates, minimum wages and other parameters deemed relevant for arriving at final recommendations in light

Agenda No. 5 ENGAGEMENT OF AUTHORIZED MEDICAL ATTENDANT (AMA) ,ON CONTRACTUAL BASIS IN CANTT. BOARD GENERAL DISPENSARY.

Ref, CBR No. 3 dated 3/8/2015.

As per CBR referred above , Cantonment Board vide letter No. CB/Eng/Doctor / Contractual /GBP/.625-26 dt. 5/8/2015, published press advertisement in two local news papers Daily Aftab and Reader, call applications for engagement of doctor ( Authorized Medical Attendant AMA) in Cantt. Board Dispensary on contractual basis on monthly honorarium. only one application of Dr. Sajad Ahmad Wani R/o Zewan , Srinagar was received . The last date for receipt of application was 20/8/2015. However, to proceed further on the matter, Dr. Sajad Ahmed Wani, vide application received on 2/11/2015, intimated that he has been engaged in National Rural Health Mission (NRHM).

Again, Cantonment Board vide letter No. CB/Eng/Doctor/Contractual/GBP /1144-45 dt 20/11/2015, published press advertisement in two local news papers Daily Aftab and Kashmir Reader . The last of receipt of application was 15/12/2015. However, no application was received by this office.

However, keeping in view of essentiality of job , and as per CBR under reference, Dr. Ali Mohammad, who has worked in Health Department J&K in various capacities such as Medical Officer, Block Medical Officer, District Immunization Officer, and finally retired as Assistant Director, Health Service ( HQ) , Kashmir has been given extension as Authorized Medical Attendant (AMA) on monthly honorarium for the period of two months w.e.f 6/12/2015 to 5/2/2016. Board may decide to take the services of Dr. Ali Mohammad Mohanad , as Authorized Medical Attendant (AMA) in G B Pant Cantt. Dispensary, on contractual basis for 11 months initially or otherwise.

Considered and resolved that-

a). Dr. Ali Mohammad be given and extension till 31-03-2016 as AMA of Cantt Board Dispensary.

b). An advertisement for engagement of AMA be published in other newspapers also having wider circulation besides Daily Aftab and Kashmir Reader.

Agenda No. 6 RATION GHAT AT PALPORA

Reference CBR No. 2 dated 27.10.2015.

Fresh tenders for use and occupation of Cantonment Board shop as Ration Ghat situated at Palpora Sonwar were called through press advertisement published through local news papers Kashmir Reader and Daily Aftab on 22.11.2015.

03 tenders were received , amongst them one Mohd Maqbool Dar S/o Ismail Dar R/o Palpora Sonwar has quoted highest bid of Rs. 13200/- ( Thirteen Thousand Two Hundred) per annum for area measuring 180 sqft. The tenders were opened in presence of CEO by the tender opening committee.

The tenders along with comparative statement are placed on the table.

Resolution No. 6

Considered and resolved, that the licence for use and occupation of Cantonment Board Shop admeasuring 180 sqft as Ration Ghat at Palpora Sonwar be granted to highest bidder, Mohd Maqbool Dar, for an amount of Rs 13,200 per annum for a period of 4 years 364 days.

Agenda No. 7 AUCTION OF SHOP NO. 4 SITUATED IN SONWAR MANDIR GALI

Reference CBR No.17 dated 6/7/2015.

The shop No.4 situated in Sonwar Mandir Gali was allotted to Sh . Mohd Rafiq Rather on annual rent of Rs. 37,855/- per annum i.e Rs. 335/- per sqft for an area of 113 sqft. The Ex-licensee submitted an application dt. 9.6.2015 , wherein he has requested for surrender of shop giving reasons not in a position to pay licensee fee under section 267 of Cantt. Act 2006. The matter was referred to Board vide CBR quoted above . Board unanimously considered and approved to take the possession of shop with immediate effect and release of the security deposit to the applicant.

As per decision of Board sealed tenders were called twice through press advertisement published in daily Kashmir Reader and Daily Aftab on 29.8.2015 and 24.9.2015 , but no party came forward to purchase the tender document and to participate in the auction of said shop perhaps due to its high security deposit i.e Rs. 2,50,000/- ( rupees two lakh fifty thousand).

The Board may reduce the security deposit to Rs. 1,25,000/- ( approx. equal to 3 years rent).

Resolution No. 7

Considered and approved reduction of security deposit to Rs 1,25,000/- for Shop No.4 situated in Sonwar Mandir Gali, in view of repeated failed attempts to auction the shop in the past. The auction process for the said shop be started again.

Agenda No. 8 LICENSE UNDER SECTION 277 OF CANTT. ACT ‘2006

In this connection, it is submitted that the term of S.No 58 had expired on 26.12.2013 and is running the trade on the basis of statues-quo order granted by Hon’ble High Court at Srinagar. Regarding S.No 66 and 67, they are part and parcel of Court Case titled as Joginder pal and Ors Sadar Bazaar v/s Union of and others.

Therefore, Board may decide whether the license in respect of the above referred is to be issued or otherwise.

Agenda No.9 DISCUSSION POINT :- REFRESHMENT STALL INSIDE PREMISES OF G B PANT HOSPITAL

Reference discussion point No.. 1 Dated 6.7.2015.

The Cantonment Board vide discussion point under reference constituted following 03 member committee to inspect the refreshment stall inside the premises of G B Pant Hospital . The committee members have inspected the refreshment stall and submitted the recommendations which are placed before the Board in the file.

Resolution No. 9

The Board perused the report submitted by 03 member Committee and resolved to constitute a 04 member Committee which will constitute of the following Board members.

1. Col. Pankaj Tuknait. 2. Sh Ab Sami Wani 3. Sh. Bilal Ahmed Wani 4. Sh. Raies Ahmed Malik.

The Committee shall submit a factual report by 22-02-2016 and may take following into its consideration while making recommendation to the Board.

a). Terms and conditions of grant of licence for occupation and use of refreshment stall to its licencee.

b). Violations if any, made by the licencee.

c). Loss suffered by licencee because of Sept’2014 floods.

The JE shall assist the Committee in performing it duties.

Agenda No. 10 ALLOTMENT OF SHOP TO BALMER AND LAWRIE NEW DELHI

Reference CBR No.1 (C) dated 06.07.2015.

The Board vide CBR under reference allotted a shop to Manager Balmer & Lawrie, New Delhi for a period of 03 years measuring 15’x12’ on annual rent of Rs. 1,00,000/- (Rupees One Lakh only) per annum. The Manager, Balmer & Lawrie, was asked to submit the consent on account of rent before taking the MINUTES OF ORDINARY BOARD MEETING HELD ON 23/01/2016 Page 7 of 31 possession of the said shop. The Manager of the above said firm has not submitted the consent till date and has occupied the shop without executing the Contract Agreement.

Now the Branch Manager of the said firm have submitted application requesting there-in that yearly rent has been charged on higher side and kindly reconsider rent /matter as it is not as per the normal rent being charged.

Resolution No. 10

Considered and observed that deposition of Rs 50,000 by Shri Ashish Handa, Branch Manger, Balmer and Lawrie (applicant) amounts to giving its consent. Now, request of the applicant for reduction of annual rent can not be considered. The occupation of shop by the applicant without executing contract agreement amounts to encroachment of Cantonment Board property.

The applicant be given a final opportunity to execute a contract with the Board failing which appropriate action to evict the applicant be initiated.

Agenda No. 11 DEVELOPMENT / RESTORATION WORKS AFTER FLOODS

Board may consider and approve the following development / restoration works to be executed during the financial year 2015-2016 subject to availability of funds. The estimates have been prepared by J.E Cantt. Board.

Agenda No.12 REMOVAL OF SHOAL FROM RIVER BED

It is submitted that State Government is removing shoal from the river bed of river Jhelum. The bank of this river within the Cantonment Area is Class ‘C’ land under the management of this Cantt. Board. Therefore , it is proposed that the shoal of this area may be put to auction by this Board. In this rgard JE has prepared MRP of the shoal at Shivpora which tunes to Rs. 14,43,750/- and at Batwara which tunes to Rs. 1,50,000/-. Board may consider and approve the auctioning of said material through e-tendering.

Resolution No. 12

The matter was discussed at length. The CEO apprised the Board, that the matter was taken up with the district administration. The Irrigation department informed that they are mandated to remove the shoal as per J&K Water resources (Regulation and Management) Act,2010. As per section 3 of the Act, the proprietary ownership of every water source in the State Shall vest with the J&K Government. As per GLR of the Badamibagh Cantonment, parts of falls under class-c land.

The Board resolved that taking away of proprietary rights of Cantt Board by J&K State Unilaterally through passing of the said Act is not correct in law. In this matter advise of CBLA and PDDE, NC should be taken which should be put before the Board for further action.

Mohd Sultan Gooni and Mushtaq Ahmad Gooni sons of Late Noor Mohd Gooni for the construction of two storied residential house after demolition of existing house at Batwara on land bearing Kh. NO.223. The DEO Srinagar has certified that the land of proposed construction is Abadi Deh land (B-3) under the management of Cantonment Board. Moreover the DEO Srinagar has forwarded Dte of DE, NC letter No.13000/78/L/DE/NC/11 dated 20/09/1999, in which it has been stated that this case can be initiated at par with the old grant for the purpose of sanctioning building plans.

Sealed quotation for auction of dead stock/ condemned stores damaged were invited vide this Office letter No. 27 dated 17-04-2014 published through two local news papers i.e., daily Aftab and Kashmir Reader. The quotation were opened by the members of purchasing committee in presence of the quotationers who participated in the bid. The highest bid of Rs. 91,786 have been offered by Sh. Javid Ahmad Bhat S/o Gh. Nabi Bhat R/o Srinagar which is on higher side of the MRP of Rs. 36000/-. The Cantt Board is providing Conservancy services to both the Air force Hqrs i.e. Old Air port and Awantipora Stations for last 03 years. Recently the Board approved the rate effective from 01.11.2015 vide CBR No. 03 dated 27.10.2015 for Rs. 4100/- for Old Airport Station and Rs. 2250/- for Awantipora Stations for lifting of garbage only.

Now the Air-force station old Airport vide their letter dated 23.11.2015 and 05.12.2015 has requested that besides lifting of garbage , the following additional services may be provided to their Stations.

a) 30 (thirty) Conservancy Labours daily except Sundays and gazette holidays through Labour Contractor of our organization/Board. b) 75 (Seventy five ) Washroom cleaning with modern equipments from firms like Sulabh and Equivalent firms, working with your Board. c) 04 (four) dumpers and 08 (Eight) rickshaws and cleaning materials on Contract . d) Disinfectants (Lime 200 kg and Tagpar 75 Kg).

In this connection it is submitted that Board has no sufficient manpower for providing to them. The Board may consider to call for tenders from private contractors for providing conservancy services to the said stations.

The Hon’ble Prime Minister of India had announced Swacch Bharat Mission on 2nd Oct 2014 to achieve a clean India by the 150th birth university of Mahatma Gandhi in 2019. In this context the GOI Ministry of urban Development has issued the themes for consideration to Ministry of Defence “Cantonment Boards” . The same is placed before Cantt Board for consideration and further necessary action.

Considered and resolved that a detailed plan under Swachh Bharat Mission be submitted before the Board. Meanwhile a cleanliness drive be carried out as per the letters under reference on the agenda side. The President Cantonment Board expressed his concerns about the level of sanitation in both civil and military areas and emphasized that necessary steps be taken to enhance the cleanliness level in both the area.

Agenda No. 24 CONSTRUCTION OF OFFICE-CUM-RESIDENTIAL FOR DEO, KASHMIR CIRCLE.

To consider the request made by DEO, Kashmir Circle, to execute the deposit work of construction of office-cum-residential complex by this Board vide their office letter No. DEO-51/ADM/Sgr/18 dt. 4th Dec’2015.

Agenda No. 25 PAYMENT OF EXGRATIA COMPENSATION TO CANTT BOARD EMPLOYEES.

Reference Cantt Board letter No.CB/flood/192 dated 03.12.2014, Directorate Defence Estates Northern Command letter No6/Gen/BB/event/ Cantt/DE/NC/53 dated 03.12.2015, even No. dated 15.12.2015.

1. During the visit of DG,DE , New Delhi to Badami Bagh Cantt on 27.11.2015 the Cantt Board staff and the elected members of Cantt Board Badami Bagh have raised the issue regarding payment of exgratia compensation to Cantt Board employees as flood relief..

2. The Cantt Board was projected a sum of Rs. 25.00 Lakhs in Budget Estimates ® 2014-15 and Rs. 15.00 Lakhs Budget Estimates ( O) 2015-16 on account of flood relief to Cantt Board employees . The said amount could not be released /paid to staff .

3. Now the Cantt Board again projected a sum of Rs. 47,50,000/- into Budget Estimates ® 2015-16 an account of relief to flood victims.

4. The Cantt Board employees are stressing hard for release of relief payment for construction /repair of their damaged houses etc. . It is recommended that Board may consider and approve the following payment as well as terms and conditions for releasing payment:-

i Total staff serving as on 01.12.2015 as per 180 pay roll ii. Amount projected into Budget Estimates ® 47.50 Laks 2015-16. iii. Amount recommended per employee for @ Rs. 25000/-(Twenty sanction . five thousand only) iv. Recoverable in 25 equal monthly Rs.1000/- installments w.e.f. 01.01.2016. v. The employees who will retire from service between 01.01.2016 to 31.01.2018 after receiving relief amount their remaining amount may be recovered in lum sum from their pension dues (Leave encashment or gratuity)

5. All the eligible employees will apply in proper application form for relief. The forms will be available in Cantt Board Office in Account Section. Further, employees applying for the relief shall have to give an undertaking that any amount due will be recoverable from their pension dues/leave encashment/gratuity in case of their death/removal from service /dismissal from service /termination from service.

6. The Board may consider and approve payment of interest free advance, on above mentioned terms and conditions, to the employees of the Board on their application to such advance.

A 02 member committee of Lt Col. Sachin Jain, GE 864 and Shri Parvaiz Ahmed Dar is constituted to submit its report to the Board, in relation to work listed at point 4, by 22-02-2016.

In relation to work listed at point 5, an NOC from district administration be obtained before starting the said work.

Agenda No. 31 COMPLAINT AGAINST THE ELECTED BOARD MEMBER.

Pseudonymous complaint dated 21/12/2015 was received against Shri Bilal Ahmed Wani, Elected member, Ward No.07. To ascertain the veracity of the Complaint, a public notice dated 21/12/2015 was issued asking for the proof MINUTES OF ORDINARY BOARD MEETING HELD ON 23/01/2016 Page 30 of 31 corroborating the allegation made in the complaint from general public within 5 days of issue of notice. After 5 days, another public notice dated 28/12/2015 was issued asking general public to refrain from making allegation against public servant without any proof as no proof was received by the office corroborating allegations made against Shri Bilal Ahmed Wani.

The Board may take notice of the aforesaid complaint and take suitable action in this regard.

Considered and resolved that the matter be treated as closed in absence of any proof corroborating the allegations made.

After deciding on above agenda, the PCB exhorted all the members to contribute actively towards upgradation of services provided by the Board. The PCB stressed upon the need to maintain a high level of sanitation and hygiene inside the Cantonment. The meeting ended with the members thanking the PCB.
