Fluor Corporation Corporate Political Activity July – December 2018 Fluor Corporation Corporate Political Activity July – December 2018 Fluor Corporation has adopted a Political Activities Policy to establish policies and procedures regarding the Company’s advocacy and involvement in U.S. elections. As the Policy outlines, we believe that meaningful civic engagement requires Fluor to participate in the legislative process and, where lawful and appropriate, provide corporate support to candidates or ideas. The purpose of this Political Activities Report, a semiannual requirement under the Policy, is to facilitate transparency regarding Fluor’s political activities. This report discloses all of the Company’s monetary and non-monetary contributions and expenditures (direct or indirect), including contributions by FLUORPAC, the Company’s separate segregated fund, during the semiannual period (July – December 2018) to: (i) participate or intervene in any political campaign on behalf of (or in opposition to) any candidate for public office; or (ii) influence the general public, or any segment thereof, with respect to an election or referendum. For each contribution, the report discloses the name of the recipient and the amount given. These contributions are publicly reported to governing agencies by Fluor, FLUORPAC, and/or the recipients as required by law. Fluor confirms that the requirements of the Political Activities Policy were followed in the making of these contributions, and all contributions by Fluor and FLUORPAC are the subject of legal and compliance review. This includes: • $140,000 Given By The American Crystal Sugar Company PAC To Members Of The Caucus. • $120,000 Given By Minority Leader Kevin McCarthy’s Majority Committee PAC To Members Of The Caucus • $41,000 Given By The Space Exploration Technologies Corp. PAC – the PAC affiliated with Elon Musk’s SpaceX company. Also among the top PACs are Lockheed Martin, General Dynamics, and the National Association of Realtors. Duke Energy and Boeing are also on this list despite these entity’s public declarations in January aimed at their customers and shareholders that were pausing all donations for a period of time, including those to members that voted against certifying the election. The leaders, companies and trade groups associated with these PACs should have to answer for their support of lawmakers whose votes that fueled the violence and sedition we saw on January 6. However, we are becoming increasingly concerned about looming cuts facing many specialists, which are expected to go into effect beginning on January 1, 2021. On December 1, 2020, the Centers for Medicare and Medicaid Services’ (CMS) published the final rule for the CY2021 Medicare Physician Fee Schedule, which increased rates for the office-based evaluation and management (E/M) code set in CY2021. Due to the requirement for budget neutrality, this will result in sizable cuts for over thirty healthcare specialties. While we are supportive of the increases for the office-based E/M code set, the resulting cuts are ill-conceived in the middle of a pandemic. Even without these cuts, too many practices are struggling, even as patients need access to health care now more than ever. We are aware of solutions to either waive budget neutrality requirements (H.R. 8505) or to hold specialists harmless (H.R. 8702). While not perfect, either of these solutions would give healthcare specialists the financial security they need to weather the COVID-19 pandemic.
