WESTERN CAPE DEPARTMENT OF HEALTH REGULATIONS RELATING TO THE PROCEDURES FOR THE NOMINATION OF MEMBERS FOR APPOINTMENT TO BOARDS AND COMMITTEES, 2017 INVITATION TO NOMINATE MEMBERS TO COMMITTEES FOR PRIMARY HEALTH CARE FACILITIES

1. The Provincial Minister of Health in the Western Cape, under regulation 2 of the Regulations Relating to the Procedures for the Nomination of Members for Appointment to Boards and Committees, 2017, invites bodies representative of the community or communities served by the primary health care facility or facilities listed in Annexure A (“nominating bodies”) to submit nominations of persons to be considered for appointment as members of Committees under section 6 of the Western Cape Health Facility Boards and Committees Act, 2016 (Act 4 of 2016)(“the Act”), for the primary health care facility or facilities concerned.

2. Section 7 of the Act provides that to be eligible for appointment as a member, the person must— (a) be a South African citizen; (b) be older than 18 years; (c) not be an unrehabilitated insolvent; (d) not, at any time, have been convicted of— (i) an offence for which he or she was sentenced to imprisonment without the option of a fine; or (ii) theft, fraud, forgery, the uttering of a forged document, perjury, any offence in terms of the Prevention and Combating of Corrupt Activities Act, 2004 (Act 12 of 2004), or any offence of which dishonesty is an element, whether in the Republic or elsewhere if the conduct constituting the offence would be an offence in the Republic; (e) demonstrate commitment to community service; (f) demonstrate support for the mission and values of the health facility concerned; and (g) demonstrate a high level of personal integrity and honesty.

3. Nominations must include the following information: (a) the name of the health facility or facilities for which the nomination is made; (b) details of the nominating body and its constitution or other founding document; (c) the full name and address of the nominee; (d) a signed copy of the nominee’s curriculum vitae; (e) an indication whether the nominee is a member of the nominating body and, if so, the length of the nominee’s membership and, if the nominee is not a member, why the body nominates that person; (f) the nominating body’s reasons for considering the nominee suitable to be a member of the Committee; (g) a declaration by the nominee of his or her willingness to be a member of the Committee.

4. Nominating bodies and nominees must take note that— (a) the Provincial Minister will make the appointments in accordance with section 6 of the Act; (b) the position of a member is a voluntary one with no remuneration attached to it; (c) members may, however, be reimbursed for transport expenses incurred as a result of attending meetings. 5. The closing date for nominations for all the primary health care facilities, other than primary health care facilities listed for the City of Cape Town, is 28᩿February 2018. 6. The closing date for nominations for the primary health care facilities listed for the City of Cape Town is 9 March 2018. 7. Nominations must be addressed and delivered to the contact person listed in Annexure B. Nominations for the City of Cape Town may be delivered to the contact person listed in Annexure B or delivered to the nearest primary health care facility by placing it in the Committee nomination box. 8. WES-KAAPSE DEPARTEMENT VAN GESONDHEID REGULASIES BETREFFENDE DIE PROSEDURES VIR DIE BENOEMING VAN LEDE VIR AANSTELLING IN RADE EN KOMITEES, 2017 UITNODIGING OM LEDE TE BENOEM VIR KOMITEES VIR PRIMÊREGESONDHEIDSORGFASILITEITE

1. Die Provinsiale Minister van Gesondheid, ingevolge Regulasie᩿2 van die Regulasies Betreffende die Prosedures vir die Benoeming van Lede vir Aanstelling in Rade en Komitees, 2017, nooi liggame uit wat verteenwoordigend is van die gemeenskap of gemeenskappe wat deur die primêregesondheidsorgfasiliteit of -fasiliteite gelys in Bylae᩿A bedien word (“benoemende liggame”) om benoemings in te dien van persone vir oorweging vir aanstelling as lede van Komitees ingevolge artikel᩿6 van die Wes-Kaapse Wet op Rade en Komitees vir Gesondheidsfasiliteite, 2016 (Wet᩿4 van 2016)(“die Wet”), vir die betrokke primêregesondheidsorgfasiliteit of -fasiliteite.

2. Artikel᩿7 van die Wet bepaal dat, om vir aanstelling as ’n lid te kwalifiseer, ’n persoon— (a) ’n Suid-Afrikaanse burger moet wees; (b) ouer as 18 jaar moet wees; (c) nie ’n ongerehabiliteerde insolvent mag wees nie; (d) nie, te eniger tyd, skuldig bevind mag gewees het nie aan— (i) ’n oortreding waarvoor hy of sy tot gevangenisstraf sonder die keuse van ’n boete gevonnis is; of (ii) diefstal, bedrog, vervalsing, die in omloop bring van ’n vervalste dokument, meineed, enige misdryf ingevolge die Wet op die Voorkoming en Bestryding van Korrupte Bedrywighede, 2004 (Wet᩿12 van 2004), of enige misdryf waarvan oneerlikheid ’n element is, hetsy in die Republiek of elders indien die optrede wat die oortreding uitmaak, ’n oortreding in die Republiek sal wees; (e) toewyding tot gemeenskapsdiens toon; (f) steun toon vir die missie en waardes van die betrokke gesondheidsfasiliteit; en (g) ’n hoë vlak van persoonlike integriteit en eerlikheid toon.

3. Benoemings moet die volgende inligting bevat: (a) die naam van die gesondheidsfasiliteit of -fasiliteite waarvoor die benoeming gemaak is; (b) besonderhede van die benoemende liggaam en sy grondwet of ander stigtingsdokument; (c) die volle naam en adres van die benoemde; (d) ’n ondertekende afskrif van die benoemde se curriculum vitae; (e) ’n aanduiding of die benoemde ’n lid van die benoemende liggaam is en, indien wel, die lengte van die benoemde se lidmaatskap en, indien die benoemde nie ’n lid is nie, waarom die liggaam daardie persoon benoem; (f) die redes waarom die benoemende liggaam die benoemde as geskik beskou om ’n lid van die Komitee te wees; (g) ’n verklaring deur die benoemde van sy of haar bereidwilligheid om ’n lid van die Komitee te wees.

4. Benoemende liggame en benoemdes moet kennis neem dat— (a) die Provinsiale Minister aanstellings ooreenkomstig artikel᩿6 van die Wet sal maak; (b) die posisie van ’n lid ’n vrywillige een is met geen vergoeding daaraan verbonde nie; (c) lede mag egter vergoed word vir vervoerkostes aangegaan as gevolg van hul bywoning van vergaderings.

5. Die sluitingsdatum vir alle primêregesondheidsorgfasiliteite, buiten gesondheidsorg-fasiliteite gelys vir die Stad Kaapstad, is 28 Februarie 2018.

6. Die sluitingsdatum vir benoemings vir primêregesondheidsorgfasiliteite wat vir die Stad Kaapstad gelys is, is 9 Maart 2018.

7. Benoemings moet gerig word aan en afgelewer word by die kontakpersoon wat in Bylae B gelys word. Benoemings vir die Stad Kaapstad kan afgelewer word by die kontakpersoon wat in Bylae᩿B gelys word of by die naaste primêregesondheidsorgfasiliteit deur dit in die Komitee-benoemingsboks te plaas.
