ગજ રાત ખાનગી યવ નિવસિટી (દ્વિતીય સધ ારા) વિધેયક, ર૦૧૯.

ગજ રાત ખાનગી યવ નિવસિટી અવધવનયમ, ૨૦૦૯ િધ સધ ારિા બાબત વિધેયક.

ચારૂતર વિદ્યા મંડળ, િ쫍લભ વિદ્યાનગર અને સમતા લોકસંસ્થાન , િડોદરા-એ સન ૨૦૦૯નો ગજ રાતનો રા狍યમાં ખાનગી યવુ નિવસિટીઓ સ્થાપિા માટે, ગજુ રાત ખાનગી યવુ નિવસિટી ૮મો. અવિવનયમ, ૨૦૦૯ની જોગિાઇઓ હઠે ળ રા狍ય સરકારને અરજી કરી છે;

, અને ચકાસણી સવમવતએ સદરહુ અરજીઓની ચકાસણી કરેલી છે અને ચકાસણી

સવમવતના અહિે ાલ પરથી, રા狍ય સરકારે, ખાનગી યવુ નિવસિટીની સ્થાપના કરિા માટે, સબં વં િત પરુ સ્કતાા મડળનેં ઇરાદાપત્ર કાઢી આપ્યો છે;

અને રા狍ય સરકારને ખાતરી થઇ છે કે સદરહુ અવિવનયમની કલમ ૧૦માં

છે અને ુڂ જોગિાઇ કયાા પ્રમાણે, પરુ સ્કતાા મડં ળ-એ ઇરાદાપત્રની શરતોન ું પાલન કય ઇરાદાપત્ર પ્રમાણેન ું દેણગી ફડં પણ સ્થાપ્ય ું છે;

, , , તેથી હિે ગજુ રાત સરકાર સદરહુ અવિવનયમની કલમ ૧૦ની જોગિાઇઓ , અનસુ ાર સદરહુ અનસુ ચૂચના કોલમ ૪મા ં વનર્દિષ્ટ કયાા પ્રમાણેના ઉપયકાુ ત પરુ સ્કતાા

મંડળના નામે અને સ્થળે, અનસુ ચૂચના કોલમ ૨-મા ં વનર્દિષ્ટ કરેલી સસ્ં થાઓનો ખાનગી

યવુ નિવસિટી તરીકે સમાિશે કરે છે.

આથી, ભારતના ગણરા狍યના વસત્તેરમા િર્ામાં નીચેનો અવિવનયમ કરિામાં

આિે છે:-

ટુંક ી સજ્ઞું ા ૧. (૧) આ અવિવનયમ ગજુ રાત ખાનગી યવુ નિવસિટી (દ્વિતીય સિુ ારા) અને આરુંભ. અવિવનયમ, ૨૦૧૯ કહિે ાશે.

(૨) તે, રાજય સરકાર, રાજપત્રમા ં જાહરે નામાથી, નક્કી કરે તેિી તારીખ ે અમલમાં આિશે.

સન ૨૦૦૯ના ૨. ગજુ રાત ખાનગી યવુ નિવસિટી અવિવનયમ, ૨૦૦૯માં, અનસુ ચૂચમા,ં - સન ૨૦૦૯નો ગજ રાતના ૮મા ગજ રાતનો , અવધવનયમની (૧) અનક્રુ માકં ૩ ઉપરની ન⺂િને બદલે નીચેની ન⺂િ મ ૂકિીીઃ- ૮મો.

ઉેશો અને કારણો

રાજય સરકારે, ગણુ િત્તાસભર અને ઉદ્યોગલક્ષી ઉ櫍ચ વશક્ષણ પરૂ ંુ પાડિાના હતે થુ ી, રાજયમા ં ખાનગી યવુ નિવસિટીઓની સ્થાપના કરિા માટેની જોગિાઈ કરિા માટે અને અવિવનયમની જોગિાઇઓ અનસુ ાર તેના કાયોન ું વનયમન કરિા માટે, ગજુ રાત ખાનગી યવુ નિવસિટી અવિવનયમ, ૨૦૦૯ (સન ૨૦૦૯નો ગજુ રાતનો ૮મો) અવિવનયવમત , કયો છે. સદરહુ અવિવનયમ હઠે ળ તે તરીકે જાહરે કરેલી ખાનગી યવુ નિવસિટીએ સદરહ ુ અવિવનયમની જોગિાઇઓ મજુ બ યવુ નિવસિટીની બાબતોનો િહીિટ કરિાનો હોય છે ગ બોડી, બોડા ઓફ મેનેજમેન્ટ, એકેડવે મક કાઉન્ન્સલ અને એિા બીજાﺂઅને ગિવન , અવિકારીમંડળો-એ સદરહુ અવિવનયમમા ં જોગિાઇ કયાા પ્રમાણેની તેમની ફરજો બજાિિાની હોય છે અને તેમના કાયો કરિાના હોય છે તથા એિા મંડળોની રચના,

સદરહુ અવિવનયમમા ં જોગિાઇ કયાા મજુ બની હોિી જોઇશે.

કેલોક્ષ યવુ નિવસિટીના હાલના નામન ું ઉ櫍ચારણ કરં ું સામાન્ય જનતા માટે થોંુ ં

મશ્ુ કેલ બને છે, 狇ના કારણે, યવુ નિવસિટીના નામનો ઉ櫍ચાર ‘‘કાલરોક્ષ’’, ‘‘કાલોરાક્ષ’’

િગેરે 狇િી અલગ-અલગ રીતે કરિામાં આિે છે. આથી, કેલોક્ષ યવુ નિવસિટીના પરસ્કતાાુ

મંડળે, તેમની યવુ નિવસિટીન ું નામ, સામાન્ય રીતે સામાન્ય વ્યન્તતને સ્િીકાયા હોય તેં ,ું

‘‘સાબરમતી યવુ નિવસિટી’’ રાખિા માટે, રા狍ય સરકારને વિનંતી કરી છે. વિિેયકની

કલમ ૨ (૧)થી તે ᚂગેની જોગિાઈ કરી છે.

િધમુ ા,ં રા狍ય સરકારને, અનક્રુ મે ચારૂતર વિદ્યા મડં ળ, િ쫍લભ વિદ્યાનગર અને સમતા લોક સંસ્થાન, િડોદરા તરફથી ખાનગી યવુ નિવસિટીઓ તરીકે દરખાસ્તો મળી છે. સદરહુ અવિવનયમની કલમ ૧૦થી એિી જોગિાઇ કરી છે કે રાજય સરકારને એિી છે, તો પછી રાજય ુڂ ખાતરી થાય કે પરુ સ્કતાા મડં ળે, ઇરાદાપત્રની શરતોન ું પાલન કય , સરકારે સદરહુ અવિવનયમની અનસુ ચૂચમા ં યવુ નિવસિટીના નામનો સમાિેશ કરિા માટે , યો廍ય કાયદો લાિિાનો હોય છે. સદરહુ દરખાસ્તોની સદરહુ અવિવનયમની કલમ ૮ હઠે ળ વનમાયેલી ચકાસણી સવમવતએ વિચારણા કરી છે અને સવમવતએ તેનો ર્રપોટા રાજય સરકારને રજૂ કયો છે અને એિા ર્રપોટાના આિારે, રાજય સરકારે, (પોતાને) ખાતરી થયા પછી, અવિવનયમની કલમ ૯ હઠે ળ જોગિાઇ કયાા પ્રમાણે ઇરાદાપત્ર કાઢી , હોિાથી સદરહુ ુڂ આપ્યો છે અને પરુ સ્કતાા મડં ળોએ ઇરાદાપત્રની શરતોન ું પાલન કય

અવિવનયમની કલમ ૧૦ હઠે ળ જોગિાઇ કયાા પ્રમાણે અવિવનયમની અનસુ ચૂચમા ં યવુ નિવસિટીઓના નામોનો સમાિેશ કરિાન ું જરૂરી જણાય ું છે.

THE GUJARAT PRIVATE UNIVERSITIES (SECOND AMENDMENT) BILL, 2019.

GUJARAT BILL NO. 25 OF 2019.

A B I L L

further to amend the Gujarat Private Universities Act, 2009.

WHEREAS the Charutar Vidya Mandal, Vallabh Vidyanagar and Samata Lok Sansthan, Vadodara have applied to the State Government under Guj. 8 of the provisions of the Gujarat Private Universities Act, 2009 to establish 2009. Private Universities in the State; 2

AND WHEREAS the said applications have been scrutinised by the Scrutiny Committee and on report of the Scrutiny Committee, the State Government has issued the Letter of Intent to the respective sponsoring body for establishment of the Private University;

AND WHEREAS the State Government is satisfied that the sponsoring bodies have complied with the conditions of Letter of Intent as provided in section 10 of the said Act and have also established the Endowment Fund as per the Letter of Intent;

NOW, THEREFORE, the Government of Gujarat, in accordance with the provisions of section 10 of the said Act, includes the institutions specified in column 2 of the Schedule as a Private University, by the name and location of the aforesaid sponsoring bodies as specified in column 4 of the said Schedule.

It is hereby enacted in the Seventieth Year of the Republic of India as follows:-

Short title and 1. (1) This Act may be called the Gujarat Private Universities (Second commencement. Amendment) Act, 2019.

(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Amendment of 2. In the Gujarat Private Universities Act, 2009, in the Schedule,- Guj. 8 of Schedule to 2009. Guj. 8 of 2009. (i) for the entry at serial No. 3, the following entry shall be substituted,

STATEMENT OF OBJECTS AND REASONS

The State Government has enacted the Gujarat Private Universities Act, 2009 (Guj. 8 of 2009) to provide for establishment of Private Universities in the State so as to provide for qualitative and industry related higher education and to regulate their functions in accordance with the provisions of the Act. A private University declared as such under the said Act is required to administer the affairs of the University as per the provisions of the said Act and the Governing Body, the Board of Management, the Academic Council and such other authorities are required to perform their duties and discharge their functions as provided in the said Act and the constitution of such bodies shall be as provided in the said Act.

As the present name of the “Calorx” University is a bit difficult for general public to pronounce which leads to the name of the University being pronounced in different manner as “Kalroksh”, “Kaloraksh”, etc. Therefore, the sponsoring body of the Calorx University has requested the State Government to have their University name as the Sabarmati University which shall be generally acceptable to a common man. Clause 2(i) of the Bill provides for the same.

Further the State Government has received the proposals from the Charutar Vidya Mandal, Vallabh Vidyanagar and Samata Lok Sansthan, Vadodara, respectively as the Private Universities. Section 10 of the said Act provides that if the State Government is satisfied that the Sponsoring Body has complied with the conditions of Letter of Intent, then, the State Government is required to bring appropriate legislation for inclusion of the name of the University in the Schedule to the said Act. The said proposals have been considered by the Scrutiny Committee appointed under section 8 of the said Act and the Committee has submitted its report to the State Government and on the basis of such report, the State Government has, having been satisfied, issued a Letter of Intent as provided under section 9 of the Act and since the sponsoring bodies have complied with the conditions of the Letter of Intent, it is considered necessary to include the names of the Universities in the Schedule to the Act as envisaged under section 10 of the said Act.

This Bill seeks to amend the said Act to achieve the aforesaid object.

This Bill involves delegation of legislative power in following respect:-

Clause 1.- Sub-clause (2) of this clause empowers the State Government to appoint, by notification in the Official Gazette, the date on which the Act shall come into force.
