Since 1893, by statute these are the words on the “Great Seal of the State of Montana.” MCA § 1-1-501 (En. Sec. 1, p. 42, L. 1893). The past, present and future of the Treasure State is encapsulated in this seal, which shows in its center “a plow and a miner’s pick and shovel,” on its left the “Great Falls of the Mis- souri River,” and on its right “mountain scenery.” Id. Amici Curiae BSF OPOQSPmU .POUBOB USBEF BTTPDJB tions with members engaged in all aspects of busi- ness, the Great Seal’s center, including members who continue to produce “oro y plata” and the other “treasure” that forms such a critical part of the story of this Last Best Place.2 The federal government has long played a role here as well, with the Comprehen- sive Environmental Response, Compensation, and Liability Act (CERCLA) becoming in the late 20th century part of the complicated equation that is Montana. Amici, concerned with balancing all inter- ests represented on Montana’s Great Seal, concur with Petitioner that the Montana Supreme Court de- cision at issue is poised to throw this balance “into chaos,” and ask this Court to grant the petition and reverse the Montana court’s dangerous misinterpre- tation and misapplication of CERCLA. 1 Pursuant to this Court’s Rule 37.2(a), counsel of record for all parties received timely notice of amici’s intent to file this brief and consented to it. TSRA’s members include mining and mineral production companies, transportation com- panies, unions, energy companies, water users and others (including PRPs at some of the 17 Superfund sites in Montana), all vitally interested in the con- TJTUFODZ DFSUBJOUZ mOBMJUZBOEBCJMJUZUPQMBOGPSSJTL provided by CERCLA, a comprehensive federal envi- ronmental scheme that precludes and preempts TUBUFMBXUPSUDMBJNTUIBUDPOnJDUBOEJOUFSGFSFXJUI federal cleanups and the federal statute’s rules, re- quirements and protections. TSRA is concerned that the decision below, which misreads and wrongly re- fuses to apply CERCLA’s jurisdictional and litiga- tion limits will result in the very type of chaos and inconsistency that is the bane of its members’ ability to function and prosper. These minerals include copper, garnets, gold, lime, manganese, molybdenum, nickel, palladium, platinum, silver, talc and zinc. MMA’s purpose is to be an advocate for its members, who as important contributors to the state’s economic fabric dating back to Montana’s territorial days, help pro- vide the necessary materials for our everyday lives, along with affording countless Montana families and graduates from local universities the opportunity to 3 prosper from well-paying employment. One of MMA’s primary functions is to share the compelling story of the industry’s history in Montana, a perspec- tive that is often left unsaid and unheard today, and which, as amicus, MMA can bring to the attention of the Court. Amicus Montana Petroleum Association (MPA) represents another sector of industry in Montana, i.e., members who explore and produce oil and natu- SBMHBT XIPPQFSBUFQJQFMJOFT BOEXIPSFmOFQFUSP MFVNQSPEVDUT"OPOQSPmUGPDVTFEPONBJOUBJOJOH a positive business climate in Montana for its mem- bers, MPA shares the concerns of its fellow voluntary trade associations that the decision of the Montana Supreme Court allowing tort claims to interfere with and supersede remedial actions carried out under the orders and auspices of a federal regulatory agency like EPA, is a recipe for disaster for business, includ- ing the petroleum industry. The Montana Chamber of Commerce (MCC) of- ten serves as amicus curiae in a wide variety of cases involving business in Montana, sometimes in tandem with the national Chamber of Commerce, which is also an amicus curiae in this matter.     Miners, managers, and machines : industrial accidents and occupational disease in the Butte underground, 1880-1920 by Brian Lee Shovers A thesis submitted in partial fulfillment of the requirements for the degree of Master of Arts in History Montana State University © Copyright by Brian Lee Shovers (1987) Abstract: Between 1880 and 1920 Butte, Montana achieved world-class mining status for its copper production. At the same time, thousands of men succumbed to industrial accidents and contracted occupational disease in the Butte underground, making Butte mining significantly more dangerous than other industrial occupations of that era. Three major factors affected working conditions and worker safety in Butte: new mining technologies, corporate management, and worker attitude. The introduction of new mining technologies and corporate mine ownership after 1900 combined to create a sometimes dangerous dynamic between the miner and the work place in Butte. While technological advances in hoisting, tramming, lighting and ventilation generally improved underground working conditions, other technological adaptations such as the machine drill, increased the hazard of respiratory disease. In the end, the operational efficiencies associated with the new technologies could not alleviate the difficult problems of managing and supervising a highly independent, transient, and often inexperienced work force. With the beginning of the twentieth century and the consolidation of most of the major Butte mines under the corporate entity of Amalgamated Copper Company (later the Anaconda Copper Mining Company), conflict between worker and management above ground increased. At issue were wages, conditions, and a corporate reluctance to accept responsibility for occupational hazards. The new atmosphere of mistrust between miners and their supervisors provoked a defiant attitude towards the work place by workers which increased the potential for industrial accidents.

    Copper kings, populists and log-rollers : the third session of the Montana State Legislature, 1893 by Jean Marie Schmidt A thesis submitted in partial fulfillment of the requirements for the degree of MASTER OF ARTS in History Montana State University © Copyright by Jean Marie Schmidt (1981) Abstract: The 1893 session of the Montana legislature deserves close study because of its long-term effects upon the state, All of the issues that made Montana politics especially- turbulent in the years immediately following statehood were present in this session: the rivalry between mining kings William A, Clark and Marcus Daly, the contest over the permanent location of the state capital, Clark's campaign to be elected to the United States Senate, labor's demands for protective legislation, the rise of Populism, and the national debate over the free coinage of silver. In spite of these distractions, the legislature had a great deal of work to do. The unproductive first and second sessions had passed on a number of unfinished tasks-, some as simple as designing an offical seal for the new state, others as complex as creating its higher education system. The Popultsts held the balance of power in the House of Representatives and helped pass some laws favorable to labor, but were blamed afterwards for not accomplishing more. The joint assembly was deadlocked throughout the session and failed to elect a United States Senator, leaving one of Montana's Senate positions vacant for two years while the repeal of the Sherman Silver Purchase Act was debated in Congress. The action of this legislature that had the most lasting consequences for the state was the distribution of the state's educational and custodial institutions in separate towns.
