Sr. No. 1 to 19 - File No. 87 to 88 and 90 to 106. Stone Quarries Situated in Forest Land at Thane and Navi Mumbai. Adivali-Bhutavali, Shil, Kausa-Mumbra, Bhandarli, I Shilsaon. Chinchwali All proposal in serial no I to 19 are fatling under forest land which already have obtained Forest NOC with validity period of 20 years. During site visit dated 03'd October 2018, it is noted that all the quarries are located adjoining to some other quarries on the single or different hillock. Committee felt that during operation phase of these quarries, the environment will be adversely affected. As per S.O. 141@) Dated 15th January,2016,, a cluster shall be formed when the distance between the peripheries of one lease is less than 500 meters from the periphery of other lease in a homogenous mineral area. While as per Appendix -XI of S.O. 14f (E) Dated 15"' January, 2016 pubtished by MoEF, the quarrying activity with cluster of mine leases of area >25 ha with individual leases size < 50 Ha are to be considered as Category B-1. As per tf,-e directive given by DEAC in the 2nd meeting Dated l't June 2017rand communication dated 06.10.2017 received from SEAC-I regarding previous similar cases, the exclusion Ministry of Environment, Forest and 'Cli-ut"provided in the Notification dated OllOTl2OlT issued by the Change for the leases or quarry licenses granted before 9th September, 2013 for being not treated as cluster and the appraisal of the Environment Impact to be considered by the DEAC

Therefore, DEAC thane is considering the aforesaid proposals for recommendations over Environmental clearance of Mining leases. During the DEAC site visit dated 03/10/2018, Range officer of forest department was directed by committee members to provide details of Sr.No. I to t9 in respect of distance from high tension line, nearest habitation, tunnel, Pipeline, Water reservoir, Dam etc.

DEAC committee sent letter to forest department vide dated 06.10.2018 for the safe distance for protection of environment and the people living at nearest habitat and their safety. Also, for the sustainable mining in homogenous hill, particularly in Digha region forest department must verifo the same, before imitating the quarry operation.

It is observed that, the concemed officers ofForest Department shall ensure the protection of the forest and green belts situated in the Forest land and expeditiously report damage, if any to DEAC and DEIAA. The leamed During the DEAC 9th meeting Asst. Conservator of Forest, Thane has informed that as per their records, there is balance area for mining activity in each proposal. As per Agenda Sr. no. I to 19 & and 2l written communication will be forwarded to the committee shortly in respect of balance area for mining. The said statement of learned Asst. Conservator of Forest, Thane is accepted.

Considering the above factors, following action plans are recommended. a) Comprehensive Environment Management Plan shall be prepared considering all the environmentally affecting factors, including Industries, Quarrying/Crushers, Vehicular and or any other factors, in consultation with MPCB, Forest and Mining Department. b) Action plan on implementation of EMP shall be prepared. c) Monitoring Mechanism shall be put in place involving concemed authorities of MPCB and Forest. d) Independent third party periodic monitoring on implementation of action plan on implementation of EMP. e) The proposal of quarry sr. no. 17 Sanjay stone Quarry as per Asst. Conservator of Forest, Thane. Human Habitation nearby 140 mtrs. I The proposal of quarry sr. no. 16, 17 & 19 viz. Bombay Stone Quarry, Sanjay Stone Quarry & Patel Stone Quarry, the committee recommends to take NOC from M.S.E.B. Board for High power tension line ofelectricity supply.

In view of above said observations and recommendations, DEAC is here by recommending the 19 cases for Environment Clearance to DEIAA for Consideration.

During site visit it was noted that, the quarry site is fulfilling distance criteria from proposed lease boundary. No Protected areas are identified within 10 km radius from project site and is complying all requisite regulations. Considering above and approved mining plan from DGM office, Committee decided to recommend the proposal for further appraisal to DEIAA, Thane subject to conditions stipulated in (Annexure-l)

Shyam Sunder Stone lndustries Located at Survey no. 177 part, Chikhloli-Village, Tahsil-Ambernath Dist : Thane. Forest Land. Area 1.00 Ha. During the DEAC meeting, Learned Asst. Conservator of Forest, Thane has informed that as per records available with RFO, This site is not situated very near to habitation. The said statement is accepted. Considering the above and approved Mining Plan for dy. Director Geology & Mining Dept. Kolhapur. Committee decided to recommend the proposal for further appraisal to DEIAA, Thane subject to conditions stipulated in (Annexure-l)

Sr. No. 22File No. 109 Sou. Jayshree Dinesh Patil Located at Survey no.7713 A (P), Kunde-Village, Tahsil- Kalyan Dist : Thane. Pvt Land. Area 1.00 Ha. The proposal was differed for site visit in 8th DEAC, Thane Meeting. The site visit was conducted on 03.10.2018. During site visit it was noted that, it is a new quarry with no hilly slope. The quarry site is fulfilling distance criteria from proposed lease boundary. No Protected areas are identified within 10 km radius from project site. It was noted that electric transmission line is present at distance of 250 meters, therefore committee suggest to adopt control blasting method during mining of stone minerals. Since it is a new quarry, plantation shall be done along the periphery of the quarry site and the details of greenbelt development shall be submitted to the committee along with half yearly compliance reports. Considering above and approved mining plan from DGM office, Committee decided to recommend the proposal for further appraisal to DEIAA, Thane; subject to conditions stipulated in (Annexure-l)

Ek Tu Hi Nirankar Enterprises Located at Survey no. 5812, Kamba -Village, Tahsil- Kalyan Dist : Thane. Pvt Land. Area 3.20 Ha.

The proposal was differed for site visit in 8th DEAC, Thane Meeting. The site visit was conducted on 03.10.2018. During site visit it was noted that, many adjacent quarries are present along with lease boundary of the project. The quarries present near to the proposed project have already obtained EC form SEAC-I, Maharashtra on 30th November 2012. Therefore the proposed operation doesn't fall under cluster situation.

During the visit, the Committee members observed that hill cutting is involved in current operation of the project, while the quarry site is fulfilling distance criteria from proposed lease boundary and No Protected areas are identified within l0 km radius from project site. Considering above and approved mining plan from DGM office, committee decided to recommend the proposal for further appraisal to DEIAA, Thane subject to conditions stipulated in (Annexure-l)

Sr. No. 24 Fite No. 106 -A M/s. Sainath Stone Crusher Located at Survey no. 91/3C, 3D, 3E & 3F (Part), Kamba Village, Tahsil- Kalyan Dist : Thane. P'v"t Land. Area 1.41.5 Ha.

The proposal was deffered for site visit in 8ft DEAC, Thane Meeting. The site visit was conducted on 03.10.2018. During site visit it was noted that, many adjacent quarries are present along with lease boundary of the project. The quarries present near to the proposed project have already obtained EC form SEAC-I, Maharashtra. Therefore the proposed operation doesn't fall under cluster situation. Committee observed that crusher activity will be involved close to quarry site and slight hill cutting will be involved in proposed operation of the project. Along with above, the quarry site is fulfilling distance criteria from proposed lease boundary and No Protected areas are identified within 10 km radius from project site. Considering above and approved mining plan from DGM office, Committee decided to recommend the proposal for further appraisal to DEIAAT Thane subject to conditions stipulated in (Annexure-1). Further, the Committee also suggests maintaining greenbelt while fulfilling all general conditions mentioned in their CTO accorded by MPCB.

The proposal was differed for site visit in 8th DEAC, Thane Meeting. The site visit was conducted on 03.10.2018. During site visit it was noted that, the quarry site is fulfilling distance criteria from proposed lease boundary and No Protected areas are identified within 10 km radius from project site. Apart from this, crusher activity will be involved close to quarry site. It was also noted that road connecting to the quarry site are passing through the nearest habitation/village located at aerial distance of 500 meters from the quarry site. Considering above and approved mining plan from DGM office, Committee decided to recommend the proposal for further appraisal to DEIAA, Thane subject to conditions stipulated in (Annexure-l) and to provide water sprinkling system at project site and roads to avoid dust nuisance in nearby areas and to maintain thick greenbelt along with project boundary.

The Committee directed the Project proponents/ Applicants to produce No-objection Certificate from the Competent Authority of the Tungareshwar Wildlife Sanctuary. The Application for EC in respect of this site will be considered only after submission of the said NOC by the Applicant. Till then proposal is kept in abeyance.

The Committee directed the Project proponentsi Applicants to produce No- objection Certificate from the Competent Authority of the Tungareshwar Wildlife Sanctuary. The Application for EC in respect of this site will be considered only after submission of the said NOC by the Applicant. Till then proposal is kept in abeyance.

The Application for EC in respect of this site will be considered only after submission of the said NOC by the Applicant. Till then proposal is kept in abeyance.

11 The Specific and General conditions applicable for Mining of Stone: Specific conditions:

Provisions stipulated in Maharashtra Minor Minerals Extraction (development and Regulation) Rules 2013 shall be strictly adhered to. Project Proponent will be held responsible personally for noncompliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986.

3. To prevent dust / particulate matter pollution, the lease holder shall take up tree plantation in an area 20 m from the boundary of the leased area and also on either side of the road leading to quarry site.

Project proponent to ensure that there is no violation of the Supreme Coua/ NGT court order given in related matters. Project proponent shall prepare "Final Mine Closure Plan" and get it approved by the competent authority for all abandoned mines in the District.

Ground Tooth data (primary) and secondary (athletic data) on flora and fauna ofcore Zone and Buffer Zone should be provided by Project Proponent or consultants the data must be classified .u into different schedules as per Indian Wild Life Protection Act.

7. The environmental clearance shall be granted subject to the directions proposed to be given by MoEF&CC and SEAC/SEIAA, Maharashtra Govt in respect to NGT order M.A. No. 98112016, M.A. No.982/2016 & M.A. No.384/2017 (Item Nos 7 to 14) dated 13th September 2018.

1. Precise mining area and land belong to which Authority will be jointly demarcated at site by officials of Mining,{Revenue department prior to mining operations for all proposals under consideration. Such site plan, duly verified by competent authority shall be submitted to DEAC,DEIAA Committee.

2. All necessary statutory clearances shall be obtained before start of mining operations.

3. Mining / loading shall be limited to day hours' time only. The quarrying / loading shall not be done during night hours.

4. No mining shall be carried out in the safety zone ofany bridge and/or embankment.

5. No mining shall be carried out in the vicinity of natural/ manmade archeological sites. 6. The lease holder shall obtain necessary prior permission ofthe competent authorities to drawl the requisite quantity of water (surface water and groundwater), if required for the project.

7. Waste water, if any, shall be properly collected and heated so as to conform to the standards prescribed by MoEF/CPCB.

8. No wildlife habitat should be infringed.

9. Where, the quarrying in a hilly terrain, cutting shall be allowed only in the recharge zone to be identified by the offrcials of GSDA.

10. Environmental clearance is subject to obtain clearance under the Wildlife (Protection) Act, 1972 from the competent authority, ifapplicable to this project.

11. Green belt development shall be canied out considering CPCB guidelines including selection of plant species suitable to existing eco system in consultation with the DFO/Horticulture Officer.

12. Parking of vehicles should not be made on public places. 13. Transportation of materials shall be done by covering the trucks / tractors with tarpaulin or other suitable mechanism so that no spillage of mineral/dust takes place.

14. Appropriate mitigation measures shall be taken PP and Environment consultants to prevent any kind of pollution in consultation with the M.P.C.B. It shall be ensured that there is no leakage ofoil and grease from the vehicles used for transportation. And privative measure about Noise, Air and Water.

15. Vehicular emissions shall be kept under control and regularly monitored. The mineral shall not be overloaded.

16. Special Measures shall be adopted to prevent the impact of Mining activities on the nearby settlements.

17. Maintenance ofroads through which transportation of minor minerals is to be undertaken, shall be carried-out regularly.

18. Dispensary facilities for firslaid shall be provided at site.

19. Occupational health surveillance program ofthe workers should be undertaken periodically.

20. Provision shall be made for housing the workers at site, if required, with all necessary infrastructure and welfare facilities such as fuel for cooking, safe drinking water, medical health care and sanitation etc. V Member Secretary d" DEAC, Thane 21. Ambient air quality will be monitored at the site and the nearest habitation during pre monsoon and post monsoon. Or if required by committee Ambient air quality at the boundary of the precise mining area shall conform to the norms prescribed by MoEF, GOL

22. Measures shall be taken for control of Air, Water and Noise levels to the limits prescribed by CPCB.

23. An Environmental Audit shall be annually carried out during the operational phase and be submitted to DEAC,DELAA Committee.

24. Digital processing of the entire lease area in the district using remote sensing technique shall be done regularly once in three years for monitoring and report submitted to DEAC/DEIAA Committee. The funds earmarked for environmental protection measr.res shall be kept in separate account and shall not be diverted for other purposes. Year wise expenditure on environmental protection measures shall be reported to the DEAC/DEIAA Committee. 25. Authorities shall submit within 3 months their policy of (D Standard operating process/ procedure to bring into focus any infringement/deviation /violation of environmental norms /conditions, (ii) Hierarchical system or Administrative order to deal with environmental issues and to ensure compliance of EC conditions and (iii) System of reporting of noncompliance /violation of environmental norms to DEAC/DEIAA Committee.

26. The Project proponent or consultants shall submit six monthly reports in hard and soft copy on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard & soft copies) to the DEAC/DEIAA Committee. And the resp€ctive Regional Office of the Maharashtra Pollution Control Board.

27. Arry change in mining area, survey no/khasra /Gat numbers, entailing capacity addition with change in process and or mining technology, modemization and scope of working shall again require prior Environmental Clearance as per provisions of EIA Notification, 2006 (as amended).MOEF CC Notification- dated l5,January 2016 and MoEF CC amendment lth July 2016.

28. In case of black stone quarries benches should be maintained as mentioned in the approved mining plan and prevailing rules of Minor Mineral in force and amended henceforth and conditions mentioned in the E.C letter. Non compliance of these conditions will attract legal action under law.

29. Rain water harvesting in mining areas by making pitting and trenching wherever is possible. And Plantation of Tree Shall be done. Recommended by DEAC/DEIAA Committee.

30. In any quarry area any suggestion from GSDA Geologist it must be followed strictly.

32. Environmental mitigation plan with restoration of Environment plan shall be submitted to the DEAC/DEIAA Committee.

33. DEAC/DEIAA Committee has power and authority to monitor AAQM and Noise pollution. Water Samples Analysis Whenever is necessary.

34. DEAC/DEIAA Committee shall remain soul Authority to Discontinue the mining Activity of consent Project proponent in case ofviolation of norms are observed.
