Country Policy and Information Note Libya: Actual or perceived supporters of former President Gaddafi Version 3.0 April 2019 Preface Purpose This note provides country of origin information (COI) and analysis of COI for use by Home Office decision makers handling particular types of protection and human rights claims (as set out in the basis of claim section). It is not intended to be an exhaustive survey of a particular subject or theme. It is split into two main sections: (1) analysis and assessment of COI and other evidence; and (2) COI. These are explained in more detail below. Assessment This section analyses the evidence relevant to this note – i.e. the COI section; refugee/human rights laws and policies; and applicable caselaw – by describing this and its inter-relationships, and provides an assessment on whether, in general: • A person is reasonably likely to face a real risk of persecution or serious harm • A person is able to obtain protection from the state (or quasi state bodies) • A person is reasonably able to relocate within a country or territory • Claims are likely to justify granting asylum, humanitarian protection or other form of leave, and • If a claim is refused, it is likely or unlikely to be certifiable as ‘clearly unfounded’ under section 94 of the Nationality, Immigration and Asylum Act 2002. Decision makers must, however, still consider all claims on an individual basis, taking into account each case’s specific facts. Libya: The ICC and Saif al-Islam Gaddafi Questions and Answers January 2012 The International Criminal Court (ICC) judges granted arrest warrants on June 27, 2011, for Muammar Gaddafi, his son Saif al-Islam, and former intelligence chief Abdullah Sanussi in an investigation authorized by United Nations Security Council Resolution 1970. The three were wanted on charges of crimes against humanity for their roles in attacks on civilians, including peaceful demonstrators, in Tripoli, Benghazi, Misrata, and other locations in Libya. Consistent with Resolution 1970, the ICC warrants apply only to events in Libya beginning on February 15, 2011. While the ICC's proceeding against Muammar Gaddafi was terminated following his death on October 20, anti-Gaddafi forces apprehended Saif al-Islam Gaddafi on November 19 in southern Libya and are holding him in the town of Zintan. While initial reports suggested that a militia also had captured Sanussi, his whereabouts remain unknown. Libya’s general prosecutor told Human Rights Watch on December 10: “Officially we don’t have him.” Following Saif al-Islam Gaddafi's apprehension in November, some representatives of Libya's transitional government and National Transitional Council (NTC) declared that he would be tried in Libya. The chairman of the NTC, the justice minister, and the general prosecutor subsequently reiterated this stance to Human Rights Watch. In December the ICC judges requested further information from the Libyan authorities regarding Saif al-Islam Gaddafi’s status, including whether and when Libya intends to surrender him to the court. Libya was supposed to provide that information by January 10, 2012, but it requested a three-week extension due to the security situation in Libya. -

Introduction Misrata is the third largest city in Libya, with a population of approxi- mately 517,000 inhabitants before the conflict.1 It is a port city located on the far western edge of the Gulf of Sidra along the Mediterranean Coast, 187 kilometers (116 miles) east of Tripoli and 825 kilometers (512 miles) west of Benghazi.2 The city center lies just off the coast, with the seaport to the east and the airport to the south. The center is connected by a num- ber of major roads, including Tripoli Street, the main commercial boule- vard in downtown Misrata that connects to the Libyan Coastal Highway. A number of suburbs, including Al-Ghayran and Al-Shawati, extend out from the city center.3 Misrata is traditionally regarded as the country’s business capital, serv- ing as a central locale for the exchange of commodities and materials with other cities. The city’s steel mill industry is one of its principal sources of income and employment, and the industry has been able to expand throughout the years with its owners holding considerable influence in the city. It began with protests against the leadership of Colonel Muammar al- Gaddafi, with the Libyan leader responding by ordering his troops and supporters to crush the uprising in a televised speech, which escalated the country into armed conflict. The unrest began in the eastern Libyan city of Benghazi, with the eastern Cyrenaica region in opposition control by February 23 and opposition supporters forming the Interim National Transitional Council on February 27. -

LIBYA CONFLICT: WEEKLY RECAP AUGUST 2011 Libya Conflict: Weekly Recap By Michael Whittaker August 4, 2011 International Resolve The United Kingdom and France reiterated their support for continued participation in the Libya conflict. UK Defense Minister Liam Fox stated that Britain will take part in the bombing campaign “as long as is required”, and Foreign Secretary William Hague noted the conflict was “something you follow through in the real world." ( Reuters, PressTV) French Defense Minister Gerard Longuet pledged to continue the aerial bombardment of Libya as France’s Rafale fighter jets relocate to a NATO airbase in Sicily, following the departure of the aircraft carrier Charles de Gaulle to France. ( Reuters) The comments come as Norway concluded its involvement in the air war, the first of the eight NATO members participating in the airstrikes to do so. Norway’s contribution of four F-16 fighters ended on August 1, though NATO officials stated the recent arrival of four British Tornado jets would allow the pace of air operations to continue unaffected. ( AFP) Russia renewed calls for negotiations in Libya, as a senior Russian diplomat described the current fighting as a “dead end” and stated that only renewed dialogue and political solutions could bring peace to the country. ( AFP) China’s assistant foreign minister reinforced this viewpoint, urging the United Nations to assume a greater role in facilitating mediations. ( Xinhua) Venezuelan President Hugo Chavez, meanwhile, read a letter from Qaddafi on Venezuelan national television and offered his continued support of the Qaddafi regime. ( WP) Syrian President Bashar al-Assad and Bahrain Prime Minister Sheikh Khalifa bin Salman al-Khalifa also sent congratulatory messages to Qaddafi for the start of Ramadan, and South Africa’s ambassador to the UN criticized Western governments for demanding that Qaddafi step down. -
