DESIGNATING AND DESCRIBING THE KANE SPRINGS HYDROGRAPHIC BASIN (13-206) WITHIN LINCOLN COUNTY, NEVADA

WHEREAS, the State Engineer is empowered to make such reasonable rules and regulations as may be necessary for the proper and orderly execution of the powers conferred by law.1

WHEREAS, Nevada Revised Statute (NRS) § 534.030 provides that if after due investigation the State Engineer determines that administration of a basin is justified, the State Engineer shall designate the area by basin, or portion therein, and make an official order describing the boundaries by legal subdivision as nearly as possible.

WHEREAS, the State Engineer established the Hydrographic Basins of the Kane Springs Valley (206), Coyote Valley (210), Muddy Springs Area (219), California Wash (218), Hidden Valley (217), Garnet Valley (216), and the northwest portion of the Black Area (215) as sub-basins within the Lower White River Flow System Hydrographic Basin (LWRFS).2

WHEREAS, the maximum quantity of that may be pumped from the LWRFS on an average annual basis cannot exceed 8,000 acre-feet annually for all sub-basins.3

WHEREAS, groundwater committed is the sum of all permitted, certificated, decreed, reserved, relinquished, revocable, and unadjudicated vested claims to groundwater rights. The committed groundwater appropriations of record in the Office of the State Engineer total 1,000 acre-feet annually, within the Kane Springs Valley Hydrographic Basin.4

WHEREAS, applications to appropriate water from the groundwater source within the Kane Springs Valley Hydrographic Basin total 17,375.28 acre-feet annually.5

WHEREAS, total committed groundwater in the LWRFS is 43,629.62 acre-feet annually.6

WHEREAS, the State Engineer finds that the committed groundwater appropriations within the LWRFS exceed the maximum quantity of groundwater that may be pumped from the LWRFS on an average annual basis.

WHEREAS, groundwater level measurements in the Kane Springs Valley Hydrographic Basin are actively monitored.7

WHEREAS, the State Engineer finds that conditions warrant the designation of the Kane Springs Valley Hydrographic Basin (13-206), located within Lincoln County, Nevada, based on data and information available to the State Engineer, under the provisions of NRS Chapter 534.

NOW THEREFORE, IT IS HEREBY ORDERED, pursuant to NRS 534.030, that the following described areas of land are designated as in need of additional administration: 8

T.6S., R.65E., Mount Diablo Base and Meridian (M.D.B.&M.) All of Sections 23, 26, 34, 35, and 36 and those portions of Sections 13, 14, 15, 21, 22, 24, 25, 27, 28, 32, and 33 within the Kane Springs Valley .

T.6S., R.66E., M.D.B.&M. Those portions of Sections 30 and 31 within the Kane Springs Valley drainage basin.

T.7S., R.64E., M.D.B.&M. Those portions of Sections 25 and 36 within the Kane Springs Valley drainage basin.

T.7S., R.65E., M.D.B.&M. All of Sections 1, 2, 3, 10, 11, 12, 13, 14, 15, 16, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 31, 32, 33, 34, 35, and 36 and those portions of Sections 4, 5, 8, 9, 17, 18, 19, and 30 within the Kane Springs Valley drainage basin.
