Prison Break Correctional Liability Update May 2013 Housing Gang Members Together: Can a Blood and a Crip Just Get Along? By Susan E. Coleman Inmates who are assaulted by other inmates, whether cell mates, co- workers, or inmates on the yard, often sue prison administrators for failing to protect them. After all, the Eighth Amendment has been interpreted by the courts to include a duty to protect prisoners. However, a vague risk of harm simply because prisons are violent places which house dangerous criminals is not enough to create liability; something more specific is required. In the case of Labatad v. Corrections Corporation of America, et al, decided on May 1, 2013, the Ninth Circuit found that even housing rival gang members together was insufficient under the circumstances to find that defendants were deliberately indifferent. Labatad, a State of Hawaii inmate incarcerated at the Saguaro Correctional Center, operated by the Corrections Corporation of America Susan E. (“CCA”), was assaulted by his cellmate in July 2009. Naturally, Labatad Coleman is sued CCA for failing to protect him, alleging deliberate indifference to a partner at his safety under the Eighth Amendment. Because Labatad’s assailant the law firm was a member of a rival prison gang, this suit might at first blush seem of Burke, to have some merit, in that prison officials should be aware of Williams & longstanding prison gang rivalries. Plan Bâtiment Durable Rapport d'activité 2017 EDITORIAL Plan Bâtiment, acte III Je ne me lasse pas d’écrire chaque année les lignes introductives à ce rapport, tellement l’écoulement du temps, loin de nous assoupir, favorise un renouvellement permanent de nos actions, en accélérant leur dynamique. 2017 restera exemplaire à cet égard, faisant mentir l’adage selon lequel les années électorales sont des temps perdus pour l’action. Voyez plutôt : la première partie de l’année a permis la mise en place de l’expérimentation E+C- qui prépare la future réglementation environnementale ; elle a été aussi l’occasion d’une production soutenue de textes réglementaires attendus. Le second semestre s’est caractérisé par le nouveau souffle donné à la rénovation énergétique des bâtiments, et la mission renforcée que le Gouvernement confie au Plan Bâtiment Durable. La période post-Grenelle a ainsi permis de lancer la programmation à l’horizon 2050, sans laquelle aucune transformation de notre société vers les bâtiments CE QUE DIT LE durables n’aurait pu s’engager. Queries or requests for any other use, or if a more substantial copy is required, should be directed in the owner(s) of the Intellectual Property Rights. i Abstract The Western image of Turks is identified with two distinctive stereotypes: ‘Terrible Turk’ and ‘Lustful Turk.’ These stereotypical images are deeply rooted in the history of the Ottoman Empire and its encounters with Christian Europe. Because of their fear of being dominated by Islam, European Christians defined the Turks as the wicked ‘Other’ against their perfect ‘Self.’ Since the beginning of Crusades, the Western image of Turks is associated with cruelty, barbarity, murderousness, immorality, and sexual perversion. These characteristics still appear in cinematic representations of Turks. In Western films such as Lawrence of Arabia and Midnight Express, the portrayals of Turks echo the stereotypes of ‘terrible Turk’ and ‘lustful Turk.’ This thesis argues that these stereotypes have transformed into a myth and continued to exist uniformly in Western contemporary cinema. The thesis attempts to ascertain the uniformity and consistency of the cinematic image of Turks and determine the associations between this image and the myths of ‘terrible Turk’ and ‘lustful Turk.’ To achieve this goal, this thesis examines the trajectory of the Turkish image in Western discourse between the 11th and 21st centuries. -

The execution is currently scheduled for October 10, 2019. This motion is based on the files and records in this case and incorporates by this specific reference the aver- ments and evidence proffered with Mr. Halprin’s § 5 application, as if fully set forth herein. Mr. Halprin’s application raises two claims: (1) judicial bias denied him his fun- damental right to due process, and (2) the future-dangerousness special issue in Texas death penalty scheme is unconstitutionally vague. The first claim presents newly un- covered evidence that trial judge Vickers Cunningham referred to Mr. Halprin as a “goddamn kike” and “fuckin’ Jew,” and to his Latino co-defendants as “wetbacks,” 1 when the judge bragged about his role in convicting and sentencing to death the Jewish and Latino members of the Texas 7. The evidence of Judge Cunningham’s bias comes primarily from first-hand accounts of disinterested witnesses to his prejudiced state- ments about Mr.Halprin. -

When an image on the film is obliterated with a large round black mark, it is an indication that the photographer suspected that the copy may have moved during exposure and thus cause a blurred image. You will find a good image of the page in the adjacent frame. 3. When a map, drawing or chart, etc., was part of the material being photographed the photographer followed a definite method in "sectioning" the material. It is customary to begin photoing at the upper left hand corner of a large sheet and to continue photoing from left to right in equal sections with a small overlap. If necessary, sectioning is continued again — beginning below the first row and continuing on until complete. 4. The majority of users indicate that the textual content is of greatest value, however, a somewhat higher quality reproduction could be made from "photographs" if essential to the understanding of the dissertation. -
