CITY CLERK Clause embodied in Report No. 12 of the Economic Development and Parks Committee, as adopted by the Council of the City of Toronto at its meeting held on December 4, 5 and 6, 2001. 3 Appointments to the Liberty Village Business Improvement Area Board of Management (Ward 14 Parkdale-High Park, Ward 19 Trinity-Spadina) (City Council on December 4, 5 and 6, 2001, adopted this Clause, without amendment.) The Economic Development and Parks Committee recommends the adoption of the following report (November 1, 2001) from the Commissioner of Economic Development, Culture and Tourism: Purpose: To appoint fifteen members to the Liberty Village Business Improvement Area Board of Management and to amend the former City of Toronto Municipal Code, Chapter 20, “Business Improvement Areas” as necessary. Financial Implications and Impact Statement: There are no financial implications resulting from the adoption of this report. Recommendations: It is recommended that: (1) Council appoint the nominees listed in Attachment No. 1 to the Liberty Village Business Improvement Area (BIA) Board of Management for the 2001 to 2003 term; (2) amendments be made to the former City of Toronto Municipal Code, Chapter 20, “Business Improvement Areas” as necessary and as set out in Attachment No. 2; and (3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto. Toronto City Council2 Economic Development and Parks Committee December 4, 5 and 6, 2001 Report No. 12, Clause No. 3 Background: Section 220 of the Municipal Act requires that Council appoint members of the BIA Boards of Management for a term expiring at the end of the term of the Council making the appointments. Accordingly, as long as the members continue to qualify, the nominees listed in Attachment No. 1 shall expire on November 30, 2003, or as soon thereafter as successors are appointed. Each of the nominees named meets the requirements for membership set out in Section 220 of the Municipal Act. The BIAs located in the former City of Toronto are subject to Chapter 20 of the Municipal Code entitled “Business Improvement Areas”. Schedule “A” to Chapter 20, “Individual Boards of Management of the former City of Toronto” must be amended to reflect the new appointments made pursuant to this report. Comments: Council enacted the new Liberty Village BIA By-law No. 34-2001 at its meeting of February 1, 2001. This by-law was appealed by property owners and business operators to the Ontario Municipal Board (OMB). In its August 1, 2001, decision to uphold By-law No. 34-2001, the OMB is satisfied that the By-law is consistent with the principles of the relevant legislation affecting BIAs. Following the OMB’s decision the Liberty Village BIA held its inaugural annual general meeting on October 10, 2001, to nominate Board of Management members and approve its 2002 budget. Conclusions: It is recommended that Council appoint the new Liberty Village Business Improvement Area Board of Management nominees as set out in Attachment No. 1 to this report.
