1. At the end of Canon 28, section 2, the following words be added:

Whereas: A. The cost of Provincial Synods has risen to a point where Provincial Standing Committee in 1988 resolved that the membership of such Synods be reduced in order to effect savings.

B. Increasing numbers of clergy (e.g. self-supporting clergy and the inclusion of ) have, on the application of the present formula for representation of Dioceses at Synod, increased these costs, and have distorted representation where there are large numbers of clergy relative to the number of parishes.

C. A more appropriate principle on which to base representation is the number of Pastoral Charges in a Diocese, as these reflect the workings of a diocese and to that extent are a fairer indicator of representation of clergy and laity.

D. Dioceses with more than 100 pastoral charges have in practice proved to be ripe for multiplication into two or more dioceses.

The Proposal

That diocesan membership of Provincial Synod be reduced in the houses of clergy and laity, and the principle upon which representation is based be changed.

The Measure

Be it enacted that:-

The Principles

Whereas A. The need has been felt to provide for some latitude and flexibility in the appointment of the President of Provincial Synod ("Synod") and ^ n Cpl?airman of Provincial Standing Committee ( PSC ), in order not to place an unnecessary burden on the Metropolitan, and to provide an opportunity for the talents of others to be exercised in this role.

B. The fundamental role of the Metropolitan in relation to the proceedings of Synod and PSC, needs to be retained, so that substitute Presidents and Chairmen will be acting in terms of authority delegated to them from the Metropolitan.

C. PSC in 1988 resolved to put such a measure to Synod for consideration.

The Proposal

That a provision be incorporated in Canons 1, section 4, and 43, section 4, and Standing Rule 3 (xi), to allow the etropolitan to delegate his Presidency of Synod and Chairmanship of PSC from time to time.

B. It remains necessary to have the clerical and lay representatives elected by each diocese, and to be mindful of the functions of PSC and its cost.

The Proposal

That the membership of PSC be increased by enabling the Metropolitan to nominate additional members up to the maximum prescribed by PSC from time to time.

The Measure

Be it enacted that a new paragraph numbered (c) be inserted in Canon 43, section 1, (and the existing one be numbered (d) with consequential renumbering and changes of headings), to read as follows: The Metropolitan may nominate additional representatives to the Committee, to provide for the representation of such interests or groups as in his opinion may not otherwise be represented, either adequately or at all. The maximum number of such representatives shall be determined by the Committee from time to time. In the absence of a determination, the number shall be 10. The Committee may also commend interests or groups to the Metropolitan which it considers need representation, but the Metropolitan may add others for this purpose, should he deem it necessary. These nominated representatives shall have all the rights and privileges of elected representatives, save only that they shall have the right to speak but not to vote." n .

That permission be given to the Bishop of the Diocese to delegate the aforegoing to a Bishop Suffragan in his Diocese.

The Measure

Be it enacted that:

1. In Canon 20, section 1, the following sentence be added - "The Bishop may delegate his authority to grant, revoke or renew a licence (or any one or more of these acts) to a Bishop Suffragan in his Diocese, which delegation he may withdraw at any time."

2. In Canon 25, the following section, to be numbered 12, be / a d d e d : ------—------r ______/ , O "12. MEASURE TO AMEND CANON 48

The Principles

Whereas: A. Canon 48 of The Order of Ethiopia limits the jurisdiction of the Bishop of the Order in that:

(i) Clergy of the Order take the Oath of Canonical Obedience to the Bishop of the Diocese and have to be licensed by him, and

(ii) The Bishop of the Order is licensed by the Bishops of the Dioceses in which the Order is working, so that his position appears to be that of a Bishop Suffragan to many Diocesan Bishops;

B. (i) it is desirable that the Bishop of the Order should possess a jurisdiction no less than that of a Diocesan Bishop, and

(ii) that the Conference of the Order should be given the status of a Diocesan Synod;

C. it is desirable that the relationship between the Order of Ethiopia and the rest of the Church of the Province of Southern Africa be more clearly defined;

D. certain provisions of Canon 48 are now redundant, obsolete or obscure: The Proposal

That Canon 48 be amended in the manner set forth in the Measure below. The Measure

Be it hereby enacted that Canon 48 be amended in the following ways:

Section 1 (a) and elsewhere, wherever it appears, delete 'for' and substitute 'of', so that the phrase reads "Bishop of the Order".

The Principle

Whereas: A. No amendment to the Constitution shall be considered by Provincial Synod unless it proceeds from a Provincial or Diocesan Synod, Board or Committee. B. In terms of Rule 30 (a)(i) of the Standing Rules of Provincial Synod, no motion shall be received unless it proceeds from the House of Bishops, a Diocesan or Provincial Body or that it has been considered by some Diocesan or Provincial Body or that it is accompanied by a declaration signed by three Diocesan representatives to Provincial Synod.

C. These Rules have been drafted to ensure that Provincial Synod deals with broad and representative issues within the life of the Church and to prevent individual or non­ representative concerns becoming part of its agenda.

D. These Rules do not, however, apply to amendments and alterations to Canons which may be proposed by individual representatives to Provincial Synod without the reguirement that the proposed measure proceed from any Provincial or Diocesan body or be accompanied by a declaration signed by three or more Diocesan representatives.

E. The Advisory Committee to Provincial Synod agreed that Canon 49 be amended to correct the anomaly.

The Proposal

That Canon 49 be amended so as to ensure that measures to amend the Canons will only be considered if they proceed from a Provincial or Diocesan Synod or Board, as in the section governing amendments to the Constitution or are accompanied by a declaration signed by a Diocesan Bishop or no less than three representatives to Provincial Synod."

The Measure

Be it enacted that: Canon 49 be amended by the inclusion of a new section 3 as follows: "3. No formal notice for the alteration, amendment or repeal of any Canon shall be received unless it proceeds out of a resolution of the House of Bishops, Provincial Synod, the Provincial Standing Committee, a Committee or Commission of Provincial Synod or a Diocesan Synod, Council, Board, Committee or Commission, or is accompanied by a declaration signed by a Diocesan Bishop or three Diocesan representatives to Provincial Synod."

And that the following sections be renumbered consequentially.

/ MEASURE TO DELETE CANON 47

The Principle

Whereas: A. A Provincial Lay Workers Pension Fund was established on 1 January 1987 as a fund administered by an insurance company subject to rules registered by that company with the Registrar of Pension Funds.

B. There is, as a result, no further need for the existence of Canon 47.

MEASURE TO AMEND CANON 46

The Principle Whereas: A. The Pensions Board, with the approval of Provincial Standing Committee, and in accordance with the recommendations of the Fund Actuary, has found it possible to improve the benefits available to retiring clergy and to the dependants of clergy who die before retirement.

B. The improved benefits thus implemented by the Pensions Board require ratification in the form of amendments to Canon 46.

C. The improvements in benefits are specifically described as follows hereunder:

(i) Clergy (other than bishops) to retire at the age of 66 instead of at the age of 68, but the pension benefits are still to be based on the service that would have applied had retirement occurred at the age of 68. (ii) All service is to count towards pension instead of the present limit of 40 years for clergy and 35 years for bishops.

(iii) The death benefit payable on death before retirement is to be increased from 8 times to 10 times the annual pensionable emoluments on 1st January in the year of death.

(iv) The death benefit payable on death after retirement is to be increased from 5 times to 7 times the annual pensionable emoluments on 1st January in the year of retirement.______D. Certain other amendments to, and renumbering of, the sections of Canon 46, are desirable to bring the rules up to date and to improve their format. The Proposal

That Canon 46 be amended as set out in the Measure below. The Measure

Be it enacted that Canon 46 be amended as follows:

1. In section 3, to the definition of "Pensionable Emoluments" add the words ",and provided that it shall be a minimum of R600 per annum, or in the case of a Bishop of the Province, R2000 per annum." 2. In section 3 insert a new definition, "Pensionable Service- after the definition of "Pensionable Emoluments" as follows: "Pensionable Service" shall mean the number of completed years of service at the date of retirement, provided tha a fraction of a year of 6 months or more shall count as a completed year. 3. In section 3, in the definition of "Normal Retirement Age amend "sixty-eight" to read "sixty-six".

4. In sub-section 17(d) delete the words "and his age at shall, for the purposes of section 22 of this Canon, be taken as being 48 years," and substitute therefor the words "and his pensionable service shall, for the purposes of section 22 of this Canon, be deemed to have commenced at the age of 48,".

5. In sub-section 20(a) (i) insert a full-stop after the word "year" in line 4 and delete the words "provided however...... per annum." Delete sub-sections 20(a) (ii), 20(a) (iii) and 20(a) (iv) and substitute therefor the following:- "(ii) Each Diocese of the Province shall in each year, on its own behalf and account, make a contribution to the Fund in respect of each Full Member of a sum determined by the Actuary as being in his opinion sufficient to support the benefits accruing to such member (after taking into account any transfer under a reciprocal agreement), provided however that such contribution shall not be less than five per cent of such member's Pensionable Emoluments at the rate in force on 1st January in that year." Renumber sub-sections 20(a) (v) to 20(a) (xii) as (iii) to (x) .

In new sub-section 20(a) (iii) delete "(i),(ii),(iii) and (iv)" and insert "(i) and (ii)".

In new sub-section 20(a) (iv) delete "(i), (ii) and (iv)" and insert "(i) and (ii)". Delete the sentence "All annual ...... in each year".

In new sub-sections 20(a) (v), (vi) and (vii) delete the words "or the Common Provincial Fund as the case may be."

In new sub-section 20(a) (ix) delete "(i), (ii) and (iv)" and insert "(i) and (ii)".

Delete sub-section 22 (a) and substitute the following therefor:-

"(a)(i) Upon reaching the normal retirement age and provided he shall have otherwise complied with the provisions of this Canon, a Full Member shall be entitled to a pension amounting to a percentage of the Pensionable Emoluments applicable to the member on 1st January coincident with or immediately before retirement; such percentage being

a. in the case of a Member other than a Bishop of the Province, seven and one-half percent, plus three and three-quarters percent for each year of pensionable service. or b. in the case of a Bishop of the Province, four and two-sevenths percent for each year of pensionable service.

(ii) Existing 22(a)(iii) renumbered.

In section 23, sub-section (a), substitute the word "ten" for the word "eight". In sub-section (b), substitute the word "seven" for the word "five", and delete sub-section (c) .

In sub-section 25(a) delete the words "to retirement at" and insert the words "immediately prior to his reaching".

In sub-section 25(b) substitute "61" for "63". 16 In sub-section 25(c) delete the words "as modified ....actual retirement" and substitute therefor the words "with Pensionable Service being taken as the Pensionable Service that would have applied had the Member retired at the Normal Retirement Age."

17 In sub-section 25(e) after the word "entitled in line 3 insert the words "on application for early retirement as is elsewhere permitted in terms of these rules, or on achieving retirement age, to such pension, and, if required, such death benefit," and delete the words at retirement age to such pension" in lines 3 and 4 of the existing sub-section.

18 Remove sub-sections 20(b) to 20(h) and reinsert them, without amendment, renumbered as section 32 sub-sections (a) to (n) omitting reference to any sub-sections (l) or ( 1 ) • 19 Renumber existing sections 32 to 36 as numbers 33 to 37

Whereas: A. Permanent or temporary disablement may occur at an early stage in a Member's service in the Church.

B. The present provisions discriminate against such a Member and are subject to the discretion of the Board. The Proposal

That the provisions of the Canon be amended by removing the minimum periods of service and discretion given to the Board.

The Measure

Be it enacted that:-

1. In Canon 46, section 25 (c), the words "with not less than 10 years service" in lines 1 and 2 be deleted; and the word "may" in line 3 be deleted and substituted with the word "shall". 2 . In Canon 46, section 25 (d), the words "with not less than 15 years service" in lines 1 and 2 be deleted; and the word "may" in line 5 be deleted and substituted with the word "shall"; and finally the words "at the discretion of the Board" in line 6 be deleted.

Be it enacted that: Canon 28 be amended by the insertion of a new section 6 (the existing section 6 to be renumbered 7) in the following terms:

"6. Where the Incumbent or Archdeacon perceives that the life and conduct of a member of the Parish Council is inconsistent with his position as a Parish Councillor, he may refer the matter to the Bishop who after further enquiry shall have power to dismiss or suspend the person concerned from his office for such a period as the Bishop may determine."

D. It is desirable that a proposer be permitted to make a brief statement in support of a nomination.

That Canon 28 be amended in the respects set forth in the measure below.

The Measure

Be it enacted that: Canon 28 be amended by the insertion of the following new sections 2, 3, 4 and 5 (with consequent re-numbering):

"2 Nominations of the outgoing Council for election as Churchwardens and Parish Councillors en bloc shall not be permitted. Each nomination must be individually made and agreed to by at least one quarter of the members of Vestry present, the agreement of the person so nominated having first been obtained.

The proposer may read out a statement of not more than 150 words in support of his or her candidate.

The candidates concerned shall absent themselves for the duration of the voting of their candidacy.

Voting may be by a show of hands or by ballot as decided by the Vestry.

That this Synod for the term of the 1989 Synod only,

73.1 resolves to amend the standing rules as follows:

73.1.1 Taking in account the present provisions of Standing Rule 3(xi), the Metropolitan may, in exceptional instances, delegate his authority as President to a Bishop in the order of priority set out in the said Rule, to enable him to absent himself in relation to the discussion of an issue when he deems this expedient for the proper operation of the business of Synod, or to attend to matters outside Synod where this is urgently necessary, or to give him the opportunity of entering the debate from the floor. The Metropolitan shall decide whether or not an instance is exceptional, but if there is any dispute in this regard, the same shall be determined by the Advisory Committee of Synod, whose decision shall be final.

73.1.2 Standing rules 35 and 55 shall be subject to the following, namely, that all members wishing to speak shall notify the President during the debate in writing, whether he or she intends to speak for or against the subject matter of the debate, and if he or she intends to propose an amendment, the terms of such amendment. Such notices shall be passed during the debate via stewards to a Resolutions Committee, comprising the Chancellor of Cape Town and the Deputy Provincial Registrar, or one of them (should the other be absent), or such other persoijj^as the President may nominate if oither-^one of them i-s- absent. At the same time the member shall move to assume a seat in the area allocated for these purposes during debates of Synod. The Committee shall keep the President informed of all such notices. 73.1.3 The President shall have a discretion as to when to permit or delay a motion or amendment put in terms of Standing Rules 32, 34, 36,373^ t t t 3i and 61

73.1.5 The Resolutions Committee may make such editorial and drafting changes to the wording of the motions or amendments as are brought before Synod during the debates as they may deem apropriate in relation to the requirements of the Constitution and Canons, but so as not to change materially the substance of the motion or amendment, unless and to the extent that same may be in conflict with the Constitution and Canons.

Item 1. AGENDUM 10. Measure to amend Canons 28 and 29.

1. Be it enacted that: In Canon 28, section 2, line 5, after "Communicants" replace with a "," and add "from as wide a cross section as possible of those eligible". ^ ,, At the end of Canon 28, section 2, the following words be added: "Such Councillors shall not serve in office for more than five consecutive years, but may serve in office for more than one period of five consecutive years; provided that, where the Archdeacon has given prior consent*, and the Vestry has assented by a two thirds majority vote, a councillor may continue in office for further yearly periods". 2. At the end of Canon 29, section 2, the following words be added: "A Churchwarden (including an alternate Churchwarden) shall not serve in office for more than five consecutive years, but may serve in office for more than one period of five consecutive years; provided that where the Bishop has given prior consent, and the Vestry has assented by a two thirds majority vote, a Churchwarden may continue in office for further yearly periods".

Be it enacted that: in Canon 20, section 1, the following sentence be added - "The Bishop may delegate his authority to grant, revoke or renew a licence (or any one or more of these acts) to a Bishop Suffragan in his Diocese, which delegation he may withdraw at any time." ______

in Canon 25, the following section, to be numbered 2 . 1 2 , be added: "12. Be it enacted that: Canon 28 be amended by the insertion of a new section 6 (the existing section 6 to be renumbered 7) in the following terms:

6 . Where the Incumbent or Archdeacon perceives that the life and conduct of a churchwarden, Alternate Churchwarden or Parish Councillor is inconsistent with that office, he may refer the matter to the Bishop, who &hall, after further enquiry and giving that person an opportunity to be heard, have the power to dismiss, or suspend for a period, the person from office. The Bishop may refer this matter to Diocesan Tribunal.

Item 9. AGENDUM 5. Measure to amend Canon 48. Be it hereby enacted that Canon 48 be amended in the following ways: Section 1 (a) and elsewhere, wherever it appears, delete 'for' and substitute 'of', so that the phrase reads "Bishop of the Order".

Section 1 (b) Line 3, delete 'only'.

Section 2 Insert a new (a) "have pastoral ___ oversight of the members of the Order, and episcopal jurisdiction over the affairs of the Order;" with the existing (a) to be renumbered (b), and with consequential renumbering.

(c) delete the words after "Obedience" and substitute "and receive the same Declarations and Subscriptions as are given to a Bishop under Canon 16;"

(d) delete (f) Line 1, before "or" add "and/". Line 4, delete 'in terms of ... Bishop' and substitute 'or shall be established by agreement with the Diocesan Bishop'

(g) delete

Section 3 Line 2, after 'Southern Africa' add 'It is a Provincial peculiar with its own Bishop, Clergy and lay people, with its own ethos and corporate life, and it seeks to live and work in harmony with pastoral charges and diocese."

Section 5 Line 4 delete "only".

Section 6 delete whole section and substitute 'The Order may be invited to send observers to Diocesan Synods, who may speak but not vote.'

Section 9 delete the first sentence: "Every diocese .... time to time." In line 5 delete "Chapter" and substitute "General Purposes Committee"

Section 10 Line 3, delete the second sentence beginning with the word ' Amendments'.

Section 11 delete 'Chapter and the Conference' substitute 'General Purposes Committee and Conference'.

Section 12 delete whole section

Section 13 delete 'Provincial' substitute 'Bishop of the Order'; Add a new (b), (renumbering consequently),"license clergy of the Order in terms of Canon 25;"

Section 14 delete

Section 15(a) Delete and substitute "The Bishop of the Order and the Diocesan Bishop shall consult each other before any new work can be begun by either of them in an area where work is already being done by the other..

(b) Delete and substitute "Where a difficulty arises from close proximity of parishes within a Diocese and missions of the Order, it shall be resolved jointly by the Diocesan Bishop and the Bishop of the Order. Should the Bishops be unable to resolve the matter they may refer it to the Synod of Bishops for a decision.

Section 16 Line 2, delete "and diocesan"

Section 18 Line 5 delete "and Diocesan Synods" substitute "Synod".

Section 20 delete whole section and substitute "All church buildings of the Order shall be open to all people without distinction of race, colour, or sex.'

Section 22 (1) In line 3, delete "Provincial" and substitute "Bishop of the Order".

Sections 9-24 to be re-numbered accordingly.

Item 10 AGENDUM 7. Measure to amend Canon 46,

The Provincial Secretary/Treasurer tabled a complete redraft of this Canon, in terms of the recommen tion of the actuary, in consultation with the Pensions Board. Owing to volume, copies are not attached, but are available on request from the Provincial Secretary Treasurer.

34.1 Recognising that:

34.1.1 the present crisis in the area of Theological Education is a result of:

34.1.1.1 the need for new models of education in a changing world, and especially at this time in the history of Southern Africa,

34.1.1.2 the serious shortage of trained theological educators in the C.P.S.A.

34.1.1.3 the shortage of diocesan funding for the training of students,

34.1.1.4 the overloaded curriculum demanded of Colleges by the Joint Board for the Diploma in Theology (Southern Africa) for as long as this curriculum is followed,

34.1.2 theological educators from all the Colleges of the C.P.S.A. have met to reflect on this situation, and to suggest ways forward in the future.

34.2 Understands:

the need for new models in theological, education concentrating on how subjects are taught as well as what is taught - which will equip clergy and church leaders more adequately for the task of seeking solutions to problems in a changing society, and / 34.3 Supports: theological educators of the C.P.S.A. in their task of training by -

34.3.1 ensuring that all who enter the Colleges of this Province have, by January 1993, completed certain basic diploma courses - common to all dioceses,

34.3.2 ensuring that all who leave the Colleges on completion of their courses participate in a standardised programme of continued clergy education within each diocese or group of dioceses, 34.3.3 requesting the Archbishop to appoint a commission to -

34.3.3.1 investigate the funding of theological education with reference to Provincial Colleges, U n ivers i 1 diocesan programmes, and a Joint Provincial Fund,

34.3.3.2 select and develop appropriate training programmes for future theological education, ar>d diversities 34.3.3.3 foster efforts in seminaries^to provide training in new educational methods for their staff, and

34.3.3.4 provide an interim report for P.S.C. in 1989, and a final report for P.S.C. in 1990.

1. There are no statistics available about the number of black priests who have pastoral charges in white group a r e a s .

2. The Archbishop of Cape Town and Metropolitan of the Church of the Province of Southern Africa is BLACK. There are several Diocesan Bishops and Suffragan Bishwps who are Black and who have oversight over God's flock in the various Diocese of this Province.

As of now the expenditure on the current session of Synod amounts to approximately R50 000.

It is impossible at thi s stage to predict accurately what the final cost w ill be. The Advisory Commi11ee is unab1e t o help me in this regard except to say that in the opinion of Mr G reenham o u r b u d g e t of R102 000 is likely to be e x c e e d e d . If we assume a final cost of + R130 000 than the cost per member (both elected and ex o fficio ) would be + R600 per p e r s o n •

This does not include admin staff some of whom are local and some from elsewhere.

For information the cost of Synod in 1982 and 1985 was R6S 000 and R100 000 respectively.

1. The Liturgy 1975 Key is not, strictly speaking, a lectionary but a Guide to Bible reading, and it therefore has included additional material.

2. Consideration w ill be given to the inclusion of the list of special days of prayer in future editions of the lectionary.

Has the Church of this Province begun any programme in solidarity with women in light of the WCC decision to declare 1988-1998, a period of solidarity with women? If the answer is yes, what programmes':' If not why?

"The service books produced for some of the Synod Eucharist services have hymns and scripture passages in them that have been copied from other sources - some by retyping, some by photocopying from other books. Was permission from the appropriate"'; op yr i q h t holders obtained before th is was done- t h e If so, how and by - whom?
