The Productivity Commission The Productivity Commission is the Australian Government’s independent research and advisory body on a range of economic, social and environmental issues affecting the welfare of Australians. Further information on the Productivity Commission can be obtained from the Commission’s website (www.pc.gov.au) or by contacting Media and Publications on (03) 9653 2244 or email: [email protected] Terms of reference I, Bill Shorten, Assistant Treasurer and Minister for Financial Services and Superannuation, pursuant to Parts 2 and 3 of the Productivity Commission Act 1998 hereby request that the Productivity Commission undertake an inquiry into the implications of globalisation for the Australian retail industry, with a view to informing the Government on whether current policy settings are appropriate in this environment. The Commission will commence the inquiry in February 2011 and report in November 2011. The Commission will hold hearings for the purpose of this inquiry. Scope of the Inquiry The Commission is requested to examine: 1. The current structure, performance and efficiency of the retail sector and impediments to its contribution to the Australian economy; 2. The drivers of structural change in the retail industry, including globalisation, increasing household and business access to the digital economy, cost structures of the domestic retail industry, employment structure, the exchange rate and structural change driven by the resources boom; 3. The broader issues which are contributing to an increase in online purchasing by Australian consumers and the role of online purchasing in providing consumers with greater choice, access and convenience; 4. The sustainability and appropriateness of the current indirect tax arrangements in this environment, including the impact on Commonwealth and State and Territory budgets, and the extent to which technology could reduce the administrative costs of collecting indirect taxes and duty on imported goods; and 5. Any other regulatory or policy issues which impact on structural change in the sector. The Commission is to provide both a draft and a final report, and the reports will be published. The government will consider the Commission’s recommendations, and its response will be announced as soon as possible after the receipt of the Commission’s report.     2020 Algorithmic Collusion and Scrutiny 1137 ALGORITHMIC COLLUSION AND SCRUTINY: EXAMINING THE ROLE OF THE ACCC’S INFORMATION GATHERING POWERS IN THE DIGITAL ERA NATHAN FEIGLIN* An important emerging issue is the fitness-for-purpose of the Australian Competition and Consumer Commission’s (‘ACCC’) information gathering powers given the challenges caused by the proliferation of complex algorithms. This article considers potential harms that may be caused to competition and consumers by (i) algorithms that may assist in creating or enforcing vertical or horizontal restraints; (ii) algorithms that enable self-preferencing by dominant platforms; (iii) algorithms that may facilitate the enforcement of anti-competitive contractual restrictions; and (iv) ranking algorithms that may mislead consumers. After surveying the relevant literature – especially in relation to the potential harms of horizontally collusive algorithms – and the state of the ACCC’s information gathering powers under section 155(1) of the Competition and Consumer Act 2010 (Cth), this article proposes an additional two technology-based information gathering powers, including the power for the ACCC to scrutinise algorithms. I INTRODUCTION This article seeks to address the risks of competitive or consumer harm being caused by the use of algorithms that may restrain competition or mislead consumers. In July 2019, the final report of the Australian Competition and Consumer Commission’s (‘ACCC’) Digital Platforms Inquiry (‘DPI Final Report’) recommended a ‘specialist digital platforms branch’1 within the ACCC, with a purpose including ‘proactively monitoring and investigating instances of * LLB (Hons); Graduate at the Australian Competition and Consumer Commission (‘ACCC’). Total sales recorded by Supermarkets & Grocery Stores as measured by the Australian Bureau of Statistics have increased from $64.5 billion at 2007 to $103.7 billion at 2017, recording average annual growth of 4.9% per annum – despite the impacts of the global financial crisis (GFC). Over this past decade the category has also increased its share of total Australian retail sales from 31.3% to 33.7%. For Victoria, similar trends are evident. Supermarkets and grocery stores’ sales have increased over the past decade at a similar rate to the national average – 4.5% versus 4.9%. The share of total retail sales directed to supermarkets and grocery stores by Victorians has also increased over this period, from 31.6% at 2007 to 32.8% at 2017. Given the importance of the Supermarkets & Grocery Stores category to both the Victorian retail sector and Victorian consumers, the entry of Kaufland into the supermarket sector brings with it enormous potential for significant consumer benefits, as well as broader economic benefits.

    cover story >>> SEAN McGOWAN REPORTS Supermarket refrigeration going natural In 2005, Coles Supermarkets opened its first ‘environmental concept’ supermarket featuring a cascade carbon dioxide refrigeration system. Two years on the technology has undergone significant improvement to better serve the local market, while internationally it promises to receive widespread adoption by the world’s retail heavyweights, as Sean McGowan reports. Supermarket refrigeration accounts for a significant 1% of Australia’s total electricity consumption, and this figure is reported to be higher in Europe and the United States. Therefore, its not surprising to find supermarket chains worldwide clamoring to adopt new technology which promises to cut their energy costs, while at the same time, address their corporate responsibilities to the environment and the communities who shop with them. The knight in shining armour looks set to be carbon dioxide (CO2) refrigeration systems, which are often used in a cascade design with fluorocarbon refrigerants such as R507 or R134a. A cascade system using ammonia is also on the agenda according to one of Australia’s leading supermarket refrigeration specialists, Frigrite Refrigeration. “We have traveled the world investigating system design and have developed solutions that best suit the Australian market. We installed the first CO2 systems in Australia, with another four systems installed in new supermarkets since,” says Andrew Reid, national account manager for Frigrite. “Due to economic constraints, the cascade CO2 systems installed in Australia best suit the energy and environmental expectations, however, further development is underway in finding improvements to the current concepts, which may involve a fundamental system design change and alternate refrigerants to those currently being used.” Reid says supermarket chains have acknowledged the importance of meeting environmental and community expectations as the general awareness of these two aspects increases.
