MT OF POLITICAL AND SECURITY COUNCIL AFFAIRS No. 18/69 October 1969 NOTES AND DOCUMENTS* OPPONENTS OF APARTHEID SUBJECTED TO BANNING ORDERS IN SOUTH AFRICA "Banning orders" are one of the arbitrary repressive measures, used by the South African Government to silence and harass opponents of a-prtheid, which have been condemned repeatedly by United Nations organs. In resolution 2396 (XXIII) of December 2, 1968, the General Assembly requested the Secretary-General to establish a register of persons served with banning orders and to publicize it as widely as possible. The Economic and Social Council in resolution 1415 (XLVI) of June 6, 1969, recommended that the General Assembly call upon the South African Government "to rescind immediately the 'Banning Orders' issued under the Suppression of Communism Act against the opponents of apartheid." This issue of "Notes and Documents" contains a list of those currently banned, together with brief biographical particulars when available. It will be noted that this list includes persons of all main racial groups in South Africa. It. includes Africans as well as Whites, Indians and Coloured people; men and women; doctors, , teachers, students, priests, workers, writers and members of other professions; and a considerable number of trade unionists. It includes many officers of organizations such as the South African Indian Congress, Coloured Peoples Congress and South African Congress of Trade Unions, which were paralyzed by the banning orders, though the organizations themselves, unlike the African National Congress and the Pan Africanist Congress, were not banned. The stringent banning orders have prevented a number of persons from continuing their jobs and professions. The restrictions have forced a number of opponents of apartheid to leave South Africa. In some cases, both husband and wife have been banned. The wives of several political have been banned. Many political prisoners have been served with banning orders immediately after completing their sentences. -2- Though the banning orders are usually for a period of two or five years, they are often renewed. (The names of persons who had been previously banned are marked with an asterisk). Many persons have been subjected for ten or more years to stringent restrictions. Particularly serious are the restrictions on nearly forty persons subjected under the banning orders to "". A typical banning and house arrest order - served on Miss Mary Benson, a writer - is reproduced at the end of this section. Under the Suppression of Communism Act, the Minister of has very wide and arbitrary powers to prohibit a person: - from entering or being in a certain place (e.g., any African location or trade union office or factory or printing works or publishing house) - from going outside a particular area or place (e.g., a magisterial district or African reserve or even a flat) - from communicating with any other person (usually another banned person) - from receiving any visitors (except an advocate or attorney managing his affairs) - from attending any gatherings - from doing specific acts (e.g., teaching, writing for publication). The definition of "communism" under -he Act is so wide and arbitrary that the repressive measures have been applied to opponents of apartheid irrespective of their attitude towards communism. The banning orders are issued under section 5 (1) (e) or section 9 (1) of the Suppression of Communism Act. Section 5 (1) (e) provides that the Minister of Justice may require any person who is listed as an officer, member or active supporter of an organization banned for furthering the achievement of any of the objects of communism, or who has been convicted of an offence under the Act, or is a communist: "(e) not to attend (i) any gathering; or (ii) any particular gathering or any gathering of a particular nature, class or kind; at any place or in any area during any period or on any day or during specified times or periods within any period, except in such cases as may be specified in the notice or as the Minister or a magistrate acting in pursuance of his general or special instructions may at any time expressly authorize." Section 9 (1) provides that the Minister of Justice may, whenever he is satisfied that any person engages in activities which are furthering or are calculated to further the achievement of any of the objects of communism, prohibit him from attending any gatherings, or any particular gathering or any gathering of a particular nature, class or kind, at any place or in any area during any period or on any day or during specified times or periods within any periods. The annexed list of banned persons is not fully up-to-date because of delays between the serving of orders and notification in the Official Gazette. It does not include those banned under section 11 (g) of Suppression of Communism Act - which is applied to prohibit publication of writings or speeches of South Africans who have left the country - or under other . The biographical particulars are taken mainly from press reports and are not complete. The addresses of those who have left South Africa are omitted. APPENDIX TEXT OF BANNING ORDER SERVED ON MISS MARY BENSON IN FEBRUARY 1g66 TO: DCROTHY MARY BENSON, 7 QUEENS ROAD, , . NOTICE IN TERMS OF PARAGRAPH (a) OF SUB-SECTION (1) OF SECTION TEN OF THE SUPPRESSION OF CCNMUNISM ACT, 195C (ACT NO. 44 OF 1950). WHEREAS I, BALTHAZAR JOHANNES VORSTER, Minister of Justice, am satisfied that you engage in activities which are furthering or may further the

-4- the achievement of the objects of communism, I hereby, in terms of paragraph (a) of sub-section (1) of section ten of the Suppression of Communism Act, 1950 (Act No. 44 of 1950), prohibit you for a period commencing on the date on which this notice is delivered or tendered to you and expiring on the 51st day of January, 1971, from (1) absenting yourself from the residential premises situate at 7 Queens Road, Parktown, Johannesburg, at any time except (a) between the hours of six in the forenoon and seven in the afternoon on any day not being a Saturday, Sunday or public holiday; (b) between the hours of six in the forenoon and two in the afternoon on any Saturday not being a public holiday; (2) absenting yourself from the magisterial district of Johannesburg; (3) being within (a) any Bantu residential area as defined in the Bantu (Urban Areas) Consolidation Act, 1945 (Act No. 25 of 1945); (b) the area of jurisdiction of the Alexandra Local Area Committee as defined in Administrator's Proclamation No. 27 of the 3rd February, 1958; (c) any Bantu compound; (d) the premises of any factory as defined in the Factories, Machinery and Building Work Act, 1951 (Act No. 22 of 1941); (e) any place which constitutes the premises on which any publication as defined in the Suppression of Communism Act, 1950, is prepared, compiled, printed or published; (f) any place which constitutes the premises of any organization contemplated in Government Notice No. R.2150 of the 28th December, 1962, as amended by Government Notice No. R.1947 of the 27th November, 1964, and any place which constitutes premises on which the premises of any such organization are situate; (g) any place or area which constitutes the premises on which any public or private university, university college, college, school or other educational institution is situate;

-5- (h) any area set apart under any law for the occupation of Coloured or Asiatic persons; (i) any place or area which constitutes the premises of any superior or inferior court as defined in the Criminal Procedure Act, 1955 (Act No. 56 of 1955), except for the purpose of (i) applying to a magistrate for an exception to any prohibition in force against you under the Suppression of Communism Act, 1950; (ii) attending any criminal proceedings in which you are required to appear as an accused or a witness; (iii) attending any civil proceedings in which you are a plaintiff, petitioner, applicant, defendant, respondent or other party or in which you are required to appear as a witness; (4) communication in any manner whatsoever with any person whose name appears on any list in the custody of the officer referred to in section eight of the Suppression of Communism Act, 1950, or in respect of whom any prohibition under the Suppression of Communism Act, 195C, or the Riotous Assemblies Act, 1956 (Act No. 17 of 1956), is in force; (5) performing any of the following acts, that is to say (a) preparing, compiling, printing, publishing, disseminating or transmitting in any manner whatsoever any publication as defined in the Suppression of Communism Act, 1950; (b) participating or assisting in any manner whatsoever in the preparation, compilation, printing, publication, dissemination or transmission of any publication as so defined; (c) contributing, preparing, compiling or transmitting in any manner whatsoever any matter for publication in any publication as so defined; (d) assisting in any manner whatsoever in the preparation, compilation or transmission of any matter for publication in any publication as so defined; (e) (i) preparing, compiling, printing, publishing, disseminating or transmitting in any manner whatsoever any document (which shall include any book, pamphlet, record, list, placard, poster, drawing, photograph or picture which is not a publication within the meaning of paragraph (5)(a) above); or

-6- (ii) participating or assisting in any manner whatsoever in the preparation, compilation, printing, publication, dissemination or transmission of any such document, in which, inter alia (aa) any form of State or any principle or policy of the Government of a State is propagated, defended, attacked, criticised, discussed or referred to; (bb) any matter is contained concerning any body, organization, group or association of persons, institution, society or movement which has been declared an unlawful organization by or under the Suppression of Communism Act, 1950, or the Unlawful Organizations Act, 1960; (cc) any matter is contained concerning any organization contemplated in Government Notice No. R2130 of the 28th December, 1962, as amended by Government Notice No. R1947 of the 27th November, 1964; or (dd) any matter is contained which is likely to engender feelings of hostility between the White and the nonWhite inhabitants of the Republic of South Africa; (f) giving any educational instruction in any manner or form to any person other than a person of whom you are a parent; (g) taking part in any manner whatsoever in the activities or affairs of any organization contemplated in Government Notice No. 2130 of the 28th December, 1962, as amended by Government Notice No. R.1947 of the 27th November 1964; (6) receiving at the said residential premises any visitor other than a medical practitioner for medical attendance on you, if the name of such medical practitioner does not appear on any list in the custody of the officer referred to in section eight of the Suppression of Communism Act, 1950, and no prohibition under the Suppression of Communism Act, 1950, or the Riotous Assemblies Act, 1956, is in force in respect of such medical practitioner. ANNEX I LIST OF PERSONS BANNED UNDER THE SUPPRESSION OF COMMUNISM ACT (Sections 9 (1) and 5 (1)(e)) AITCHINSON, John Jacques William Address: Flat 15, Birket Court, Christie Road Pietermaritzburg (Period of current banning order: 19 May 1965 to 30 April 1970). A university student and a candidate for Holy Orders when banned. He was also secretary of the Natal branch of the Liberal Party and a student leader. In October 1966, he was refused a passport to go to the United Kingdom for study. In December 1966 he was sentenced to one year's , all but four days suspended, for failing to make a weekly report to the local police station as required by the banning orders. AJAM, Achmat Address: 21 Kingsley Road Salt River Cape Town (Period of current banning order: 1 September 1966 to 31 July 1971). Detained under "90-day law" in 1964. Charged under the " abotage ct", but the charges were withdrawn on 5 June 1964. ALEXANDER, Dorothy Hazel Address: Marais Road Middleburg Cape Province (Period of current banning order: 21 April 1969 to 30 April 1974). High school teacher and sister of Dr. Neville Alexander. Sentenced to five year imprisonment in 1964 under "Sabotage Act". Banned after release. ALIE, Mohammed Cassiem Address: Elsieb River District of Bellville (Period of current banning order: 23 May 1966 to 31 May 1971). A businessman. Detained under "180-day law" from October 1966 to 51 March 1967.

-2- *ARENSTEIN, Jacqueline Address: 7 Majorca 79a Essenwood Road Durban (Period of current banning order: 31 August 1968 to 31 August 1973). Journalist. Wife of Mr. Roley Arenstein,attorney, now in . Mother of two daughters. Accused in the Treason , 1956. Served with five-year banning orders in 1963. Convicted to seven days' imprisonment in 1964 for sitting with three others in a coffee shop; acquitted on appeal. Banning orders involve 12-hour house arrest. *ASVAT, Dr. Zainap Ebrahim Address: 77 Park Drive Johannesburg (Period of current banning order: 31 December 1968 to 31 December 1973). Doctor. Former President of the Indian Women's Association. On Human Rights Day, 1963, she led a group of women who tried to present a petition to the Prime Minister protesting the Group Areas Act. The next day she was served with fiveyear banning orders. The banning orders confined her to Johannesburg, prohibited her from communicating with other banned persons, and required her to report to the police e very Monday. Banning orders renewed for another five years in 1968. Her husband, Dr. Aziz Kazi, is also a banned person, as is her sister, Mrs. . BAKER, Lewis Address: 4 Lakenheath Flats Russel Street Benoni (Period of current banning order: 11 April 1968 to 30 April 1973). Attorney. Most of his clients were Africans. Listed as a communist in 1962. Arrested in court while defending a client and detained under "90-day law" on 27 August 1964. Subsequently charged with participation in the activities of the Communist Party. Sentenced on 13 April 1965 to three years' imprisonment. Banned after release in April 1968 and struck off the roll of attorneys. Married with three children.

BALA, William Address: Esikobeni Location Cofimvaba District of St. Marks (Period of current banning order: 17 November 1967 to 31 October 1969). *BALFOUR, Mabel Address: 2752 Mphepheto Drive Dobsonville Location Roodepoort (Period of current banning order: 31 January 1969 to 31 January 1971). Trade unionist. Organizer of the African Food and Canning WTorkers Union and member of South African Congress of Trade Unions. Was banned for five years in 1964. BANI, Silas Address: 27 Nikiwe Street New Brighton Port Elizabeth (Period of current banning order 24 March 1969 to 31 March 1971). Detained in June 1965. Sentenced on 26 March 1966 to three years' imprisonment for participation in the activities of the Pan Africanist Congress. Banned after release. BARDIEN, Mogamat Tauffie Address: 99 Fifth Street Maitland Cape Town (Period of current banning order: 2 February 1966 to 30 November 1970. Cape Town taxi-driver. Former secretary of the Taxi Operators' Association and executive member of the South African Coloured People's Congress. Detained in 1960 and 1961. Charged on 24 November 1964 with conspiring to help alleged saboteurs escape from prison, and acquitted on 11 January 1965. Charged again on 13 August 1965 and sentenced to six months, three months suspended, for participating in activities of Coloured People's Congress, and to thirty days, suspended for possession of a banned journal. Banned after release from prison in February 1966. The orders confined him to his house at nights and weekends. The orders made it impossible for him to continue as a taxi-driver. Married with six children.

BARSEL, Esther Address: 39 Regent Street Yeoville Johannesburg (Period of current banning order: 11 April 1968 to 30 April 1973). Detained under "90-day law" on 26 August 1964 and went on hunger strike for 35 days until taken to court, with her husband and Mr. and others, on charge of membership in the Communist Party. Sentenced on 13 April 1965 to two and a half years on each of two counts, two years to run concurrently. Banned after release and placed under house arrest. She is required to report to the police station twice a day. Mother of three children. BASTOMSKY, Saul James (Period of current banning order: 19 February 1965 to 31 December 1969). Lecturer at the University of Natal. Left South Africa. BECK, Godfrey Kenneth (Period of current banning order: 29 May 1965 to 31 May 1970). Coloured leader. Left South Africa, BENSON, Dorothy Mary (Period of current banning order: 15 February 1966 to 31 January 1971). Writer. One of the founders of the Africa Bureau, London. Her South African passport was withdrawn in 1962. The banning orders placed her under house arrest and prohibited her from writing or transmitting any publication. She left South Africa on an exit permit later in 1966. She appeared before the United Nations Special Committee on Apartheid in 1963, 1964 and 1966. BHENGU, Moses Address: 952 Jabulary Drive Sobantu Bantu Village Pietermaritzburg (Period of current banning order: 14 April 1966 to 31 March 1971).

-5- *BHUGWAN, Sonnie Address: 32 Sydenham Road Durban (Period of current banning order: 31 December 1968 to 31 December 1973). Former secretary of Natal Indian Youth Congress. Banned since 1964. *BOCK, William Jacobus Addrc-ss: 38 Duke Street Woodstock Cape (Period of current banning order: 8 November 1966 to 31 October 1971). Former teacher. Former Acting General Secretary of Coloured People's Congress. Sentenced in 1965 to nine months' imprisonment for remaining a member of Coloired People's Congress in contravention of an earlier banning order. More stringent banning orders, after release, placed him under house arrest for 13 hours a day. Father of twelve children, he is now a clerk at an engineering firm. BONAYELE, Nicholas Address: Ntselamanzi Location Alice Victoria East (Period of current banning order: 20 February 1968 to 31 January 1970). BOOYSEN, Maggie Address: N.Y. 89 99 Guguletu District of Wynberg (Period of current banning order: 6 August 1965 to 31 July 1970). Detained in October 1963. BOSCH, Jonathan Fred Address: 16 Twelfth Street Bishop Lavis Estate Elsie's River Bellville (Period of current banning order: 8 April 1965 to 31 March 1970).

-6- Former secretary of the caretaker committee of the Cape Town Municipal Workers' Association. The banning orders prohibited him from attending gatherings and restricted him to Bellville. He was required to report once a week to police, and was placed under house arrest for twelve and a half hours each weekday, from 7 a.m. to 2 p.m. on Saturdays and for 24 hours on Sundays and public holidays. *BROWN, Peter MacKenzie Address: Shinglewood 385 Howick Road Pietermaritzburg (Period of current banning order: 31 July 1969 to 31 July 1974). Former National Chairman of the Liberal Party. Served with a five-year banning order in 1964 which prevented him from attending political or social gatherings, or any gathering of students or pupils for the purpose of being instructed. Confined to magisterial district of Maritzburg. Banning orders renewed in 1969. BRUTUS, Dennis Vincent (Period of current banning order: 6 July 1965 to 31 July 1970). Poet and teacher. President of the South African Non-Racial Olympic Committee and Director of the World Campaign for the Release of South African Political Prisoners (of the International Defence and Aid Fund). Served with banning orders in 1961. Arrested in Mozambique in September 1963 and handed over to South Africa. Shot while allegedly attempting to escape. Sentenced to eighteen months' imprisonment. Released on 8 July 1965. Served with banning orders before release, and placed under house arrest. Left South Africa on an exit permit on 29 July 1966. Appeared before United Nations Special Committee on Apartheid and before Ad Hoc Working Group of Commission on Human Rights, in 1967 and 1968. BRUTUS, Wilfred Cecil Joseph (Period of current banning order: 3 May 1965 to 30 April 1970). Teacher. A leader of the Coloured People's Congress and South African Non- Racial Olympic Committee. Banned in 1964. Served with more stringent banning and house arrest orders on 3 May 1965. Served 15 months in prison for contravening banning orders and released on 20 March 1967. Charged again with contravening banning orders and sentenced on 31 August 1967 to three years in prison. Fled from South Africa in November 1967, while on pending appeal.

Had earlier been imprisoned for several years for participation in the activities of the African National Congress. BUTELEZI, Bafana Samuel Address: J 1097 Kwa Mashu Bantu Village District of Inanda (Period of current banning order:24 February 1966 to 31 January 1971). BUTHELEZI, Babazi Joseph Address: F 166 Kwa Mashu Bantu Village District of Inanda (Period of current banning order: 22 February 1966 to 31 January 1971). BUTHELEZI, Musa Hamilton Address: 52 Madeleni Bantu Township Newcastle (Period of current banning order: 27 May to 31 May 1970). *CACHALIA, Amina Address: 2 Luttig Street Fordsburg Johannesburg (Period of current banning order: 30 November 1968 to 30 November 1973). Wife of Mr. Yusuf Cachalia and sister of Dr. Z. E. Aivat, also banned persons. Collaborated with Mrs. in tracing and assisting banished Africans. ,.Banned since 1963. Banning orders involve partial house arrest.

-8- *CACHALIA, Yusuf Ahmed Address: 2 Luttig Street Fordsburg Johannesburg (Period of current banning order: 30 November 1968 to 30 November 1973). A prominent leader of the South African Indian Congress. Detained in December 1966 and held for ninety days. Banned since 1963. Banning orders involve partial house arrest. *CAJEE, Dawood Ismail Address: 139 Reneke Street Schweizer-Reneke (Period of current banning order: 31 January 1969 to 31 January 1974). About 71 years old. Businessman. Former executive member of Indian Congress. Detained in 1960 and 1963. Banned in 1964. Charged in 1965 and 1968 with contravening banning orders, but acquitted. CELE, Bungo (Joseph) Address: Block 342, Door 8709, Bed 8711, Kwa Mashu Bantu Township District of Inanda (Period of current banning order: 18 February 1966 to 31 January 1971). CHAMILE, Mokone Andrew (Andries) Address: 281 Tabeth Street Western Bantu Township Johannesburg (Period of current banning order: 9 July 1965 to 30 June 1970). About 70 years old. One of the accused in the Treason Trial, 1956. Worked in the office of Defence and Aid Fund, Johannesburg, from 1960 until banned. The banning orders involve house arrest for 12 hours on weekdays, and 24 hours on weekends and holidays. CHANNON, Charles Percival (Period of current banning order: 18 April 1966 to 30 April 1971).

-9- T.V. Cameraman. Represented Visnews in South Africa. Banning orders included house arrest for 15 hours a day. Left South Africa on an exit permit on 13 July 1966. CHEITY, Iyavar Moonsamy Address: 3 Luxmi Court Main Road Tongaat, Natal (Period of current banning order: until 30 November 1970. Formerly high school teacher. Banning orders confined him to the magisterial district of Inanda and required him to report to police once a week. He was prohibited from entering African reserves, factories, harbour areas and educational institutions. CHOABI, Seretse Petrus (Period of current banning order: 19 December 1967 to 31 December 1969). Detained under "90-day law" in 1964 while student at University College of Fort Hare. Served a three-year prison . Discharged in January 1968 in bad health and immediately served with banning orders. Left South Africa to study at Oxford University. CRAIGHEAD, David Hepburn (Period of current banning order: 28 April 1965 to 30 April 1970). Chairman of the Defence and Aid Fund, Johannesburg, and national vice- chairman of the Liberal Party until banned. Left South Africa. CRANKO, Robin Philip Address: 2 Dana Court Durban Street Bellevue Johannesburg (Period of current banning order: 18 May 1967 to 30 April 1972). . Deported from Lesotho in December 1966 and detained under "180-day law" in South Africa. Banned after release.

Tried under "Sabotage Act" and acquitted in November 1964. DHLADHLA, Johannes Nomandla Address: 8939 b Elizabethville Orlando West Johannesburg (Period of current banning order: 10 February 1965 to 31 January 1970). *DICK, Nancy Graham (Period of current banning order: 27 May 1966 to 31 May 1971). Trade union secretary. Banned earlier in 1959. Left South Africa in 1967. DICK, Samuel Address: Molteno Necter Road Retreat Wynberg (Period of current banning order: 4 May 1965 to 30 April 1970). A leading member of the Liberal Party in the Cape Peninsula. The banning orders prohibited him from attending gatherings, restricted him to Wynberg and Cape Town magisterial districts and required him to report to the police station every Monday. DOCRAT, Abdul Khalek Address: Flat 8, 81/3 Victoria Street Durban (Period of current banning order: 22 December 1964 to 31 October 1969). Salesman.

- 11 - DOYLE, EOlly Irene Address: Leeukop losendal District of Ficksburg (Period of current banning order: 12 October 1967 to 31 October 1972). A niece of Mr.Abram Fischer. Former secretary of South African Congress of Trade Unions. Served six months in prison in 1963-64 for helping to distribute a pamphlet of African 1'ational Congress. Actress. Wife of Mr. Marius Schoon, now serving a 12-year prison sentence. Former member of Congress of Democrats. Banned in 1963. Sentenced on 14 October 1965 to twelve months' imprisonment, two months suspended, for pasting up African National Congress leaflets in 1962. Sentenced again on 14 October 1966 to 24 months imprisonment, all but ten days suspended, on charge of contravening banning order by failing to notify police of change in place of employment. Prohibited, under the banning orders, from entering any educational institution or factory or any non-white location except Athlone. Required to report to police every0Monday. Father of three children. SOBUKWE, Robert Address: 6 Naledi Street Kimberley (Period of current banning order: 13 May 1969 to 31 May 1974). Leader of Pan Africanist Congress. Sentenced in 1960 to three years' imprisonment for incitement against the pass laws. After completion of his sentence, he was detained by special legislation on for six years. Released from detention on 13 May 1969 and was immediately placed under house arrest and banning orders. He is confined to his house from 6 p.m. to 6 a.m. daily and is prohibited from leaving the magisterial district 'of Kimberley and taking part in teaching and publication.

Arrested in 1961 and charged with commission of five explosions in the Port Elizabeth area. Sentenced in May 1962 to six years' imprisonment, three years of which were suspended. Charged again on 31 March 1965, while still in jail, with participation in Umkonto We Sizwe in 1961. Acquitted on 21 May 1965. After release, he gave interviews on conditions in which were published in Rand Daily Mail on 30 June and 2 July 1965 and attracted world-,wide attention. Served with banning orders on 2 July 1965 placing him under "house arrest" from 6 p.m. to 7 a.m. and preventing him from teaching or writing. Sentenced on 27 January 1966 to two and a half years' imprisonment on charges of perjury and contravening the Prisons Act. Sentence reduced on appeal to 18 months. Peleased from prison in June 1967 but remains under house arrest.
