Preamble

Design guidance in the existing Shopfront and Commercial Properties SPD, specifically that relating to ‘Paint Colours’ on pages 16 and 17, was intended to ensure that the colours used on individual properties reflected the historic period from which the property originated. More recently this guidance has been reviewed in the light of architectural paint research undertaken by English Heritage, and other heritage paint manufacturers, including Little Greene (English Heritage), Dulux (Heritage range), and Farrow and Ball with reference also made to the paint ranges set out in the British Standards.

This research has identified that many shop fronts from the period 1780 to 1840 (Georgian/Regency) were painted in lighter, more neutral ‘stone’ coloured shades including greys, creams, beige/fawn along with imitation wood, and shades of brown and green. Shop fronts from the period 1840 to 1920 (Victorian/Edwardian) generally used darker, richer colours including blues, greens, reds and black. However the neutral shades of grey, beige/fawn and dark cream from the previous era may also have been used.

Based on this research it is therefore considered that the advice contained within the SPD on paint colours should reflect more flexibility in the palette of colours that are considered to be acceptable. Whilst the recommended changes would allow greater flexibility they still seek to preclude the use of colours that do not reflect the historical context of an individual property.

This review has been undertaken on the basis that any amendment to the advice within the Shopfront and Commercial Properties SPD would not lead to a detrimental impact upon the special character and appearance of listed buildings, would continue to preserve or enhance conservation areas and would ensure objectivity in the considerations of relevant planning and listed building applications.

1. Introduction

1.1 Under the Town and Country Planning (Local Development) (England) Regulations 2004 it is a requirement to prepare and publish a Consultation Statement for a range of planning policy documents, including Supplementary Planning Documents (SPDs). This is a reflection of Government’s desire “to strengthen community and stakeholder involvement in the development of local communities”.

1.2 Regulation 17 of the Town and Country Planning (Local Development) (England) Regulations 2004 relates to public participation and requires local planning authorities to prepare a Consultation Statement when undertaking consultation on a Supplementary Planning Guidance, or on any proposed revisions to that guidance document.

1.3 This statement is intended to meet the requirements of Regulation 17 and seeks to provide a clear public statement to enable the community to know how they can be involved in the proposed revisions to the Shopfront Design Guidance SPD.

The Statement sets out: • The programme for public consultation; • Who will be consulted; • The consultation process and where and how the consultation will take place; • How representations will be incorporated into the process.

2 Programme for Public Consultation

2.1 In order for the District Council to revise the Shopfront SPD, the document must be subject to a formal public consultation process. The Council has resolved that this will be for a period of six weeks. This will enable all interested parties, including statutory organisations, private developers, consultants, amenity groups and the public, to comment on the proposals.

2.2 The six-week formal public consultation process on Proposed Revisions to the Shopfront & Commercial Properties Design Guidance SPD in respect to the section relating to ‘Paint Colours’, will commence on Wednesday 14 th March 2012 and will finish on Wednesday 25 th April 2012.

2.3 Planning Policy Statement 12 (PPS12) recommends that SPD’s should be prepared taking into consideration the process of continuous community involvement. The Council’s Statement of Community Involvement sets out how people will be involved in the consideration of SPDs and it requires the Council to undertake the following consultation for revisions affecting the SPD:

• Make the documents available for review at Council offices; • Send the SPD to an existing network of organisations; • Prepare press releases (including a Statutory Notice); • Place information and documents on the Council’s websites.

2.4 Any comments on the proposed revisions to the SPD will need to be received by the District Council by 5.00pm on Wednesday 25 th April 2012. Any representations made after this time will not be accepted.

When submitting your representations on the proposed revisions you may also request to be notified at a specified address of the progress and of the future progress and final adoption of the SPD.

3 Who will be Consulted?

3.1 The Council will re-consult, those bodies and individuals previously consulted on the currently adopted SPD: • Parish and Town Councils, within and adjoining Derbyshire Dales; • Statutory consultees identified in relevant planning legislation and guidance; • Planning consultants who work in the District; • Other non-statutory groups such as local civic societies; • Associations representing shop-fitters and Insurance Companies.

4 The Public Consultation Process

4.1 In addition to the consultees listed in Appendix 1, the general public are invited to comment on the proposed revisions. In accordance with Regulation 17 of the Town and Country Planning (Local Development) (England) Regulations 2004 the Council has published a statutory notice in local newspapers advertising the publication of these proposed revisions.

4.2 Copies of the SPD on Shop Fronts and Commercial Properties Design Guidance, the related Existing Extract, the Revised Text and the Consultation Statement will be available for inspection at the following locations:

5 How will Comments and Responses on the Draft SPD be incorporated into the process?

The District Council will formally record any written representations on the proposed revisions received within the specified consultation period. Following the closure of the six-week public consultation period, all written responses will be summarised and recorded in a single document. A report will then be produced listing all representations received, a response to each representation and a recommendation as to what changes, if any, should be made to the revisions as proposed on ‘Paint Colours’. This document will be presented to the District Council’s Partnership & Regeneration Committee, and if necessary, amendments will be made prior to adoption.
