In reference to the above, we are sending you Request for financial Bid. The Food Court at Calcutta High Court, Kolkata, West Bengal has been completely renovated and fitted with furniture, kitchen equipments. The electricity and water will be provided free of cost by Calcutta High Court, Kolkata, West Bengal. The cost of pest control & housekeeping will be borne by service provider. The service provider at his own cost will bring kitchen utensils, cutlery and crockery & service gears. Repair & maintenance of the equipments, furniture & fixtures provided at Calcutta High Court will solely be the responsibility of the selected service provider. You are requested to send detailed plan for manpower to be deployed, and the financial quote in the given format. The approved menu items along with the rates are enclosed for your reference. In case of any clarifications, please contact the undersigned. Page 2 of 17 INSTRUCTIONS 1 Bid document is for providing catering services at Food Court at Calcutta High Court, Kolkata, West Bengal. The Food Court is situated in the ground floor of Centenary building of Calcutta High Court. 2 All bid papers submitted should be serially numbered. 3 This bid document should be duly signed and stamped by the authorized signatory of the applicant. The bid document should be submitted in original. Offer not submitted along with Bid document in original will summarily be rejected. 4 License for management of catering services in the Food Court at Calcutta High Court, Kolkata, West Bengal will normally be awarded to the party quoting highest percentage of license fee on gross sale per month, in the given format. Page 3 of 17 TERMS AND CONDITIONS GENERAL 1. Successful Service provider will arrange his own kitchen utensils, including cutlery and crockery required for running the Food Court. 2. The service provide will ensure proper upkeep, repair & maintenance the all the furniture, fixtures & equipments provided at Calcutta High Court, irrespective of whether provided by IRCTC or Calcutta High Court. Cost of damage of the above, if any, will have to be borne by the selected service provider. 3. Successful Service provider will obtain necessary certificates/permissions as required by law such as food licence, or any other stipulated statutory document from the competent authorities. 4. The premises, electricity, water shall be provided by Calcutta High Court free of cost to the successful Service provider. Use of electricity should be restricted for use of Bain-Marie, Micro-Wave, Toasters, Geysers, and Visi-Cooler etc. However, food should not be cooked through use of electricity. 5 Tenure: Tenure of licence will be w.e.f 01.01.2015 to 10.09.2015 which could be further extended for a maximum tenure of two (02) years, subject to the extension of the MOU between IRCTC and High Court authority and satisfactory services of the service provider, at the sole discretion of IRCTC. The operation / agreement can be terminated during the operative period by giving 30 days notice in writing by IRCTC. 6 Licence for management of catering services at Food Court at Calcutta High Court, Kolkata, West Bengal will, normally, be awarded to the party quoting highest percentage of license fee on Page 4 of 17 gross sale per month, in the given format. However IRCTC has sole discretion to award the catering services to any other party. The decision of IRCTC in this regard shall be final and binding. 7 The successful Service provider shall, at all times indemnify IRCTC against all claims and penalties which may be suffered by IRCTC or any person employed by them by reason of any default on the part of the Service provider in due observance and performance of provision of, i) Workmen’s Compensation Act -1923 ii) Employment of Children’s Act XXVI of 1938 and iii) Contract labour regulation and abolition Act-1970 and other statutory laws. 8 The employees, contractors, sub contractors of the successful Service provider will not be in any contractual relation with IRCTC. 9 The successful Service provider will bear the cost, throughout the term of License, for comprehensive general liability insurance for his men and material. 10 Successful Service provider shall be responsible for compliance of provisions of Prevention of Food Adulteration Act, 1954 or any other amendments thereto. 11 A Service Level Agreement (SLA) will be signed between the successful Service provider and IRCTC. 12 The contractor shall issue Identity Cards to all its workers. 13 IRCTC will not be liable for any liability arising under the labour laws, non-payment of taxes of any statutory taxes or any other law of the land incurred by the successful Service provider in course of performance of activities under the Agreement. Page 5 of 17 14 The successful Service provider shall be responsible for the conduct and behavior of his employees. 15 All cash transactions will be handled by IRCTC Officials. 16 In case successful Service provider is found indulging misbehavior and malpractices such as bad quality, wrong portioning, unapproved items and prices, and any other such offence which is against the spirit and terms of the contract and any adverse performance in regard to quality and quantity, the Service provider will be given a warning and for any subsequent offence, will be appropriately penalized not below the amount of ₹ 1000.00 (₹ One thousand only). 17 Display of Rate List: Legible rate list displayed as per IRCTC standards with menu card. 18 Food Court service: Self service system should be adopted in the Non-Ac portion of Food Court and personalized service in AC portion of Food Court. 19 Billing system: Printed bill/receipt should be given to the customers through POS machine. 20 Safety: The Licensee shall be responsible for the safety of the workers. All the safety measures must be taken in the operation of Food Court in the interest of smooth operation. 21 Uniform: The staff should be in standardized presentable smart uniform with name tags. The uniform should be cleaned well ironed. Uniforms to have prominent IRCTC logo. Uniform design to be approved by IRCTC/Calcutta High Court. All managers and chef should have uniforms as per industry standards. Page 6 of 17 22 Training of staff: The staff should be courteous enough to deal with the hon’ble Judges & other high level officials and to be trained and provided with all necessary information on safe handling and maintenance of equipments and to lay emphasis on service orientation and personal hygiene. 23 Premises, electricity and water will be provided free of cost to the service provider at the Calcutta High Court, Kolkata, West Bengal. Use of electricity should be restricted to re-heating and for use Bain-Marie, Micro-Wave, AVM machines, Toasters, Geysers, Visi-Cooler etc. However, food should not be cooked through use of electricity. 24 Pest Control: Pest control will be done regularly by service provider and will be properly documented. The cost of the pest control will be borne by service provider. 25 Disposal of Garbage: Collection of garbage and its proper disposal at equal and regular interval of time on daily basis will be responsibility of the licensee. 26 Visitor Book: Visitor book/Feedback forms should always be available and also feedback should be obtained from the guests/users. 27 Food audit for quality and food safety must be integral part of Kitchen Operations. 28 Table Clearance: - The service provider will be responsible to ensure the proper clearance of all used plates and utensils in the Food Court. In this regard the service provider should provide adequate manpower for smooth operation of Food Court. 29 Housekeeping - Regular cleaning of the allotted premises shall be the responsibility of the licensee who should engage adequate staff for cleaning & pot washing etc. Page 7 of 17 30 Food Court- VIP service: The AC portion of Food Court will be managed by the licensee through providing personalized table services etc. Licensee may also required to render catering services to the judges, senior advocates and higher officials of Calcutta High Court in their chambers as and when required as requested by Calcutta High Court authority. 31 Register for Block stock & kitchen equipment-Service provider has to maintain the block stock & Kitchen equipment register. 32 VIP Catering-Service provider has to render the special/VIP catering in a special occasion as desired by Calcutta High Court/Kolkata authority from time to time within short notice. The bill for the same will be raised separately to IRCTC as per the rate and mutually agreed terms & condition between IRCTC & Calcutta High Court, Kolkata. III SECURITY DEPOSIT i) Security of ₹ 1,00,000/- (Rupees One lakh only) for the Food Court will be submitted by the Service provider within 7 days of acceptance of LOA. No interest will be admissible on this Security Deposit. ii) The security deposit is liable to be forfeited if the successful Service provider unilaterally withdraws amends, impairs or derogates from terms and conditions in any respect during its currency.

After independence, this monument continues to be known for its beautiful architecture and green surroundings. 2 To the north of the Victoria Memorial Hall is a huge stretch of land known as ‘the Maidan’ which is covered by green grass and interspersed with a large number of trees, bushes and shrubs. At the end of about 2 kms. of this greenery is the Esplanade where another monument known as the ‘Sahid Minar’ stands, and by the side of the Sahid Minar is a bus terminus. To protect and preserve the Victoria Memorial Hall and its green surroundings, a public interest litigation (Writ Petition No. 7987(W) of 2002) was filed in the Calcutta High Court by the respondent nos. 1 to 5. 4. Rabindra Sarovar plays a major role in maintaining ecological equilibrium in the city, particularly in its southern part, and has never been associated with practicing any religious or social rituals. However during last few years, the Sarovar has been severely affected environmentally; often in the name of culture and religion especially during Chhat Puja. We take this opportunity to remind that a committee involving primarily government officials and experts, set up under NGT order, highlighted the threat to Rabindra Sarobar and recommended the ban on such events in Rabindra Sarobar; based on which NGT passed the ‘ban Chhat puja’ order.
