Learning and growing 3 Editorial Welcome all to the August issue of The Mylander I’d fi rstly like to thank all those that got in touch aft er my very fi rst issue of The Mylander in May. I am looking forward to delivering many more issues to your door and meeti ng some of you on my hunt for stories! I hope this reaches you well and that you are enjoying the summer, with all that it brings. And especially to those who have the added joy (and challenges!) of moving into their new home. Living on the Chesterwell estate, it is fascinati ng to see just how quickly these houses are going up—and before you know it there are cars on the driveway! A warm welcome to all our new neighbours. I know there are many new families joining our community and I have tried to put myself in your shoes—what do you want or need to know about your new community? Please take a look at the new secti ons; Council Reports, Sport, From inside the Community, Charity, Churches and Learning & Growing. There is also a new feature of the magazine, the ‘What’s on’ guide, which I hope will develop as businesses and groups add to this in coming months. I hope, whatever your interests, that you fi nd something to read about in this issue. I have really enjoyed getti ng to know more and more people from our Parish, be it councillors, members of the community, or businesses. There is a great buzz about our growing community and it will be great to see everyone together at the MCC Summer Fete on August Bank Holiday (Monday 26th). If you have not heard much about this, please turn to the advert on the back page or p17 to see what fantasti c prizes are available in the raffl e. I am sure it will be a day not to be missed and great fun for the whole family. There is not much else to say other than ... happy reading! Kati e Maddocks Editor 4 Myland Community Council This is my first Mylander contribution since being elected Chairman of the Council in May this year. I want to thank Councillor Pete Hewitt for all he has done as Chairman for the last year. I am pleased to say he has agreed to remain as Vice Chairman of the Council and also remain on our Planning & Highways Committee, where his expertise is very much appreciated. The Council elections in May drew an increase in applicants to be a Councillor in the Myland Ward and such interest is always rewarding. Indeed, as at July, we have two vacancies for co- option to the Council and have four candidates applying. The successful two candidates will be decided at our July meeting. Parish Councils remain largely ‘apolitical’ and free from party politics and Myland is no exception, believing that we work better for the Parish as a team. As a Council we have expanded our profile, not only on our website, but to Facebook as well. Our new Chair of the Community Engagement Committee, Marina de Smith, has ensured our presence at local fetes and is the driving force behind our Annual Fete. All of this ensures we do as much as we can to meet with and ascertain the views of residents in Myland. If you want to know more about your Council, please approach any of our Councillors (listed in the front of this magazine) or contact the Clerk to the Council, Katherine Kane (01206 854300), who will be pleased to assist you. My job as Chairman is to ensure our Council meetings are managed and properly conducted. But I am also the public face of the Council and attend meetings and maintain liaison with Colchester Borough Council colleagues. I also meet regularly with our Borough Ward Councillors i.e. Mile End (Martin, David and Phil) and our Highwoods Ward (Gerard, Beverly and Phil). In May, I was pleased to be invited to attend the Annual Mayor Making Ceremony in the Town Hall, which saw Councillor Beverley Oxford elected as Deputy Mayor. The next 12 months will no doubt be challenging but be assured that we, as a Council, are working to make sure Myland Council is working for you to improve your quality of life. Decision(s) Required 1.1 To recommend to Full Council that it makes (adopts) the Myland and Braiswick Neighbourhood Plan (attached as Appendix A), following its approval at examination and referendum. Once adopted, the Myland and Braiswick Neighbourhood Plan will become part of Colchester Borough Council’s Local Development Plan. 2. Reasons for Decision(s) 2.1 To ensure the Council’s planning policies provide a robust basis for decisions on future planning applications in the Borough. 3. Alternative Options 3.1 The alternative would be to recommend to Full Council that it does not adopt the Neighbourhood Plan. This alternative, however, would be contrary to the positive approach to Neighbourhood Plans found in the National Planning Policy Framework (Paras 184-185). 4. Supporting Information 4.1 On 28 January 2013, Colchester Borough Council designated the Myland and Braiswick Neighbourhood Plan Area for the purpose of preparing a Neighbourhood Plan (in accordance with Part Two of the Town and Country Planning (England), Neighbourhood Planning (General) regulations 2012). The plan area includes the whole of Myland Parish, an additional area of Braiswick and a small area which is now within Highwoods Ward (following the recent Boundary Review). 4.2 The Neighbourhood Plan Working Group comprising Myland Community Council councillors, Braiswick Residents Association representatives and resident representatives carried out development and consultation on the Neighbourhood Plan.

    COLCHESTER BOROUGH COUNCIL MYLAND AND BRAISWICK NEIGHBOURHOOD PLAN DECISION STATEMENT 1. INTRODUCTION Under the Town and Country Planning Act 1990 (as amended), the Council has a statutory duty to assist communities in the preparation of Neighbourhood Development Plans (and Orders) and to take plans through the processes of examination and referendum. The Localism Act 2011 (Part 6 chapter 3) sets out the Local Planning Authority’s responsibilities under Neighbourhood Planning. This decision statement confirms that the modifications proposed by the examiner, in his report dated 5 May 2016 have been accepted by both Colchester Borough Council and Myland Community Council, the draft Myland and Braiswick Neighbourhood Development Plan has been altered to reflect these changes and the plan may now proceed to referendum. 2. BACKGROUND On 28 January 2013, Colchester Borough Council designated the Myland and Braiswick Neighbourhood Area for the purpose of preparing a Neighbourhood Plan in accordance with Part Two of the Town and Country Planning (England), Neighbourhood Planning (General) regulations 2012. Following the submission of the Myland and Braiswick Neighbourhood Plan to the council the plan was publicised and representations were invited. The publicity period ended on 22 nd February 2016. Colchester Borough Council appointed an independent examiner, Dr. Angus Kennedy OBE, MA, MRTPI, MCIH to examine whether the Plan meets the necessary basic conditions and legal requirements and should proceed to referendum. 3. Decision Section 18 (1) c of the Neighbourhood Planning (General) Regulations 2012 requires the local planning authority, in this case Colchester Borough Council, to outline what action to take in response to the recommendations of the examiner made in a report under paragraph 10 of Schedule 4A to the 1990 Act (as applied by Section 38A of the 2004 Act) in relation to a Neighbourhood Development Plan.
