‘A Man of Courage and Activity’: Thomas Tew and Pirate Settlements of the Indo - Atlantic Trade World, 1645 -1730 1 Kevin McDonald Department of History University of California, Santa Cruz “The sea is everything it is said to be: it provides unity, transport , the means of exchange and intercourse, if man is prepared to make an effort and pay a price.” – Fernand Braudel In the summer of 1694, Thomas Tew, an infamous Anglo -American pirate, was observed riding comfortably in the open coach of New York’s only six -horse carriage with Benjamin Fletcher, the colonel -governor of the colony. 2 Throughout the far -flung English empire, especially during the seventeenth century, associations between colonial administrators and pirates were de rig ueur, and in this regard , New York was similar to many of her sister colonies. In the developing Atlantic world, pirates were often commissioned as privateers and functioned both as a first line of defense against seaborne attack from imperial foes and as essential economic contributors in the oft -depressed colonies. In the latter half of the seventeenth century, moreover, colonial pirates and privateers became important transcultural brokers in the Indian Ocean region, spanning the globe to form an Indo-Atlantic trade network be tween North America and Madagascar. DEWrrE* INTRODUCTION In the aftermath of the terrorist attacks of September 11, the United States has repeatedly emphasized the asymmetry between traditional war and the War on TerrorlI-an unorthodox conflict centered on a term which has been continuously reworked and reinvented into its current conception as the "new terrorism." In this rendition of terrorism, fantasy-based ideological agendas are severed from state sponsorship and supplemented with violence calculated to maximize casualties.' The administration of President George W. Bush reinforced and legitimized this characterization with sweeping demonstrations of policy revolution, comprehensive analysis of intelligence community failures,3 and the enactment of broad legislation tailored both to rectify intelligence failures and provide the national security and law enforcement apparatus with the tools necessary to effectively prosecute the "new" war.4 The United States also radically altered its traditional reactive stance on armed conflict by taking preemptive action against Iraq-an enemy it considered a gathering threat 5 due to both state support of terrorism and malignant belligerency. -

Corsaires vs pirates ou la formation d’un partenariat public-privé pour l’établissement d’un dispositif permanent face à la menace pirate VALENTIN LARA* RÉSUMÉ De toutes les menaces pesant sur la sûreté maritime, la piraterie est certainement celle qui a le plus fait parler d’elle ces dernières années. À la suite d’une série d’at- taques inouïes de par leur niveau de violence, la communauté internationale dépêcha en 2008 une flotte militaire au large des côtes somaliennes afin d’y restaurer l’ordre et la sécurité. Toutefois, face aux coûts importants engendrés par un tel dis- positif, une certaine doctrine n’a pas hésité à soutenir un recours accru au secteur privé dans le cadre de la lutte contre la piraterie. Pour ce faire, la question de la résurgence des lettres de marque, qui permettaient autrefois la guerre de course, fut notamment abordée. Cette tentative d’employer le système corsaire d’antan dans le contexte des enjeux maritimes du XXIe siècle n’est pas sans poser des questions sur la compatibilité d’un tel dispositif avec le droit international moderne. Bien loin d’écarter la pertinence d’un recours accru au secteur privé, l’auteur met toutefois l’accent sur la nécessité d’établir un système durable au sein duquel les entreprises pourront participer aux interventions navales présentes et futures. Après avoir établi les conditions d’usage des lettres de marque par les États, l’auteur suggère fortement la formation d’un partenariat entre le secteur public et le secteur privé, dont les modalités devront écarter tous risques inhérents au recours à des sociétés militaires privées. -

Il ajoute un peu plus tard : “Le passé n'a de sens que par rapport aux questions que nous posons maintenant. Et les seuls événements importants sont ceux qui ont eu des enfants et qui agissent encore, directement ou non, dans la vie d'aujourd'hui”. Comme Claude Wanquet l'a montré dans sa thèse, l'esclavage est très présent dans les réalités et les préoccupations insulaires à l'époque révolutionnaire2. Qu‟en est-il en 1968 quand j‟arrive à la Réunion ? Des réactions contrastées aux questions que je pose me font penser, aujourd‟hui encore, que je peux m‟inspirer des propos des deux historiens : prégnance de l'esclavage et de sa postérité, même sous forme fantomatique, présence des “enfants” de l‟institution longtemps après l‟Abolition de 1848. En 1968, j‟avoue naïvement aux premières personnes que je rencontre mon désir de travailler sur l‟esclavage et je sollicite des informations. -

You do it with a great fleet and are called an emperor.”’ Augustine, The City of God.1 1 Introduction Piracy, including the ways in which it was viewed over time, is predominantly considered the way David Luban does in his article with the telling title ‘The Enemy of All Humanity.’2 This common approach takes Cicero’s concept ‘enemy of all’ (communis hostis omnium) as a point of departure and ends with the special place piracy holds today within the field of international law because of the uni- versal jurisdiction that applies. In between legal scholars are mentioned who used or adapted Cicero’s expression, including the medieval jurist Bartolus Saxoferrato (1314-1357) and the early modern jurist Alberico Gentili (1552-1608) who con- nected piracy with the law of nations. -

Nathaniel Mayo: Documenting an American Merchant Seaman of the Early Nineteenth Century Anne Morddel Abstract Early nineteenth century American merchant seamen roamed the Atlantic World and many are well documented in the libraries and archives of the countries warring around the Atlantic at the time, as well as in the archives and papers of the American consuls in those countries. This study is of one seaman, Nathaniel Mayo of Massachusetts. Town records and the Federal census give little more than his name and that he was a seaman. However, French archives reveal that he was a mate on a vessel evading the strictures of the Embargo Act, was captured and became a prisoner of war. Consular papers contain letters from him and his father. State Department correspondence and French archives both show that he was on the crew of the privateer, the True-Blooded Yankee, while British archives describe his imprisonment in England. Court and prize records in Massachusetts show that he returned home to make a claim for his prize money. Hundreds more American seamen appear in Atlantic World records and archives; studying them could shed quite a lot of light on their hitherto anonymous lives. _______________________________________________________ Documenting American merchant seamen of the first twenty or thirty years of the nineteenth century is quite difficult. Town registers of births, marriages and deaths may tell the three basic events of their lives but nothing more. Looking beyond registers, the Seaman’s Protection Certificates carried a description of the man but little more; crew lists of merchant vessels were rare and few were preserved; vessel registration gave the names of a ship's owner and master only.
