A/49/172 Français Page 4 LETTRE D’ENVOI Le 7 mai 1994 Monsieur le Secrétaire général, Le Comité spécial chargé d’enquêter sur les pratiques israéliennes affectant les droits de l’homme du peuple palestinien et des autres Arabes des territoires occupés a l’honneur de vous transmettre ci-joint, conformément aux paragraphes 5, 6 et 7 de la résolution 48/41 A de l’Assemblée générale, un rapport périodique qui met à jour les renseignements du rapport qu’il a adopté et présenté le 14 janvier 1994 (A/49/67). Le présent rapport périodique a été établi afin de porter à votre attention et à celle de l’Assemblée générale une information à jour sur la situation des droits de l’homme dans les territoires occupés. Ce rapport porte sur la période comprise entre le 1er décembre 1993 et le 31 mars 1994. Il se fonde sur les documents reçus de diverses sources, parmi lesquelles le Comité spécial a choisi les extraits et les résumés pertinents. A/49/172 Français Page 5 I. INTRODUCTION 1. Par sa résolution 48/41 A du 10 décembre 1993, l’Assemblée générale : "5. Prie le Comité spécial, en attendant qu’il soit entièrement mis fin à l’occupation israélienne, de continuer à enquêter sur la politique et les pratiques israéliennes dans le territoire palestinien occupé, y compris Jérusalem, et dans les autres territoires arabes occupés par Israël depuis 1967, de procéder avec le Comité international de la Croix-Rouge aux consultations voulues conformément à son règlement pour sauvegarder le bien-être et les droits de l’homme des peuples des territoires occupés, et de présenter au Secrétaire général un rapport à ce sujet le plus tôt possible, et, par la suite, chaque fois qu’il y aura lieu; 6. Prie également le Comité spécial de présenter régulièrement au Secrétaire général des rapports périodiques sur la situation dans le territoire palestinien occupé; 7. Prie en outre le Comité spécial de continuer à enquêter sur le traitement des prisonniers dans le territoire palestinien occupé, y compris Jérusalem, et dans les autres territoires arabes occupés par Israël depuis 1967;" 2. Le Comité spécial a poursuivi ses travaux conformément au règlement intérieur figurant dans le premier rapport qu’il avait adressé au Secrétaire général, et a tenu la seconde de ses séries de réunions du 25 avril au 7 mai 1994 à Genève, au Caire, Amman et Damas. M. Stanley Kalpagé (Sri Lanka) a continué d’assumer la présidence. A aussi participé aux réunions M. Ibra Déguène Ka (Sénégal); M. Abdul Majid Mohamed, qui représente la Malaisie au Comité spécial, a participé aux réunions tenues à Genève et au Caire. M. Zainal Azman Zainal Abidin a représenté la Malaisie au cours des réunions du Comité spécial tenues à Amman et Damas. 3. Dans la section II du présent rapport, le Comité spécial décrit la situation dans les territoires arabes occupés par Israël dans la mesure où elle affecte les droits de l’homme de la population civile. Les informations figurant dans ce rapport reflètent les renseignements écrits que le Comité spécial a reçus au cours de la période allant du 1er décembre 1993 au 31 mars 1994. Le Comité spécial a suivi la situation dans les territoires occupés jour après jour, sur la base des articles parus dans la presse israélienne et de la presse en langue arabe publiée dans les territoires occupés. Il a également examiné plusieurs communications et rapports émanant de gouvernements, d’organisations et de particuliers et concernant la période considérée. 4. A/49/172 Français Page 6 II. RENSEIGNEMENTS RECUEILLIS PAR LE COMITÉ SPÉCIAL A. Situation générale 1. Évolution générale et déclarations officielles 5. Le 1er décembre 1993, Israël et la Jordanie ont conclu un accord permettant à Amman d’ouvrir de nouvelles banques dans les territoires sans limitation de leur nombre. (Jerusalem Post, 2 décembre 1993) 6. Le 1er décembre 1993, le Procureur général Michael Ben Yair a déclaré que la création d’une organisation paramilitaire "Hashomer" envisagée par les colons pour assurer la protection des colonies de peuplement serait illégale et que les responsables de la sécurité devaient s’y opposer. (Ha’aretz, Jerusalem Post, 2 décembre 1993) 7. Le 1er décembre 1993, il a été signalé que la police avait récemment arrêté les sept membres d’une cellule du mouvement Hamas du quartier d’Abu Tor qui avaient lancé des cocktails Molotov sur un hôtel de Jérusalem le 6 septembre. (Jerusalem Post, 1er décembre 1993) 8. Le 3 décembre 1993, il a été signalé que l’enquête ouverte sur le décès d’Ahmed Abu Rish, le 28 novembre, avait révélé que la victime n’était pas armée et n’avait pas tiré lorsqu’elle avait été abattue par des agents secrets des FDI, contrairement à ce que leur porte-parole avait affirmé. Deux fugitifs recherchés des Fatah Hawks se trouvaient à son domicile lorsque les forces de défense israéliennes (FDI) ont fait irruption et ont commencé à tirer. Les deux fugitifs ont réussi à s’échapper. (Ha’aretz, 3 décembre 1993) 9. Le 7 décembre 1993, des dizaines de sections, dont plusieurs unités de combat d’élite, ont été déployées sur la Rive occidentale à la suite du meurtre de Mordechai et Shalom Lapid. Selon des sources militaires, à aucun moment au cours des dernières années il n’y avait eu autant de soldats sur la Rive occidentale. (Jerusalem Post, 8 décembre 1993; également relaté dans Al-Tali’ah, 9 décembre 1993) 10. Le 8 décembre 1993, il a été signalé que le Service général de sécurité et les FDI avaient récemment arrêté des dizaines de militants d’organisations opposées au processus de paix dans les territoires. (Ha’aretz, 8 décembre 1993; également relaté dans Al-Tali’ah, 9 décembre 1993) 11. Le 9 décembre 1993, B’Tselem, l’organisation de défense des droits de l’homme, a signalé qu’au cours de la sixième année du soulèvement (décembre 1992 à décembre 1993), l’armée avait tué 165 Palestiniens, contre 121 l’année précédente et 97 l’année d’avant. B’Tselem estimait que 1 095 Palestiniens avaient été tués par l’armée depuis le début du soulèvement, le 9 décembre 1987, alors que d’après l’Associated Press, 771 avaient été tués par d’autres Palestiniens.

    Since the beginning of the second intifada, in September 2000, Israel has imposed restrictions on the movement of Palestinians in the West Bank that are unprecedented in scope and duration. As a result, Palestinian freedom of movement, which was limited in any event, has turned from a fundamental human right to a privilege that Israel grants or withholds as it deems fit. The restrictions have made traveling from one section to another an exceptional occurrence, subject to various conditions and a showing of justification for the journey. Almost every trip in the West Bank entails a great loss of time, much uncertainty, friction with soldiers, and often substantial additional expense. The restrictions on movement that Israel has imposed on Palestinians in the West Bank have split the West Bank into six major geographical units: North, Central, South, the Jordan Valley and northern Dead Sea, the enclaves resulting from the Separation Barrier, and East Jerusalem. In addition to the restrictions on movement from area to area, Israel also severely restricts movement within each area by splitting them up into subsections, and by controlling and limiting movement between them. This geographic division of the West Bank greatly affects every aspect of Palestinian life. THE SOUTH HEBRON HILLS SOLDIERS TESTIMONIES 2010-2016 ISRAELI SOLDIERS TALK ABOUT THE OCCUPIED TERRITORIES Introduction The South Hebron Hills is the southernmost part of the West Bank and includes the Palestinian towns of Yatta, Dura, Dhahiriyah, and the surrounding rural areas. The region includes approximately 122 Palestinian communities which together house close to 70,000 people, as well as roughly 8,500 settlers who live in settlements and unauthorized outposts affiliated with the Mount Hebron Regional Council.* The Palestinian population of the South Hebron Hills is primarily composed of Bedouin, as well as fellahin (farmers or agricultural laborers) cave dwellers, who lead a rural traditional lifestyle, earning their living primarily from agricultural work and sheep herding. Some are refugees who arrived in the West Bank after being expelled from Israel in 1948 and the years that followed, while others are descendants of families who have been living in the area for hundreds of years.

There are about 2,600 settlers and 49,000 Palestinians living in the old city. Quds • A report from the Israeli Ministry of Interior stated that the money provided to the settlements in the Palestinian Territories is about eight times the amount provided to the development of towns in Israel proper. Quds • The Israeli soldiers stormed Burin Village, in Nablus District, and also bulldozed the main road that leads to the village. Jadeeda January 2, 2002 • In Bethlehem District, the settlers of Kfar Etzion settlement uprooted 400 olive trees and vineyards from land in Al Khader village. These lands belong to the brothers Yosef and Khalil Jaber, and to the brothers Judah and Muhamed Sbaih. Yosef Jaber said that the destruction also included wells, water pipes, pine trees and 25 thyme, 60 sage and 70 cauliflower plants. Companies traded in the United States: THE BOEING COMPANY The Boeing Company is a multinational arms manufacturer headquartered in Chicago, Illinois. In 2012, it was listed as the second largest arms supplier in the world. The company has provided Israel with AH-64 Apache helicopters, F-15 Eagle fighter jets, Hellfire missiles (produced with Lockheed Martin), as well as MK84 2000-lb bombs, Joint Direct Attack Munitions (JDAM) kits that turn bombs into “smart,” guided bombs, and the Harpoon sea- to-sea missile system. The Israeli Air Force uses various other Boeing aircraft for transport and refueling, and is anticipating the delivery of Bell Boeing V-22 aircraft. Boeing has long-term cooperation agreements with the Israeli weapons industry that include the development of the Arrow anti-ballistic missile system (with Israel Aerospace Industries) and the marketing in the US of the Israeli UAV military drones Hermes 450 and 900. Apache helicopters and Hellfire missile-equipped drones are the primary tools used by Israel for attacks on urban Palestinian areas and “targeted assassinations.” Human Rights Watch, Amnesty International, and United Nations commissions have reported the repeated and regular use of weapons in human rights violations and war crimes committed by the Israeli military in Lebanon, the West Bank, and Gaza. According to the UN’s Fact-Finding Mission to the Gaza Conflict, missiles fired from Apache helicopters targeted civilians during Operation Cast Lead in Gaza in 2008-9.
